  1. Hi, I had a hearing due in February - it was a date agreed last summer. This has now been moved to late June. However the respondent had produced a page-numbered bundle anyway, it excludes most of my evidence and looks to be padded out with documents that neither I or the respondent will be referring too (these documents are outside the scope of the claim). How can I now go about challenging the documentary 'padding' in the bundle and getting my own documentary evidence included in the bundle? The respondents have refused to add any more of my documents to the bundle because (they say) the present one is adequate enough.
  2. Hi, (could you bear with me a little as I briefly merge two previous threads of mine) my ET hearing is now listed for February 2013. In preparing the paperwork for my bit of the bundle I have found documentation which could well prove criminal activity by my employer. Since my ET1 was accepted my employers solicitors have been playing fast and loose; and between the pair of us, both sides have missed the original dates for exchanging documents. I have since asked the Tribunal service, several times, for a court order to impose a revised timetable which my employer should adhere too. The Tribunal service have not responded at all to any of these requests. Knowing what I now know (about my employers activities) has placed additional pressures on me and I feel that the task in hand is a lot more than I had anticipated. Furthermore the apparent lack of support from the Tribunal service has been dispiriting. I feel inclined to report what I have to the police/CPS for further investigation. The evidence looks as though it stacks up in it's own right i.e. it can't be said I am making a spurious complaint. It would take a huge weight off my shoulders I think. But I don't know how this might affect my ET hearing. I don't know what to do for the best really. Has anyone got any ideas?

Thanks for the tip papasmurf1cx, my principal problem at the moment is that I can't get the Tribunal Service to acknowledge the issue let alone suggest a revised timetable which the respondent would have to adhere too. Would an 'unless order' generate such a revised timetable for the exchange of lists,bundle and witness statements?
  4. Hi, I have asked for document disclosure from my employer. This has taken so long that we have missed all the dates for the exchange of lists, agreed bundle and witness statements. I kept the Tribunal informed of these delays. I suggested a revise timetable for these important dates and my employer/the respondent has not stuck to them at all. There has been no exchanges and no bundle. I have written to the Tribunal service on several occasions over the last couple of months, ahead of the hearing, asking for an order to put a revised timetable in place so that we can proceed in the correct way. The Tribunal have not replied to any of these requests. (I'm told it is a busy ET centre). Can anyone help me on this? It's a major worry to me now. Is this normal behavior in the 'ET' process? How can this tactic of non-response benefit the respondent? (and leave me at a disadvantage?) More importantly, how can I get this process back on track ahead of the hearing? Any advice would be appreciated. .
  5. Hi, I lost my job when I raised concerns about my company's dealings with a supplier we had a contract with. Briefly - one of our managers was ripping off the supplier. The supplier sussed something was going on - but settled out of court and signed a confidentiality agreement. In preparing for my tribunal hearing for constructive dismissal I have come across documents that seem to prove there was fraud at my ex-employers. It seems the supplier was ripped off for much more than they settled for out-of-court. Should I now refer the fraud matter to the police for further investigation? If so would that affect my own ET hearing? If the supplier has signed a confidentiality agreement as part of the out-of-court settlement would that stop them talking to the police if the police begin an investigation? Any advice would be most helpful.
