  1. hello oblivion do you know if the procedure set out in your post still apply? i sent my info to that birmingham address and have had no response. have read elsewhere that you need to fill in a tax return to claim pension tax relief but not sure whether this is still correct. thanks very much danny
  2. hi i have gone after lloyds tsb for the charges on my joint a/c. i went thru usual stages, filed my claim at court for £452.62 plus £50 court fee. lloyds wrote to me saying they had transferred an 'ex gratia' payment into my account of £395 into my joint account. i replied to them acknowledging receipt but stating that i would not drop the claim until the full amount of my claim was paid to me. thay have since filed a defence. i have spoken to their sols and asked them to save time and costs and pay the balance into my a/c and i will drop proceedings, but they say i should inform the court of the ex gratia payment and the balance of the sum i am claiming. is this correct - seems like total time wasting by the bank as we both know the result.
  3. i won! the full amount i claimed appeared in my account 2 days before the court hearing date. many thanks to everyone and this website for their help - off to donate now.

  5. have served my bundle and they offered me full settlement with usual conditions which i rejected on 8 January. getting slightly concerned as my court case is this tuesday and have heard nothing back from them.
  6. sent my rejection of offer letter back to them on 8 Jan registered post. court case is on feb 13th. is this their tctics to wait until last hour and then finally settle or is it worth me giving them a nudge?
  7. i know that in employment law, eg when people get paid a lump sum to leave their jobs 'quickly', it is common for the employer to pay a sum of money in return for the employee keeping shtum. i think it is worth a try, if they dont agree to it then i wont agree to the condition. also, is the settlement figure subject to tax?

I won! got a letter from sechiari today offering full amount i am owed (their first offer) for £3,600 but with the usual conditions: 'full and final settlement' - they can ghet stuffed on this as they have charged me since i filed my claim and i want the freedom to sue them for any charges they bring against me unlawfully in the future. 'confidentiality' - not too fussed about this 'keep account in credit/ no more charges incurred' - they can get stuffed. their charges are unlawful 'account review at nearest branch' - not fussed. will be checking mjanet's thread for some choice wording to put into my reply. my thanks to all whove helped me so far and to the founders of this website. now to claim back my charges on my joint account!
  10. just remembered - when/if it comes negotiating settlement with lloyds, can i claim the £120 court fee on top of the full amount I am claiming in my schedule of charges I was reading mjanet's thread in which she says the court fees were part of the claim she made. I am not sure I have included the £120 as part of my claim - is it too late?

  12. sent my bundle to court and to sechiari & mitchell both by reg'd post on 6 December in time for deadline of 13 december. may give sechiari a ring in the middle of next week if i havent heard from them
  13. does my statement have to specifically refer to the cases listed in the relevant case law summary? also, my schedule of charges which i submitted to court lists the 8% interest only up to 29 august 2006 when i filed my claim. when i sned off the bundle, shall i enclose the same form or should i update the 8% interest on all the sums i am claiming? any help would be much appreciated thank you

  15. got a letter from court yesterday confirming my court hearing is set for mid Jan. I have until 13 December to file any evidence i wish to rely on (which i take it is just the schedule of charges)

  17. have had no rreply from the court at all - i keep trying to phone the switchboard but always engaged, have also faxed and emailed them. my aq did arrive there on time as it was sent by registered post. been 3 weeks since the deadline for filing the aq passed. anyone else in the same boat?
  18. i spoke to sc&M today, it appears that they spend most of their time dealing with litigation against Lloyds! they sent me an AQ yesterday which I noticed didnt have box A filled in re whether they wanted to settle or not. nice bloke at SCM said his client always looks to settle with in a month from the deadline of filing AQ but they are just waiting for instructions. i am filing AQ on friday by regd post in time for deadline on monday
  19. received my AQ on Saturday, with deadline for returning it on 23 October. I am thinking of ringing the solicitors SC&M before I return it, to see if they want to settle before 23rd and save a lot of time and hassle

  22. congratulations topgeeza the same firm of lloyds solicitors in brighton have just filed defence of my claim, so i hope they will be equally quick with the settlement letter!
  23. lloyds have submitted defence just before the deadline of 4 October, so now am waiting for AQ to be sent to me so battle can commence! case has been transferred apparently from Northampton to Wandsworth CC
