Hi all just wondering if anyone ever got to the bottom of the strange world of Black Lion Law/ James and Becketts/ Heenans.....IMHO very effective PPI claims sink...burying thousands of genuine PPI(recruited online) claims on behalf of the banks.... My complaint to the Ministry of Justice/FOS was a waste of time...the referee has long since left the playing field .. thanks and good luck all
  2. yes, i have written and thanked my mp already, however it will have been a phone call not a letter. Also today they DWP miraculously confirmed that my 2 month fitness note was indeed that... WITH TOTALLY UNPROMPTED CALLS and offers to post further payments today. Reverse gear has truly been found... I however reserve judgement on which if many, one or all the tactics worked and would advise anyone to use all routes. You may have an inconsiderate mp. I wil ltry to scan the dwp dpa letter on here so people can see how they squirm. bla bla bla rant rant rant micko
  3. It is easy to really feel victimized by the system but again i would repeat i bear no ill will to all the hard working people who do really good jobs at the DWP mick
  4. I received a letter today from a gentleman from the dwp information and Records Management Service. The letter is really cool(NOT) IN THE WAY HE ASSUMES NOBODY IN THE WORLD KNOWS ABOUT AUDIT TRAILS. I quote "It would be unreasonable and unrealistic to expect a data controller(DWP here) to sift through every recorded call held in the hope of identifying those to which an individual customer might have a right of access." This is an enormous assumption about peoples ignorance with regards to IT integrated systems. They enclosed a form in which i was asked to be more specific about my requirements. I filled in the form and added this to the part which i signed. I hereby confirm your legal obligation is clearly outlined in the legal letter you have received and acknowledged for which you are accountable in law. Our previous letter gave very specific information as to what was requested and explained that your duty to provide information in law extends beyond that requested. We have knowledge that the dwp runs a a fully searchable audit trail process. Every keypress, every call. Please bear in mind that the absence of information requested wil be justified before a County Court. I have much experience of this and i can tell you, judges know all about sql queries and filter searches and they despise being treated as though ignorant and asked to believe you just have a big filing cabinet. We reserve the right to request details of every it system and source of data storage and the filter criteria used to demonstrate your willingness to fulfill your legal obligations outlined clearly in my letter. I have to follow this all the way now as i feel i may be starved again at any time. Stopping peoples benefits is in effect a job creation scheme generating phone calls and work for people that could well be avoided. Some times when boxed in a corner the only defence is attack. thanks micko
  5. yippee 3 weeks money arrived this morning. I think they have misread a 2..month fitness note for a 1 month fitness note ..I will write today to pull them up. but it certainly is a positive cooked greasy breakfast me thinks.. will keep updating
  6. Today I received 4 letters from the DWP the most significant stated that i was entitled to benefits from the date i finished working. The money has not yet appeared in the bank however. Another was more atos forms to be re submitted. another one was the standard request for another sick note but all the dates are wrong ....looks like panic has set in... no time for fat ladies singing as i am nearly nine weeks without payment. but it does seem like something might be happening. and i do not know if the sar , the complaint or the mp intervention worked..... and we dont know yet if any has worked..but bucket loads of mail are now coming.....fingers crossed.....thanks all
  7. Had my 2pm appointment.... explained the situation exactly as on here... he took a copy of my letters and was disgraced. He knows the organisation my sister works for and also said that their past experience confirmed that DWP did keep telephone audit trails. He told me it would be a few days until he got back to me but that they would not be going through the normal channels and would go straight to a management level. all in all i was quite pleased and hope this escalates the matter , nearly 8 weeks now with benefits stopped. I will soon be hiding behind lamposts lol

  10. Also in my experience the medicals themselves were never overcrowded and all was quite civil. I was just shocked that the guy who told me not to bend because of the pain i was in wrote the opposite in the report.

  14. i have been reprimanded on CAG for every crime "hijacking", slander, bad language , threads removed, posts removed you name it. However this is the best and most helpful website in the uk and every reprimand was on retrospect my own fault.. I think even the experienced Caggers would admit a few of the enemy cruise these pages and try to muddy the waters, however anyone with half a nose can smell them a mile off.   16. This may or may not be useful to others....Having sent my SAR as posted above I have also sent this letter below in complaint. It has been radically detoxified by my sister who proof read it and removed the worst of my venomous bile. She is correct though, no matter how bad I feel, particular employees are not to blame and every letter from here is future ammunition and part of the paper trail that gives them an opportunity to rectify matters. TO DEPARTMENT OF WORK AND PENSIONS JOBCENTRE PLUS LEEDS BDC LEODIS WAY LEEDS LS88 8AB DATE 08/07/10 Name ************************* NI No ************************ Dear Sir/Madam, I am writing to you as a customer of the DWP to complain about the recent unfair treatment I have received. I have a 25 year work record paying more taxes than most. I became a customer of the DWP due to an injury to my back. It was not my choice and I dearly wish that I could regain my financial independence. Although I am a qualified and experienced civil engineer, I attempted a return to work in May by accepting a warehouse job. I notified your office immediately of this. Sadly, my illness meant that I was unable to continue in that job after eight days. Once again I notified your office of this immediately. My general practitioner has continued to provide sick notes explaining why I am unable to work and these have all been sent to your office by recorded delivery. Despite numerous telephone conversations and a new claim having been submitted, I have received no payment since then(27th May), nor have I received any explanation for why this should be. I trust that it is not your intention to leave any customer with no means of supporting themselves for this length of time. My sister has dealt with all the telephone conversations on my behalf as I have felt disrespected, and also because this is her field of employment. Despite her constructive approach and clear knowledge of the welfare benefit system, she has been repeatedly given inconsistent, misleading and contradictory information. I have followed all the requirements of a DWP customer with honesty and integrity, yet it seems that I have effectively been punished very severely for attempting to return to work. If it is the intention of the department to discourage its customers from striving to regain their financial independence, then it is deeply concerning on a much wider level. I have therefore passed on this information to my political representatives. Clearly this is a situation that needs to be resolved as soon as possible. I look forward to your reply.   17. from my painful experience I would advise the following. 1. Refrain from any telephone conversations with them as these are designed to infuriate people and are nearly always in my opinion contradictory depending on who you talk to. 2. Keep them on their toes by requesting SAR from all parties atos, gp and dwp , demand Audit Trail explain your grievance very clearly in writing. 3. From this moment ensure a good strong paper trail for everything they are doing and trying to do.. use internet to contact any MP's in your area very clearly explaining your grievance. I know its difficult and stressful but try and treat it like a game that is what they do. I am not an expert but hope this helps in some way and I am sure the senior Site people will be long soon with better advice also. good luck
  18. Hi and very sorry and shocked to hear about your problems. I think i can offer some advice on evidence collection.. 1. Use SAR's on all related parties even gp surgery. etc. 2. Always include in an SAR a couched threat of using Section15(2) in the event of omissions or inaccuracies. Section 15(2) can be used to devastating effect in getting the info they don't want you to see. ALL the big players laugh at standard SAR's until in front of a judge under a section15(2). This is also why cross referencing all your sources is so important. The judge at Huddersfield denied the GE Money Barrister a strike out on the strength of my section15(2) and has left my lawyers with a very strong case on DPA breaches against GE..(micko 1 barrister 0). 3. Demand Audit Trail information in its entirety the DWP illegally guides its employees not to provide this information,, this should garner every keyboard input against your husbands account. My other thread in this section has a sample SAR I used I cannot link as it is classed as thread hijacking but it is there under micko19. 4. You need to be patient and diligent in collecting information, i think its worth bearing in mind that solicitors don't collect evidence, you must do all that leaving no stone unturned and bring a strong case to them. It is all a time consuming process. I got break downs of all PPI and loan secret commissions to brokers all with the use of section 15(2). One ommission from the broker included by the lender opened the section 15(2) filled in an N1 and all the info gets coughed up. also if you have enough for criminal it may be worth bringing the police on a criminal allegation must be investigated. However I would get advice from more senior people on here. My advice is just things i have got from here and learned myself please take as much advice as you can as well as my own and hope you find a way I hope these help good luck mick

  20. Thanks very much privatehudson for your remarks. Yes the term trained liars is not appropriate and i unreservedly apologize for that remark to you and anyone else working in the industry. I do not know what they see on their screens or what they are reacting to during a phone call. Here are some facts from phone calls that my sister a very respected Social Worker/healthcare proffessional has experienced and is bearing witness too. 1. Phone call 1...She was told that no break in my claim would be experienced that 8 days would be deducted from my claim for my effort at trying to work. FACT no payment for 5 weeks. 2. Phone call 2 ....She was told the claim had been flagged to be closed but to write a letter explaining phone call 1 and the closure might be stopped. 3. Phone call 3...She was told the claim was moving from Halifax to LEEDS and we now need to fill a fresh application and to phone in one week and it would be processed asap. 4. Phone call 4 ... She was told they were doing nothing about processing the claim and nothing will be done untill a doctor says my slipped disc is worse than it was before i worked...Also stated that i had missed a medical assesment i really dont know how to use any other language than outright lie for that. I must make it clear every phone call included apologies for previous misleading directions. The operators react to what they see on screen and i believe the underlying policy is to punish those who try to work. As you can see now I cannot possibley approach my doctor until i have something in writing explaining what they want, as they will without doubt again move the goal posts. I believe there has already been 2 suicides for inexplicabley stopping benefits. To me I can see the system is designed to have that effect. MY SAR includes a specific demand for the audit trail which is supposed to capture every key press in relation to my account. We have proof of the phone calls duration etc so the proof will either come or the DWP will end up in court under section(15)2 of the data protection act explaining why they are breaking the law with regard to DPA. So please watch this space. Again I am very sorry for the entirely wrong language i used in anger and really do respect any person trying to do a job.. mick
  21. just reflecting on fuzzgins comment. The amount of misleading information provided in calls must be a deliberate ploy it keeps call operators employed whilst providing no service whatsoever. Any private business would shed those idiots instantly especially when they deliberately terrify people from attempting work. The government are going to have a right job on sorting these clowns. Internally they are a big job creation scheme for themselves having the external effects on customers of guaranteeing no one dares to try working and locking people into a benefit culture. A horrifying irony in terms of what the government are trying to achieve. bla bla
  22. I agree and find it staggering that the government don't understand that the policy is clearly one of punishment for trying to work. The perfect recipe for locking people into benefits indefinitely. I am forwarding my case details to several MP's but not holding my breath thanks for your comments... micko
