  13. had letter from bank stating that would pay up had money checked moneyclaim form online bank has submitted a defence for the claim disputes whole thing wants to take it to court and i will apparently recieve court info soon what do i do next ive recieved the money owed except the 120 pounds court costs ahhhhhhhhhhhhhhhhhhhhhhhh
  14. hello scarlett your not really entitled to claim the interest until you have to take the bank to court but in the event you do have to take action you need to get this spreadsheet http://www.consumeractiongroup.co.uk/forum/showthread.php?t=182 input your own info into the appropriate coloumns and the formula will work it out for you remember in the date section you need to input the date american style i.e month/day/year hope this helps and keep plugging at them the final letter i recived stated that even though they dont agree with these actions it will cost them more to defend in court that whats being claimed.
  15. well good news everyone keep plugging away at your pursuits against your respective banks 13 days after the acknowledgement of my court action i recieved payment in full from the halifax didnt seem to get my court costs back so am still going to pursue them for that but hey ho thats another one in the eye for them
  16. it seems ive made a mistake on my particulars of claim form on the money claim form heres what i put The claimant claims interestunder section 69 of the county courts act 1984at the rate of 8% a year from 29th september 2003 to 30th march 2006 1656 pounds and also interest at the same rate up to the date of judgement or earlier payment at a daily rate of 0.36% it doesnt say on the form that i need to put an total amount of interest claimed which would be 173.67 pounds but when i spoke to customer help desk she said that even though i'd put that i want to claim the interest i wont get it because i didnt put the amount she saidthe only way would be to amend the claim which would cost an additional 35 pounds(non returnable) and would have to be bounced backwards and forwards between me the court and the defendant by post before starting the claim again. what would your advice be many thanks
  17. i know its not original but will this do as a claim particular and is there anything that needs changing cheers My action is on the grounds that:- I have a contract with the defendant bank dated 29th september 2003 and which is conducted on their standard terms and conditions. I am claiming the return of money taken by the defendant in the way of charges over the last 2 years and 6 months years plus the interest they have levied on those charges. The bank's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. Further, as a disproportionate penalty they are invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2(1)(e). In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. In addition the defendant bank (newbury branch) was presented with a hand delivered letter stating my wish for the charges to be refunded which has been subsequently ignored therefore i see this as grounds also to make my claim against them.   20. i hand delivered my letter, stating what they owe me, to the bank handed it directly to a member of staff addressed private and confidential to the branch manager doesnt get a reply after 14 days i know the question might look arse backwards but it does make sense thanks
  21. recieved 2nd letter today from peter dixon customer relations manager starts off by saying sorry your unhappy blah blah dissagree with your legal analysis blah blah customer provided with terms and condition when opening account THEN putting the above to one side on this occasion as a gesture of good will i can refund 360 pounds please sign blah blah blah now im not sure what to do next andwould like some ideas i dont want to feel like im bailing out but wht they have offered me is my total charges minus interest which only amounts to 42 pounds anyway. but am i right in thinking your only entitled to claim the interest if i take it to small claims. to be honest i think its quite a fair offer so ideas please ta
