  5. Thanks Milly. The attatched schedule does state the amount and when they will pay. I was just a bit concerned and confused as i thought they were conning me. The schedule being on non headed paper made me suspicious. You have reassured me now. regards Melissa
  6. Can any one help with this. I received a letter from Eggs solicitors Eversheds, agreeing to refund my charges but with the usual legal jargon. They believe charges were fair, no admission of liability etc. They are requesting i sign a TOMLIN ORDER. I am concerned about this as i feel they are trying to con me. It states In the Northampton court Melissa McDonnell and Egg Banking Plc Tomlin Order Upon the parties having agreed terms of sttlement set forth in the schedule attatched hereto. BY CONSENT it is ordered that: 1. All further proceedings
  7. Has anyone claimed bank charges over the 6 year period? If so what legal arguement was used/ Just thinking about taking on the Halifax again. I won my case for the standard six years but know they must have taken loads more of my money prior to that.
  8. Just received the standard response to my request for refund of charges and removal of default. They are sending me a cheque for £40, when the charges amount to nearly £1000 plus interest. I have my LBA ready to post and i am not going to respond to their letter, I'll just send the LBA. They are refusing to remove the default, standard response. I am determined to get my money back and the default removed. However, i am a little concerned that there doesn't appear to be many cases settled with capital one. Are they taking the cases all the way to court? Has anyone had any luck with capital one
  9. How do i fit everything in? Have looked at guidance notes but finding it impossible to list particulars of the case as well as list of charges, dates and interst etc. Can i assume the courts will calculate intersest as long as i state i am claiming it? Do i have to list the charges or can i state an amount. If i have to list charges then i think i'll have to use the PDF form and post it. There is no way it can be fitted in to that small area. Merged threads, please keep to the same one.

  11. Sent LBA which is due to end 27th of April. I want to get ready for filing my claim as it looks like Halifax are not going to pay up. They offered me £130.00 of the £1020.00 charges. Haven't a clue what i am doing and cannot seem to be able to open the spread sheets on this site. I have microsoft works spreadseet and not sure how to use it. How do i get the thing to add up charges and calculate interest??? Do i calculate interest at 8% of the total charges or do i take each charge and calculate 8% per year from the date of the charge. Can i calculate it with calculator, pen and paper. I
  12. Just received a letter offering me £130.00 of the £1020.00, with the standard response. I'm not going to accept it. I have already sent the letter before action and think the letters crossed over. They sent there response the day of the deadline and i sent the letter before action the same time. Do i ignore there offer, not respond to this letter and wait to see the response to the LBA?
  13. Capital one have taken nearly the 40 days to reply surprise surprise. They have sent two separate letters one asking for £10.00 for information held about me and another stating the same again and that my statements will arrive within 7 - 10 days. Is this correct? Do i have to pay for them to disclose the information they call 'a subject access request and the data protection act 1998 governs it'. Do i have to have this info if it reaches court? They are also stating the have 40 days to send this info, is this correct as i have alread given them 40 days in my original letter?
  14. Egg responded quickly but sent a pack for me to complete before they will disclose the information. I also have to send them £10.00 for them to process it. Has anyone else had this?
