Hi all Finally recieved yesterday a "Forthwith" judgement on this. I put a defence in explaining that the debt is subject to a PPI claim etc and it was stayed for ages but het ho....apparently the defence dident comply with CPR 16.5. My question is how do I get the forthwith changed so i can pay monthly and will i have to pay to do this? Thanks

yes i did and I filled in the AQ too. Have they missed a date out then? Im at work tomorrow first thing

It was taken out in 2004 and i never asked for a copy of the agreement i used the defence as posted for me on here.

Hi recieved a letter from county court yesterday saying that the district judge rules that "The defence be struck out and the defendent has untill 4 pm (no date ) to submit a defence or the claiment can apply to court for judgement" Any ideas what I do now?

Ok thanks for that. They have sent me a huge envolope full of all information regarding this debt. It incldes the agreement and also mini versions of all the statements back to the opening of the account. What should I do next? fill in the AQ or try to negotiate a payment plan?

well marlin saying that the last payment was made october 2009 is a lie, and, if they had the account info they would see this. Is it worth telling marlin that ive checked bank statements and no such payment was made on that date and basically "prove it"?

Right, I knew I kept everything. Last payment made was to rockwell on 3rd november 2008. (so not SB as I first thought) Sent cca request on 23rd november 2007 (still have post office reciept for letter) and they (m and s) sent my a copy of my application form dated november 1994......... After rockwell it was passed onto fenton cooper whom I wrote to telling them to bog off basically and I actually have a letter from Fentons saying we can confirm we are taking no further action in this matter and our files are now closed. After that it was passed to collect direct uk but i ignored them and nothing untill now with marlin.....

Hi and thank for your replies. I am trying to find out when I DID last make a payment, because I was paying Rockwell DCA £5 per month. So need bank statements from further back. I did send CCA request but it was NOT 2009, it was well before then. Will post back after I have found statements. Thanks again

Well I ve checked my only bank account statements and, as I suspected, no payment made on the date they specify in letter......so how do I respond to this please.....

Hi response to letter to marlin says they have checked with M&S and last payment was made in 2009 so they say its not SB and basically what do i intend to do about it. I need to dig out all bank statements and check this but im sure it was not 2009.......

Ok thanks i ll have a look at that. What impact, if any, will the PPI claim thats gone into capone have on the claim?

Hi CB Ive acknowledged service of this today online and also put in the defence as above. I will keep you informed of any developments and thanks for your help so far. Lets see what they come up with now
