  2. I was only suggesting hypotheticals and not what I thought would happen. I personally think we should have joined the euro and we should have joined Schengen but that was then not now. Maybe you can answer some of the questions I asked
  3. Well of course if Corbyn is a Marxist he will call himself working class as (as far as I know) he does not own the means of production of anything other than this thoughts. I agree with you that Boris is just an opportunist and I also agree that Corbyn is in a somewhat difficult position because he is a legit supporter. I am not sure what he is promoting that you think is incompatible with either membership of the EU or close alignment. Which good MP has the NEC deselected - lets face it Roger Godsiff is against core labour values of non discrimination. And this is a difficult point , Corbyn is anti the ruling power in the state of Israel, I have not seen any evidence he is anti Semitic although they should have acted more swiftly.
  4. Nothing like taking a quote out of context is there so you can bash Corbyn. Do you not see that by bashing him all the time, you may help the Tories actually get in . Not every constituency have realistic alternatives to the Con/labour dichotomy.
  5. I asked the questions because I do not know the history of the account(s) and I like many have been guilty of not reading all correspondence sent to me. Did you make the request to Payplan for information under GDPR? If that is the case they have a limited time to reply ( I think it is 28 days although they may ask for more time). So do you think these visits are about an Idem account? If that is the case I really see no harm in writing to both Idem and resolve call as I outlined above. The problem is if you do not know what the debt is about you can not deal with it and are leaving yourself open to the possibility of a court claim with all the angst that comes with it. If you know what the debt is, you could maybe send a CCA Request (if you haven't done so already) to see if it is enforceable at that level although as I always say, there is a lot more to defending a claim than non compliance with S77-79 or an improperly executed agreement.
  6. The problem you have is that you are not sure just which debt this is. Do you open all your post and are payplan forwarding any post they get? I know what I would be doing and that is to write to them and say something along the lines of I have no idea what these intrusive visits are about. My health is not good (if it is mental health say that ) and in future please refrain from visiting my property and keep all communication in writing. Once you establish what this relates to I will be in a better position to make informed decisions. That is just a general idea - send it Royal mail signed for (or just get a free proof of posting if money is really tight). Remember these are just debt collectors (or at least from what I can see they are) and have no power to do anything. To be perfectly honest it might do no harm in actually talking to them just to establish what it is about but they will usually want to check name date of birth etc and I never do that over the phone. But above all remember they have no power and although I can only talk from my one experience of Scotcall some time ago, they were decen, polite and just doing a job- we don't all have the luxury of placing morals in front of getting a job.
  7. Well I kind of think that being forced to stand for re selection is in principle no bad thing. It will get rid of lazy incumbents who are neither good constituency MPs or good parliamentarians. Remember it is onluy 1/3 to trigger the re selection process. The problem is of course the way the Labour (and Conservative) parties are made up of activists. By their very nature activists tend to be at the extremes of the ideologies. In labours case currently more left, in the Tories verging on the far right - these are often older middle class seekers of empire , well at least in the Shires it is. I am delighted that the MP for Birmingham Hall Green has been deselected although I hope this won't let the Tories back in (unlikely considering the majority an the fact JLR have been a central employer heavily impacted by Brexit.
  8. I am saying that local parties have been slow in finding candidates. My area is ripe for the taking with the sitting Brexit MP standing down. He has a large majority but has been here for 30 years and IS a good local MP. I know he intervened on my behalf several years ago with the DWP and they wrote off over £1000 they has wrongly paid me over the course of a year. It was an amount I genuinely believed I was entitled to and I had kept the DWP up to date on my status. They had failed to act and a charity had assured me I was entitled to the money. If he did that for me I am sure he will have done things for other people so will lose that good will
  9. I am really not sure that sort of comment is either helpful or true. I do have some concerns about Momentum, it seems they have caused problems in selecting people who may have been good candidates and as for the areas that have no candidate in place it is criminal neglect but I am not sure who exactly to blame.
  10. Did I say anything differently? Again, did I make sweeping statements (apart from it helps if the agreement has been assigned, which it does This gets technical so you might not understand. If the agreement was pre Apr 2007 you would expect the lack of a signed agreement to be fatal to a claim BUT it relies on the individual stating they did not sign any agreement AND the Judge believing them - See Arrow Global V Frost - they lost when no agreement was produced. Post 2007 the law is much fuzzier and the courts can enforce even with no signed agreement if they can demonstrate the money was advanced . It maybe that the Judge places some sanction such as a reduced amount but it is up to the judge. An example given is the Iron Mountain Fire. If a bank sends all its documents off to be stored - should they automatically be disadvantaged if these documents are lost due to fire , flood or natural disaster. http://www.legislation.gov.uk/ukpga/1974/39/section/127 I said that very thing, a CCA Request is for information purposes only . Enforceability is a lot more complex than just a CCA Request and you are right- the wrong judge on the wrong day and you would lose.   11. Just to add my thoughts. I had an online Vanquis card from 2010 which was sold to Lowell. Lowell closed the account for reasons I do not know but I do know what I had in my file as a DN was flawed. Of course while in law that should be enough, get the wrong judge on the wrong day and you might lose. Sadly since 2007 the lack of a signed agreement with the prescribed terms is not an automatic case of unenforceable. For this reason I would not get too hung up on the bank needing to produce a signed copy. It always helps if the agreement is assigned as the glow of paperwork may be limited. Without seeing the Deeds of assignment and accompanying literature it is again difficult to express an opinion. Lastly and finally for this, the S77-78 request is for information purposes only. If the debt owner produces what they truly believe to be the agreement they might (and in the past have) get away with it. I would link you to a couple of blogs but they are attached to commercial concerns.

Toby With respect because you are entitled to your opinion, just as Farage supporters are entitled to theirs, I think you have misinterpreted what I have said and are also wrong on some points- although if you can provide evidence then I am happy to listen. I have never said Corbyn is perfect, in fact far from it; I think he is the wrong man for the job but he is the leader of the Labour Party and I will support him as such until an opportunity presents itself to find someone better. I agree you have critiqued Johnson but too often it is a secondary critique of comparing Johnson and Corbyn. Remember, whoever becomes Prime Minister has to try and bring along almost 50% of the people who voted (and therefore have a right to complain) the other way. I have seen the stats about About Party activists bringing motions to Conference but we know that the majority of regular Labour Party members do not fully engage with their local party . So my question on that is How do you know what the 'vast majority' of labour members think? Corbyn is definitely Labour but probably more left wing than we have seen since the 1980's if not before. You say I can not clarify his stance on the major issue - I can. It is to bring a second referendum with one option being to remain. It really can not be clearer than that. The substance of those deals is in the future so no one can say exactly what the situation will be- for a start we have to hope the EU offer us a further 5 months extension to get that second referendum done. My critique of the LD are that I worry they are Orange- that is Neo liberal capitalists and I am against Capitalism and believe in Socialism with ultimately the means of production being owned by the people (the State). I believe this can then be run in a profitable way which will enhance all our lives. Is it right that the profits made by the travel companies along with Utilities and more go into the pockets of rich often non EU let alone British shareholders who pay little of no tax. I also can not see a Lib Dem majority and while I do not necessarily believe it when they say they will not support Labour , their stated position is they will only work with labour to stop a no deal Brexit. This is very different to working with Labour to put a deal on the table with a remain option. Much as I hate to say it, I do think the only viable option is to put some form of deal on the table- if nothing better can be worked out then May's deal against a remain. If a referendum then supported that deal, I would, with regret have to go with it. My anger against the rhetoric of the leave campaign is because we know there were lies told and we know that people voted for different versions of leave- people I speak to who admit voting leave often say it was the ECJ or even the Parliament they were against but many do not even know just how EU laws are passed; some even quoted the ECtHR. I also think the remain campaign was a shambles with no-one going up against the lies told. We both want the same thing on the major issue but we have different ways of getting there. You want ( I think) a Lib Dem government, I want a Labour one. As for JRM , well he may just be an asset to the Labour Party
  13. You seem to be putting all your energy into a hatred of Corbyn. This will not get us where we need to be. All it does is play into the hands of the right wing Tories. I am not convinced the Lib Dem’s are not orange book , Tories in sheep’s clothing which has been reinforced with Swindon actually saying she won’t do a deal with Corbyn. If we really do need her and him to decide to support each other in key marginals, what then?What happens, do we get another minority government with a confidence and supply agreement? There really does need to be a labour government . We need some democratic socialism to get us going. Do not let blind hatred get in the way of pragmatism. You talk about Sinn Fein and unionists , remember we actually need MPs who take their seats to defeat Johnson.
  14. Well Jo Swindon has ruled out a coalition so maybe that’s a fools hope. I think you confuse what Corbyn may have or may still think with the pragmatic approach he will need to run the country. what we must avoid is a disaster of a Tory government. It’s interesting there are at least two areas I know of with no labour candidate. One is Bosworth where the sitting Brexit MP is retiring with a half decent LD opponent and Eddisbury where Antionette Sandbach is standing as an independent. Both are quite rural with huge farming communities. You may not like Vorbyn but we need to be pragmatic and vote accordingly. Do not let your blind hatred ruin this countries chances
  15. Remember they do not need to provide a signed copy just a copy of what you would have signed. They also need to provide all relevant T&Cs at inception and default along with a signed statement of what you owe. If the debts were pre April 2007 they need a bit more to enforce. But remember there is a lot more to unenforceability than just the agreement
  16. I do not see us getting a Lib Dem majority which is the only sure way of getting Brexit cancelled. Letting BJ back in with a majority is a sure way of getting Brexit. I would say 'do the math'. You also forget that it was actually the labour strongholds of the North who voted leave, yes Sunderland and Derby voting leave was akin to turkeys and Christmas but they did and they had their reasons no doubt- yes they were lied to but not sure how to put that right.   17. they say a week is a long time in politics- that was nearly 6 months ago, before Boris, before Boris died in a ditch As I said it might be the remain option included a commitment to the Euro or Schengen but there is little point on thinking about it. We need to get the Tories out- surely we can agree on that. We need to stop the Tory wholesale demolition of the welfare state, we need created wealth to help all. We need a progressive taxation system and we a nationalised infrastructure - rail, buses, utilities. Oh yes and we need to sort out H.E. Education should be about that and not ticking boxes. These things count and will count after the election and any changes in our relationship with Europe

  19. According to the Labour Party website the vote would be on a deal as renegotiated or remain. I can’t see how remain can be anything else it might be a soft Brexit or remain but we need to get Boris and the Tories in that ditch

I think in the case I mentioned, they tried to use the thread as proof of admitting the debt. Remember LiPs can be very seriously disadvantaged if it gets to court.   21. Well both are goodish news. They have received and passed on. Now it’s a waiting game. I think it was disingenuous or RW to say they had to cancel your arrangement but there again it stops you having to do it. Just as an aside, I would also obscure the amount as we know these people trawl these sites and dates and amounts would mean they would be able to connect the dots. There was a relatively recent case where a debt purchaser put a whole thread into their witness statement.
  22. The problem is , we know BJ is a liar and will do all he can to manipulate the circumstances. We have to fix the date of the election , problem as I see it , is it makes a mockery or the FTPA . I worry about the outcome of the election. Even if the SNP it Lib Dens hood the balance of power, there will be no time for a referendum.
  23. Looking at opinion polls, it seems that as time goes on, Johnson is losing both support and respect. As such it would make perfect sense to postpone the election. The problem is, Christmas, this really means that unless we have the election in early December, it will be mid to late January before the next opportunity - after all these posh Tory boys will not want to move from their log fires and stately homes to actually meet people in December. Also there can only be so much of reduced item size and numbers before the public realise hat there is very real inflation out there. Look at Jaffa cakes, there are now only 18 in a packet where there use to be 20 - or the multipacks of Mars bars- have you seen the size: when I were a lad they were 'fun size' .
  24. Recently Amazon froze my account due to unusual activity- not once but twice. The first time it took them a week to unfreeze it, the second 24 hours. After the first release I had two separate transactions with Amazon. 1) I topped up my account with £80 to get an extra £6. I then made a couple of purchases but still have £67.01 left. This has now been withheld- in spite of two phone calls which promised resolution within 24 hours. 2) I bought two gift cards at £25 a pop. Now my account shows two balances of £25 withheld. I have a horrible feeling these are the gift certificates. I paid for both transactions with my Amazon credit card which I have now paid off in full. Do I have any comeback against Newday(who provide the CC) because the funds have been withheld. The gift cards are presents and I do not want to 'text' them but there again I daren't risk sending them if they are going to be invalid.
