  1. I too am surprised there's no meter. If you don't have a meter I cant see how you have a supplier, especially if you've never received letters. It's the supplier that you pay your bill to, so if you don't have a supplier I question who you own the money too. Roughly how old is the property please? At the fuse board in the property can you see 2 thick round cables (meter tails)? They are likely to be the only round cables and quite thick - can you see where they go? Please don't remove any covers or make anything potentially unsafe in the process of looking
  2. Ok sorry to be hypothetical - I imagine conjuring up the worst case scenario is why most people just pay up. We will carry on paying at the current rate and wait for the DSAR to come back. Thanks Andy, S.
  3. Bankruptcy - would that not strip my father of his assets (i.e the remainder of his property? (Property worth say £110k, Charges ~£5k, therefore equity of £105k.) This would be just as detrimental as a forced sale.
  4. Thanks andy OK I shall continue to pay the loan at the current arrangement (£200 a month). The current arrangement runs out at the end February, it was set up on the phone and they only agreed for 3 months. They might start action then? We'll wait and see. When you say execute, does that mean they take him to court to claim repossession their outstanding balance through the sale of the property?
  5. I was going to go down the hardship route and found this template, I started to modify it but now wonder if it's necessary. Whilst he is in hardship is it worth it now, the interest has built up and up anyway? I was also going to make a point that he was in hardship and that any further payments would be a token payment but suddenly felt I was getting in above my head.. Anyone got any thoughts?
  6. DonkeyB - yes we will go down the route of both unlawful charges and missold PPI Thanks all for your help. I had come to the conclusion that I was going to have to get a loan to pay this balance off for my father, but with a bit of luck it won't come to that .

  8. Good Morning all, Has anyone had any thoughts about our options when it comes to paying our current arrangement, or more to the point, not paying our current arrangement? I imagine not a lot can happen now until we get the SARs through, and then we can start calculating what we feel we are owed?
  9. The letter regarding PPI was actually to try and claim on it as my father was out of work. Surprise surprise it had run out so he couldn't claim. It never went any further. The solicitor costs might have been the beginning of court proceedings but maybe it didn't get that far? He can't remember :-/ sorry.
  10. I think you're right.. I think the credit agreement calls it a mortgage? (Sorry I'm using my phone). Not that it has much relevance but it was sold as a loan, well at least my father believed it was a loan.
  11. I have ordered the title register but for some reason I'm struggling to find the document, I have a worldpay transaction ID (by email) but land registry website can't find it. I will ring them up shortly.

  13. Morning Jon, He has no other accounts, but has had (which he has been in fincancial trouble with). The CCJ could have been longer than 6yrs ago. Is 6yrs significant when it comes to CCJs, or is it just that they don't show after 6yrs? Will apply for his credit reports today.

Is it worth applying to all; experian, equifax and callcredit - to cover all bases? Yes Jon, the paperwork is in your desk I won't lose faith, though I can see it's easy to - yours and everyone's help and support from this forum would be in vain if we backed down. Also the blighters(mild to what I wanted to call them) would win! S
  15. Hi Dx, thanks for your reply. He is sure it did, but can't remember the outcome, nor does he have any paperwork for it. It was a long time ago if it did. He remembers receiving a letter saying that he didn't have to attend, so he didnt! Sadly we might have to wait for SAR to return before we know for sure.
  16. I have today sent the SARs off. I used a different template in the end as felt it was more specific. I sent both to GE Money and Cigna. Cigna were the providers of the Insurance. Cigna: GE Money: As I have previously said, my father has been paying £200 a month by Direct Debit post completion of the loan. This is due to be reviewed at the end of February. Now he has been made redundant he will be on Job Seekers allowance (approx £70 per week). Ultimately he cannot afford to continue paying near this amount. If he were to stop paying would this put us in a worst state, is it likely that they'll repossess his property? I am able to give him the money to pay if necessary, and if really necessary I could hopefully get a personal loan to cover the outstanding amount. Because it is secured and ultimately a mortgage, not paying could make things worse? Before we found CAG I phoned GE Money. I said that now the loan was paid off and it's just charges and fees outstanding, will the deeds to his property be released. They said that they would only be released after the outstanding balance was paid off. Thanks. S

  18. Thanks HB and Andy for your replies. No this arrears account doesn't have a seperate account number. In fact it seems to be exactly the same account. These fees/charges/additional interest were lingering but not showing as an arrear until after the loan was paid off (November 2012). I have got some documents from my father and have scanned them in (see below). He definitely had PPI which he was verbally told he needed for the loan. They acknowledge he had PPI '1002 Response to PPI application.pdf' as once when out of work he went to the CAB for advice, they tried to claim on it only to find it was out of date. A few things that have been highlighted to me by someone; on the credit agreement there is only one signature for both the PPI and Loan, not multiples. It appears they have been charging interest on the PPI. In regard to the bailiffs - we believe it was an overdraft from another bank that instructed these, I will remove them from post #1. I have got other documents, but mostly statements. I do however have a Full account statement from 11/2002 - 08/2012. It's a lengthy document but I can scan in if it helps out. I will send off the SAR tomorrow. Many Thanks!
  19. I am looking for an address to send the SAR to. I have found this contact address on their website: Shall I send it here addressed to 'Data Controller' instead of 'Resolutions Team'? Searching around I find conflicting addresses to send it to, but as this is on their website I feel it's likely to be the one? Also I am going to send a letter requesting that all further correspondence are carried out using letter only. Does this sound acceptable? Many thanks.
  20. Honeybee and Andy, thanks for your replies. My father is going to check his paperwork so I will respond tomorrow. I have got some paperwork here which makes me think it's going to have the same account number. This paperwork is from March 2010 so out of date but it may give us an idea: It seems here that they have amalgamated the loan and the fees. I'm sorry I don't have the latest information but I will get it tomorrow to confirm the above. I will also get the SAR sent off ASAP too. From what we read this isn't a quick procedure, I imagine it's best for us to keep paying whilst all of this is going on? Many thanks.
