  1. Thanks, the LBA letter is off tomorrow then!!
  2. Hi, I have recently sent my prelim letter to claim my husbands charges. This will be the second time we have claimed, last time was settled in full with no problems. The letter I received back from the bank said that they have acknowledged the complaint but until the proceedings with the OFT are concluded they cannot proceed any further. I would like to know if I should continue with the claim and send my LBA? If I do continue with the claim will it be settled as before or will we have to wait until the OFT proceedingshave been completed? Many Thanks
  3. Thanks for the advice. I haven't sent anything off yet so I will go with your advice. Thanks for all your help!
  4. Thanks for the advice, just needed to check that I didn't need to get my suit out! I will try and speak to the solicitors tomorrow ayway just to check. My claim was for £1298 so I was quite happy with their offer and going to accept it. What will happen if I do reject it? Also any idea what happens to the £120 fees that I had to pay to mcol? Thanks again!
  5. Hi If someone could shed any light on this I will be eternally grateful. Yesterday I finally got a letter from DG Solicitors offering a payment of £1198 as a full and final settlement. I was obviously pleased until today when I have received a transfer of proceedings to my local court! They seem to have filed a defence. I have called the court and asked for advice as both letters seem to contradict themselves, they have no answers. they suggested I speak to DG Solicitors but I cannot get hold of them now. Does anyone have any experience of this kind of practise?
  6. Hi I think I'm in the same boat as you. Had the £10 for my statements sent back, sent off the letters and received a eply in Sept. stating that their answer was a firm no! I have finally found the £120 court fees and submitted my mcol today. I am just worried because I have now committed myself to the £120 and am concerned that HSBC will put up a fight as I had to declare myself bankrupt last year because of the charges they were imposing and I had a lot of debt written off with them! Any words of encouragement or advice from anyone in a similar situation would be appreciated.
  7. Well...look at this for an update! I was resigned to waiting to find £80 to do the MCOL then today my partner called me at work to say he'd received a letter offering £540 (only £60 shy of what I was claiming)! We are going to accept this as it has taken long enough to get here. Just to say if you don't have enough money to do the MCOL then patience may just pay off! I'm off to start my claim now!!

  9. Thanks for the advice I will do it this way!
  10. Looks like we'll have to wait til we've got the money for mcol then!
  11. In response to Robokop...do you think it is worth going through the process again but sending it recorded post?
  12. Hi I'm claiming my partners bank charges back for him. So far I have sent the prelim letter 21st June (no response) then the LBA 16th July (no response). I believe that at this stage I must now claim the money through the courts. I filled out the money claim online form but did not realise that the fee is £80! Is there any other option to claim our money back as we will probably not be able to find this sort of money for a while?
  13. Hi! I had an account with HSBC for 15 years and last year had to go bankrupt due to the spiralling amount of charges that they were placing on me. I am now discharged and the account closed but it it still possible for me to claim back my charges?
