I was suffering a lot of harassment from my jobcentre (in addition to my landlord): my adviser was all the time trying to make me NOT sign (pretesting for example that his computer is over, give me just one job ad while in the system he had assigned two on my profile). Previously, I have applied to JSA that took a month and half before to receive any benefit (by using a citizen advice bureau). However, since I refuse to be dependent to this kind of organization (dwp) I prefer to re-register for JSA instead of ESA (and try to find a job in the month) and to try to manage my sickness as I did during the last 6 years [eating chewing-gum all the times (due to headache), accupuncture (will need extra money for this...), etc...(presently I am however taking pain relief)].

  3. Hi all, Due to sickness I am trying to get a one day per week volunteering work. However, all I have found are organizations that want me to work for full time (I have not told them about my sickness (chronic headache)). Obviously, for the purpose to take zero risk, these potential employers want me to develop a software for them (since my previous jobs involved information technologies skills)....but all free. Since I really do not know the rules for the volunteering work, i would like to know if i have to sign a contract (even they will not pay me) and have a mandatory period for working for them. Presently I am claiming for Employment and Support Allowance (not received yet) (but may switch in next weeks to JSA if my health improve a bit more) and also I would like to know if the Department of Work and Pension will not refuse my benefits if i work full time or even once a week for volunteering work (2 months for software development). Thanks in advance for your help, Ps: All the three potential different employers I have found told me that the volunteering work could lead to a job.

I do not understand your last post, but all i can say is that due to my sensitive situation I don't think it is wrong to try have different point of view from others (others forums) and I hope the solution I have chosen will give me at least two months (since I am trying to find a job in despite of my sickness (one day/week volunteering work that could lead to a paid job (crisis + sickness)).
  5. Good advice by 45002? If yes, then you are joking . I hope you do not really think that I needed someone before to know that I have to leave a property where I am permanently harassed: I have asked help in filling a counterclaim for in this forum and nobody in this forum (comparatively with the two others forum (proudly shown by 45002)) was able to give any relevant except the 'do you know that you have to leave?', 'you may not have paid your rent', etc...useless comments for a very clear request. Please, as previously explained I am presently and it will be very great if you could not make me lose me energy for nothing. If you cannot help then just ignore the thread instead of giving 'advice' based only on your prejudices.

You really make me laught but sad at the same time : you should compare your 'advice' with advice given on other forums : totally differents (but of course you could as usual say that sky is green while it is blue...). Only you know the logic of showing that I have posted the same thread on other forum (if you think that i do not know that these links are easy to find using google) : for me your last post only says a lot about your own personality ('Op has posted same subject in three differents and also OP is wrong' : i am really sad for you....).
  7. Thanks but as I have the opportunity to make a counterclaim in my defense I will do it. Just a quick summary of your 'contribution' : a month ago when I asked someone to help me fill the n244 form you requested from the moderator (who was willing to try to find someone in forum to help me) to wait until I receive a confirmation from the court that there is truly a possession claim against me. Now, a month later, (after reception of a letter form the court regarding a possession claim)I am asking help in the forum to fill my defense form and all you are saying (despite of the fact I already explained you several times that I am sick, on my own and presently cannot move) are : - the landlord has not committed any harassment ('he has just changed the lock'...) - i may not have my rent up to date - i have to leave the property, etc... Thanks God that at least my sickness has not affected my intelligence.

And sometimes I had to call shelter several times (with my reference number) when i had new infos for the solicitor...and presently i would like to net get extra charges due to my sensitive situation. However, i may not have any other choices...and may call them tomorrow. I have made my calculation yesterday and it seems that my rent still presently up to date : i am waiting for the bank confirmation payments done to my landlord through my bank account. In addition to this I will give my last month mobile phone bill (the monthly fee deducted) to my landlord.
  9. No, last time the sent me 'Community Legal Advice' who use a 0845 number (and I had more that £100 as mobile phone bill) and the solicitor was taking all his time and did not really resolve the issue (i had to make a complaint against a police officer before to have the issue resolved).
  10. No, it is not in Northampton County Court. Presently I do not have a scanner and really sick so I cannot do the process above. The ground is : 'rent arrears'. In the 'Notes for defendant' it is said : 'You should : fill in the attached defence form and return it to the court within 14 days of receiving the claim form'.

This means that the last day I can send it is 20 February 2013 (I have sent an email to the court yesterday when I have received their letter in goal to acknowledge receipt on 06 February 2013). In the claimant claim the further £40 does not occurs : only the £260/month (the original rent agreed : my bank statements of the first three months of the tenancy prove that was the rent I had to pay). The contract has not been amended : the landlord had just sent an email for this purpose but i have respond to him explaining that i agreed for the further £40 if the harassment stop...and that has not been the case so (the harassment still continue) and i think I will make a counterclaim regarding this permanent harassment ( a lawyer told me that in case it seems to be a "breach of covenant for quiet Enjoyment"). I was regurly paying the half of the rent every two weeks. The landlord had not written against this two weeks delay except in the eviction notice received in november.
  12. Hi all, I have received today a defense form regarding a possession claim my landlord have made against me. Previously, in November 2012 I have received an eviction notice (notice requiring possession under Section 8 (grounds 8, 10 and 11) & section 21 of Housing Act 1988) from my landlord with a deadline of 05 February 2012). However on 05 January 2013 (expiry day of my tenancy agreement (but one month before the deadline of the eviction notice), my landlord (despite of knowing that I am sick) have tried to unlawfully evict me by changing (without a 24 hours notification) the lock of the front door of the building by a way I could only come out but not come back in (he didn't give me a copy of the new key) : As a result I was locked inside the property for 6 days. I had a one year Assured Shorthold Tenancy Agreement that will ended on 05 January 2013, but I have not found another accommodation due to my sickness. Based on section 8, he is claiming 2 months rent arrears but for my point of view at the date of my landlord possession claim the rent was to date. Previously, in the eviction notice my landlord had claimed that I had two months and two weeks rent in arrears while I had only two weeks arrears at that time (due to housing benefit payment delay). - The court form is dated 1st February 2013 but I have received it only today : also, what is my deadline to return it to the county court? - Originally I was paying £260/month (single room) (it is this amount that is on the possession form and eviction notice letter) all inclusive during the first 5 months of the tenancy and after the landlord claimed informally (when the harassment started) for a further £40 so after that he and the new tenants will stop the harassment. Also I was paying the £300 (£150 every two weeks) instead of the agreed £260/month but the harassment continued (no right to use the gas (kitchen), tenant who are relatives of the landlord slap the door while the well know i am suffering severe chronic headache,etc...) : on the 11 January 2013 after beeing harassed again by the landlord I have just deducted the £40 paid each month during the last 7 months (£40*7 = £280). This deduction has been made on the ground of 'breach of quiet enjoyment. Due to the fact that was locked inside during 6 days I had to call a lot of 0845 numbers for advice and that increased my mobile phone bill to above £100. However I have not take this last bill in account regarding my rent payment. Also, if I was right to do the above deduction then my rent arrear (but only on 05 february 2013 but not at the date the landlord has apply for possession) is only from 25 February 2013 to 05 March 2013 (height days). Thanks in advance for your help, MoonTop Ps : The landlord had tried to unlawfully evict me several times few months ago. My rent payment is presently up to date but I had two weeks delay during the last 10 months due to the Housing Benefit payment delay. Presently, I am appealing for an esa claim that has been rejected.

I have an appointment but only at the end of this month : it will be with an welthare adviser that helped me previously when I firstly claimed for JSA (i had a similar problem) : I hope after my appointment with the CAB it will be possible to 'Have you arranged for someone to represent me at the appeal'.

Hi, I have made a claim that has been rejected by DWP (regarding my eligibility for esa ('right to reside')) and I have just made an appeal without my local citizen advice bureau (their next available date was in a month...). Also I have ticked 'No' for the question 'Have you arranged for someone to represent you at your appeal' but due to my health I am not sure that I could attempt this hearing. - What are my chances that the appeal to be fair without my presence? - Should I still searching a cab adviser that could represent me at this appeal? - How many times this appeal will take before a date for the appeal?   16. hello, It seems that in fact I am a director of limited company (but alone in the company) instead of a self-empoyed person : also class 2 nic is not relevant...but i am not sure. I have just realized that I have made a mistake in my esa form : I had wrongly ticked 'self-employed' instead of 'Employed by an UK employer' (my limited company). But DWP is just using this small mistake to make me loose time.

  19. Hi all, I set up a limited company in 2009 and my profit and loss account was alltime less than £5000 and i did not also paid for Class 2 National Insurance Contribution. However, I have forgotten to apply to the Small Earnings Exception certificate (i was relying on my account who was a bit negligent) and presently I am urgently needing this certificate to prove that I am really self employed. Thanks in advance for your help. SilverOne
  20. Is it too late to claim for certificate of small earnings for 2010, 2011 and 2012? I was under JSA after a period of three months sickness until December 2012 : I have closed my JSA claim in goal to make the present ESA claim. Ps : A copy of the 2012 self assessment form sent to the HRMC has been sent to DWP.
