  1. hi guys many thanks for your replies, sorry i am a little late returning to the thread. our thoughts were possibly to involve the police, i have visited all the nursing homes and they willingly gave me the dates i requested. we needed them in order to ascertain money being taken from his accounts when he wasn't able to get to the banks himself. we have done a few calculations and have come to a sum of £47,000 taken from his accounts in the three years leading up to his death (including £800 withdrawn in the last 3 weeks of his life when he didn't leave hospital) we have now taken legal advice, they told us the police wouldn't give two monkeys and would do little or nothing to help us. his bank were a little more helpful but only after we exerted pressure on them to supply us with full bank statements for the previous years. this only came to light after his death when we realized he didn't have enough money left in his accounts to pay remaining bills - and seeing as he had been housebound for the previous 3 years + we did a little digging - only to find nearly all the previous three years bank statements were missing ( my dad kept them as far back as 2006!) we know who's had the money, and all the bank statements coupled with all his hospital stays and nursing home stays prove that he could not have withdrawn all this money do we have anywhere to go from here? i have let this lie for a while as i don't want to get involved with the woman i know is at the center of all this, and she also brought her daughter along to my fathers funeral to try to pick a fight with me in front of all the other mourners, so you can understand the lowlifes i am dealing with here any advice would be welcome, its hard enough dealing with loss, but having to fend off utilities company's a year after my dads death because he's been cleaned out is slightly grating
  2. hi guys back in 2012 i got a speeding fine which i totally forgot about. it got taken to court eventually and i got fined a vast amount. the reason for never getting around to sorting it was the fact i was looking after my terminally ill dad and everything went by the wayside for at least 18 months i started to pay this fine through my wages and paid £397.00 towards the £600 they fined me. when i lost my job i didn't think about the fine until a couple of months later, i contacted the court involved and they sent me out some forms to fill in along with income and expenditure. i filled in and sent back with my wage slips showing the amounts paid within the time frame they gave me. lo and behold some weeks later there is a bailiff on my doorstep. i phoned the courts to be told that the material i sent back hadn't been received until three weeks after i had posted them! that serves me right for sending it snail mail - i also sent some other documents to another company the same day and they didn't receive them at all!) despite the fact they had all the information they needed they would not call off the bailiff and i was forced to pay £900 on the spot or the bailiff was ringing the police to attend to remove goods. the court has said it has only ever receive one payment from my last employers. when i contacted my old employers they very nicely sent my a breakdown of all the payments they had sent to the courts. my dilemma is this - can i claim back the money already paid to them somehow? it seems unfair that i have paid £397.00 that they claim they have not received? any help would be greatly appreciated
  3. hi boltmaker just a quick question - how did you get the co-op to send you a cheque? i tried this last year wit them trying to claim back unfair charges for the last six years and they denied my request saying that all the charges in their eyes were fair despite the fact that i gave details of how the charges have affected me financially - i would deary love to get at least a small portion of my money back as when the unfair bank charges situation first kicked off in the media i approached a company to claim back the charges for me and the co-op kindly sent me a record of all charges incurred! then as the banks all closed ranks in the wake of the media i heard nothing for at least three years until i wrote to them chasing it my self. can you point me in the right direction please as i feel they have massively overcharged me over the years and mainly at times when i was financially on my knees. any help would be lovely x
  4. hi all i need information from various nursing homes regarding the dates that my father went in and came out and i dont have them all. can i approach them direct if i have the certificate of death with me? i know one of them wont be a problem, but have never visted at least one of the homes he was in for a short time. this post relates to money (unfortuntely) as we discovered his cleaner had been helping herself to all his funds (we discovered this at great length after his death) any help/advice would be greatly appreciated. as soon as we have all the information we need we will be handing our file over to the police. regards
  5. hi quick piece of advice needed i have today phoned Nottingham county court and gave them the claim number on the letter the bailiff gave to us, however the claim number belongs to another case to do with TNT, i have e mailed the sheriffs office explaining this and now await there reply, they may have made a mistake, what do i do now as i cant put in to court the n244 form until i have this is there a way i can get this from anywhere else ? any advice gratefully received thanks
  6. hi no i have not got the statments, all i have is the original agreement, i lost a lot of my financial stuff through my divorce were do i start and were do i find all the template letters ? i was charged 803.62 for ppi and 175.00 for personal accident plan regards
  7. hi i need a little bit of advice on how to go about claiming ppi back from a loan i took out with welcome finance, the loan was sold on to a debt collecting agency so can i still claim and were do i send the claim to ? the loan was defaulted on due to being out of work and then a divorce, is it worth all the bother? Thanks
  8. hi we have not moved home the first thing we knew about it being at court was when we had a letter from the bailiff pushed through our letter box about 2 weeks ago, i guess my partner was worried about telling me, as soon as i saw the second letter from him pushed through the letter box on Wednesday morning i started to deal with it, once again thank you so much kempy
  9. thank you so much, as for our insurance the only damage to our car was the grill plate came out which i put back in when i got home other than that there was no damage to the car, also for information this sheriff officer called at my house at 6.30 am on Wednesday morning also he said if they needed to they would call in the evening to do a removal are they allowed to do this call so early ? and so late in the evening ? thank you PT and WD and everyone else for your help and support
  10. thank you for all your help so far, im a little confused as to what the difference is between a sheriff officer is and a bailiff do they not have different powers, and what is a high court enforcement officer a bit confused here, i think the reason the individual has taken us to court is because his insurance company representative came out to see my partner while i was at work and my partner told them what had happened and they said they would look in to it and that was the last we heard so we think they told him he could not claim is there no way the sheriff officer can force entry or use a locksmith and have the police present when they do this to gain entry we are just worried about this again thank you for your help kempy
  11. hi this is for a car accident that my partner was involved in [ the man who has taken us to court reversed in to us,] i have spoken to the sheriffs office this morning and have told them i am submitting a n244 form and an n245 form, he has replied that this will not stop the action being taken against us as the judge may throw the stay out he has told us that we need to enter in to a repayment plan with them and this will slow down the process, on the attendance to remove letter he pushed through the door he has written in the space that all items are now in their possession he has not been inside my property at all, the original hearing took place in the Croydon high court, what are the chances of this being set aside ? he did say that if i dont enter in to a repayment plan they will attend and remove goods regards kempy many thanks for the advice already given
  12. hi please help i have had a judgement entered against my partner and is now with an HCEO and are using the sheriffs office based in croydon, my partner never knew this was going to court as we received no documentation, my questions are what is a sheriffs office and what powers do they have also can i get them off my back as thier fees are £1279 including vat original judgement was £1056.00 i have got an application form n245 to suspend the warrant and i am submitting an n244 form and asking for the judgement to be set aside, what i want to know is what will stop action in the meantime as im worried that they will turn up and take everything before the courts receive these forms. also can i do this through my local county court, as this case was heard in croydon, also if im successful in getting this case reheard will they hear the case in my local court?as we are over 300 miles away from Croydon this case is about some one claiming against my partner for a car accident when our vehicle was parked and he reversed in to us i need some expert advice and know im in the right place to get it regards Kempy
