I've sent letter to the council asking what LO they have as I'm still convinced they don't have one and a statement of my payment plan saying they will be receiving all payments and Rossendales can do one. I sent a letter to Rossendales asking for a breakdown of fees for the account as they have merged two accounts into one and that they will recieve no payments as they will go directly to the council. No response as yet. Because if how the cab sent the wrong info in I will be paying £50 tomorrow to the council although I've already paid it and don't owe it but I don't want to give Rossendales a chance to say I've defaulted.
  2. Thank you, the council man stated that the payments go on there computer and then they send the info to Rossendales. So I will send letters again to council and Baliff instructing them of what I am doing and when payments will be made and stick to those dates. I know there going to hassle me but the worse that can happen is they take me to court ( I have 3 locks on the door they won't break in) and as I am already paying the amounts the debt will be cleared in may next year!

  4. ive spoken to roosendales the amount i paid to the council on 8th october which was £50 is classed as septembers payment as i only paid £25 in september and the cab said i would pay £50 bearing in mind it was before i saw cab that i paid the £25! Rossendales have joined the two acccounts together although i bet there is still 2 lots of fees and levy which wont have been taken off yet, and they still want a payment of £50 by the 31st as they are saying the payment i made on 8th oct is classed as september. im kind of really fed up with all of this with the council guys attitude i will make a formal complaint anyway jut cos he peed me off, but do i pay council or rossendales?? Also i can only make the payment of £225 not £275 do i pay £225 regardless every month on time as i am showing that i am willing or do i have to pay £275 which i am afraid i will fall behind with? do i pay council or rossendales? (the council guy said to me we inform rossendales of all your payments anyway) should i also rewrite to them as now it is one account should i request a breakdown of fees again funnily enough this ref no is the one they didnt send the subject access request for or am i bascially just wasting my time? also does anyone know or successfully been to court over these issues as my thnking is let them go to committal hearings all the court will do as i am showing willing of payment is to keep making me pay? can i request it goes to court or does it have to be the council?

Having just spoke to the council who insist the account will stay with Rossendales they have just said there not interested if they are charging me for one account or two and if my payment plan is for one account or two that's the payment arrangement that's been accepted. My offer is £225 a month that is it not £225 and £50 or £275 and £50 that Rossendales want! I will default on payments as can not pay the two payments together. Really really annoys me. I said to the guy I've been in reciept of advice from here and basically I am going to make a complaint he said go ahead your Account will stay with Rossendales.
  6. Hi please help with the never ending saga! I enlisted the help of the cab they sent a letter to Rossendales after I had sent my letters to the council and Rossendales offering a payment arrangement I had said to them following advice from here that I won't be paying them but the council instead but this letter was sent to Rossendales instead. The issue is I explained to the lady at cab that I can not give accurate figures of my self employment as my wages fluctuate but she did the sums and determind I have £50 left per month and this was to be paid to Rossendales when I had offered them £25. So I changed my payment to £50 I paid my payment on the 8th oct to the council as previously stated in the letters to them, I have one more payment on another debt left and them payments of £225 are to be made to the council. Today I recieve letters from both Rossendales and cab saying my payment plan to Rossendales is accepted and that my next payment is due 23rd. But as I stated in my original letters I can not pay it to the 10th nov and will be paying £100 then ( Rossendales want £50) to the council?! Because of the working outs on the financial statement Rossendales want £275 a month and I wrote to the council saying I would pay £225 as I had managed to always make this payment for another debt. So do I still send the letters to Rossendales and the council saying I am inferring £225 a month but only to the council or am I now obligated to pay £275 to Rossendales. ?
  7. I do know the council holds meetings in the court but if you agree to a payment order you do not see the magistrate, it's there way if not tying up the courts, so I'm not sure it even ends up as a LO. Just a payment plan you agree to with the council.
  8. When I contacted the magistrates court to try and find out the info myself they told me there was no LO registered against my name in last 3 years!
  9. Right guys I will be typing up the letters in the morning. Just want to clarify things I am making a formal complaint to the council stating that I will only be paying them, I will not deal with the baliffs and I wish to complain about the baliffs as I do feel I have been treat un fairly due to excessive fees being applied to the account and not providing me with the info requested. Also the council told me they had £300 in fees listed on the account but the one subject access I recieved did not support this. So why tell me that. How do I challenge Rossendales fees? Also I intend to find out if what magistrates liability orders they have as this question is still not answered and I believe they have none, so am I right in thinking its unlawful for them to pass it to the Baliff without one? Also I need to send a letter to Rossendales to tell them the cab have my payment plan listed wrong but basically they won't be receiving any money anyway as I won't be dealing with Them?
  10. Please more help needed. I sent the letters to the council who say I don't fit there vunerable criteria and other issues I raised like the Baliff levy on goods that where not a proportionate value I was told to speak to the Baliff about. Whilst I have been waiting for this response I made my payment online to the council. The cab sent my financial statement to Rossendales instead of the council although I asked otherwise and have listed my payment offer wrong. Rossendales sent a letter saying they will accept this payment. I am still waiting for the subject access request for one of the accounts. I do not want to deal with the Baliff and intend to make all my payments to the council regardless. Do I write back to the the council and tell them this making sure they have the correct payment plan I offered, and wrote to Rossendales to basically say where's my second subject access request as intend to challenge there double fees and that I will not be dealing with them and will only pay the council. Even though they have a wpo? Or do I just pay online regardless of what the letters say?
  11. Hi having sent my original letters to the council as yet I have had no response. The 14 day deadline for Rossendales to respond is Thursday that is 14 days plus 2 for postage I will have allowed. I made my payment online on the 8th oct direct to the council making sure I used my acc no and have written the reciept number. One thing I still want to query Is is this action even legal I know the magistrates court do not have a liability order for me as I have checked with them on 3 occasions and have been told there is no LO attached to my name. Also is the next step the formal complaint? Is this to ensure that they deal with my account? Also drop the levy fees and double fees on my account from the baliffs? Although I do not have in writing as they are yet to respond to my letter. ( I know they have it I sent it special delivery) any advice would be greatful.
  12. If you can make the payment you said do it online direct to the council themselves. Just go on bill payment. Then call them and tell them you have paid whatever and want make a payment arrangement. The other guys on here will give you further advice but the fact you made a payment to them may help.
  13. I was made bankrupt in 2008 obviously I am discharged from bankruptcy. I have since moved house, I do still have debt which have resulted in a ccj and liability orders for council tax. I can not get a current account with Lloyds tsb and are always refused for credit. What can I do to build my credit rating? I am self employed and not on a great income so do not have regular wages as take home pay.
  14. Sent you a pm. I read somewhere else that to ask the council what addresses the LO was made against? I know it won't be my now home address as I did not live here at the time does that make a difference? Can I challenge that the LO are out of date and that Baliff action/ wpo are not valid due to it should have been sent back to the court??? As yet I have had no response from the council and will make my payment online on Tomorrow due to it being due on the 8th.
  15. The only time I allowed the Baliff in when he did the wpo he has charged me a WPO Order fee, a levy for the goods, a first visit fee on each liabilty order there is two. Can they go this or is it one fee per visit regardless of how many liability orders there is?
  16. Also one thing I learnt start making payments online to the council only for the amount you have offered to make a arrangement for. Do this as soon as possible and always make sure you use your account reference number. Also start keeping a diary. When they start quoting to you I called you on, visited on, etc you will now exactly what happened on which day. Also try and see the citizens advice easier said than done.
  17. Thanks like I say I am sending another letter stating my case and delivering it in person to howden house the councils h.q.. and posting a second copy. I will make my scheduled payment online etc. If my case did end up going to court I know u would only be made to keep to a arrangement which I am already doing. My only concern is the Baliff breaking in and seizing goods when I'm not there as I won't let him in otherwise.
  18. Thank you. I have wrote again to the council stating my case with copies of reciepts of payments I have made and have stated that I will only deal with them and I will pay directly to the council only. I will copy the info above to Rossendales.
  19. No goods have been seized as yet but it is from my house the wpo was made. The business rates are from two years ago when I was a sole trader.
  20. The business no longer exists. The items on the wpo are tv, DVD player, coffee table, tv stand microwave. There's goods did not cost more than £260 new the newest one being over 3 years old. The amounts I owe are £1086 and £323.

  22. Hi I am looking for advice regarding Rossendales for inpaid business rates. I recieved hand delivered letters on 20th June this year claiming a magistrates liability order and warrant of execution dated 5/12/2008 and 10/7/2009 for two very different amounts. I called the Baliff and requested to pay in instalments and was told I could only do that if I paid £160 and let them in to discuss it. I did and signed a walking possession order. I then sent back the form about my earnings and offered to pay £25 per month. I recieved letters on 11th July stating that this was not acceptable and had to pay £450 and £100 a month obviously amounts I could not afford. I rang them and told them I had already made one payment of £25.00 they said send in more info regarding my income and payment offers. I made two further payments of £25 a month all of which I have reciepts for. I then recieved a phone call from the Baliff being told the payment arrangement was not suitable and that I would have to pay £500 or he would sieze goods. After the £500 he would accept the payment of £25 a month. I was given a week. I never agreed to pay anything but in the mean time I went to magistrates court and tried to submit a n245 form but after much hassle I found out this form is not acceptable. I did get to speak to the prosecuting magistrate explained my case and was told to go to cab and to howden house to talk to someone. My papers were handed over to the council and they have been in touch saying I must speak to the Baliff unless I fall under the vulnerable persons category or there is insufficient goods for the Baliff to sieze. I rang them again and tried to reason with the council explaining I can not pay £500 and I have kept to a affordable arrangement I could make and my payments will increase over the next three months upto £225 as I will have paid other debts off. I was told to send this info in along with cab financial statement I am still waiting to recieve ( which won't be in time ) to the council. I was told the Baliff is claiming £300 in costs which is unlawful as I have had no visit from the one I am dealing with, only two phone calls. After doing some checking I have found out there is no magistrates liability issued against my name registered at the court. Also if they did have one they will be older than 180 days. I am going to write the letter out today how do you think I should proceed?
