  1. Hi All, Has anyone actually challenged in court the Lenders Deed of Appointment of Receiver ? With specific regards to the incorrect signing of the Deed in accordance with the Companies Act 2006 ? Or indeed any other reason that made it invalid ? If so what was the outcome, any info would be most appreciated. Thanks
  2. Hi 999. It is not just MX who are stealing our BTL property in broad day light - hiding behind the antiquated LPA 1925. Chelsea Building Society appointed Allsop Receivers for just 2 months arrears, yes two months arrears. I offered the £1,700 in full payment, this represented two months arrears and next month ahead,payments would of been completely up to date. The caring, ethical Chelsea BS refused to accept my payment and call off the Receivers,Why ? Receivers Allsop told tenant DO NOT PAY LANLORD but Receivers did not bother to collect rent for 15 Months, yes 15 months. The debt has now multiplied 10 fold, Why ? Together these so called INDEPENDENT companies have deliberately pushed me into this bad financial position. They are selling my property at a fraction of the value, which will leave me with a huge deficit. Why ? I asked Chelsea who in a bouyant rental market would sell in a depressed market ? Chelsea state they are happy with Allsop Receivers management, Why ? What's this all about ? It is unreasonable and totally avoidable. The stress is destroying my family life,for that reason alone I want to free myself from being a mortgage prisoner but can't. Chelsea are aware I have recently survived a life threatening condition. I blame both Chelsea and Allsop in directly contributed to the cause of this. I cannot take the stress any more, my health is deteriorating once again. I fear this stress is going to kill me,when it does remember you read it here, know that Chelsea and Allsop have my death on their hands. If there is anyone who can offrer any advice please do so now.

  4. Hello Psg2008, I am in a similar situation the stress of which has almost killed me. Who is your Lender and LPA ? mine is Chelsea BS & Allsop LPA.
  5. Hello Ell- enn Thanks for the Info. I am in a similar situation as Psg 2008 can you please help me ? Can you tell me if a BTL mortgage is a Commercial or a Residential loan ? I believe it is a Residential Loan, if that is the case it is not under the remit of an LPA, would you agree ?
  6. Hi Keats, Thanks for info. Can you please help with these Q's Chelsea BS unreasonably refused payment in full of 3mths mortgage arrears and instead appointed Allsop Fixed charge Receivers. They have put my BTL for sale £30 K less than my outstanding mortgage, no court, no permission from me, how can I stop it ? Should the Lender or the LPA have provided me with a copy of the LPA Appointment Document ? Is a BTL a Commercial or a Residential Loan ? Thanks
  7. I am glad to see you are getting support from the site. This is my first time using a site- do not feel confident but forced myself because I am also in need of help from anyone who knows how to challenge a Fixed Charge Receiver. It is not my home as it is yours but a buy to Let, Yes I am a Landlord which seems to be a dirty word when you ask CAB to advise because you cannot afford to pay for legal advice. I am very hardworking and have always maintained my property well and had a good working relationship with my tenant. On an interest only mortgage at 6.04% I have made absolutely no money but was looking at the long term for my Retirement. This action of Receivership will bankrupt me for less than £2,000 mortgage arrears. Immediately on being told by Yorkshire Bank trading as Chelsea Building Society for the first time I offered full settlement over the phone using my Debit card. Chelsea refused my offer of settlement saying they had appointed the Receivers Allsop two days earlier. I had called Chelse two days before that to discuss other matters and was not told of the impending action ? Is this legal ? Chelsea denied I offered settlement but I managed to get a copy of the recorded conversations. Allsop look to be getting paid hansomely from my family's abject misery. thed debt is likely to exceed over £60,000 and was totally unecessary. Allsop stand to charge three times over because not only are they Receivers,they are the Management company ARIM and I believe Estate Agents and Auctioneers. Talk about conflict of interests ???? Is this legal ? Allsop Receivers have RECEIVED not one penny in rent because they did not ask the tenant for it in over twelve months. The reason Allsop gave was that I was having Chelsea investigated by the Financial Ombudsman ? However the Ombudsman confirmed he did not instruct Allsop to not collect rent or evict the then non paying tenant. They took this financial decision yet Allsop claim to be an Independent company to Chelsea, HA! Ha ! Why did Chelsea tell them to do nothing ? This stress has severely affected my health, I literally survived a life threatening condition directly because of Chelsea/Allsop action.I am desperate it is a living nightmare, is there anyone who can help me and my family ?
