  1. Hi I am new in UK and looking to rent apartment in London. I requested a break clause in my agreement and my agent has put in following two clause. I find both of them contractdictory and don't really understand why xx.1 is required? Both clause appear tricky you. Would really appreciate guidance. XX.1 Consequences of early termination of the Tenancy outside the Terms of Tenancy Agreement If the Tenant vacates the Proerty prior to the end of the Term, the Tenant will remail liable to pay Rent until the Term expires or the property is re0let whichever is earlier. Should the Property be re-let during the fixed Term, the Tenant will also be responsible for the repayment of any pro-rata commission of fees that have been or will be incurred by the Landlord for the unexpired portion of the Tenancy (where xyz is the Letting Agent, this fee is caluclated at 11% _ VAT of the Rent for the fixed Term of the Tenancy) AND if the new Tenancy is for a lesser Rent, an amount equal to the difference between the original Rent and new lower renal figure up to the end of original Term. The Tenant is also responsible for any other reasonable costs (e.g. telephone lines, satellite television contaracts, TV licenses, cleaning, admin fees etc.) incurred from that poiont until the end of the Term. For the aviodance of doubt this clause shall not take effect where the Tenant is operating a break clause contained in this Agreement XX.2 Either party shall have the right to terminate this Agreemtn by giving the other party not less than two months advance written Notice. In the case of the Tenant such Notice will only be effective if sent by recorded delivery to XYZ, (Address) or alternatively via email to xyz email. This Notice may not expire before the end of the first six months of the Tenancy.
