Hi I have today spoke to a helpful assistant in Credit Control at Marks & Spencers. She told me that I opened the account in 1995 and "it looked like it closed around 1998". She is going to send details on the account to me!!! No mention of any fees etc. I am going to send a letter to Global as you suggested and tell them to "prove it" etc. Also what does IMHO stand for and is their a template letter I can look at please.

HI I'm a bit confused on this. If it doesn't show on a CRA File then it's been taken off paid/unpaid after six years. What if you have made one or two payments on the debt tho' does it still make it active and should it still be on file. Thanks -
Hi I'm not 100% sure of dates as it is so long ago. Sporadic payments maybe, again I can't pin it down.

What I meant to say is that if I didn't make a payment from 2001 onwards then it wld be stat barred in 2007. Payment was on 27th August 2007 so I presume stat barred wld have to be up to 26th August 2001 - 26th Aug 2007 an exact 6 years, and that would exclude any doorstep collection paid by daughter. The payment on 27th August was by a D/D (Proved by me). If I'm right then an I a0 Claim back daughter's £100 and also amount of D/D £60? He he wld love to take them bardstards to court and play em at own game.

Ha just worked out that if I haven't made a payment since Mar 2006 it became stat barred in March 2012 (not including a doorstep payment from daughter which I think was earlier) I'm in the clear, there not in the money !!! Thinking of a song there.

Hi I have done a SAR to Marks & Sparks which I will post tomorrow a.m. I am also sending a CCA request to Experto Credite as Global say they are working for them. Is there a letter etc which I can send to Global to sort of say hey lay off the court case as you haven't fulfilled my request and I'll ask judge to throw it out!!!!

I know in order to get anyway I need actual dates but where from. M & S won't tell me a thing only to say they have no records and have checked my current address and former address so must have got rid of them or passed them on to a DCA?? I tho' about requesting my bank statements to see if any payments crop up but wld that be worth it not just in money but time trawling thru them?

Okay I think they have a record as when they rang me (before i was knowledgable) I refused to answer any questions but the guy did say "You owe this amount and yr daughter paid £100 on her visa" so they must have kept a record. She can't remember when but said it was years ago. I believe it was when we 1st moved to this house have lived here 14 yrs. We moved here in 1998 and that's when I gave my old job up. I'm not working at moment as I fractured ankle and had 2 ops so now crippling arthritis in it. Sorry to be so vague about dates but it was so long ago, I have problems remembering what I did last week lol

God I wish I could find out for definite when I last made a payment obviously when my daughter paid them it came out of the blue totally forgotten about the account and truthfully tho' it was paid.

Hi Thanks I took out an M & S store card around 1998-1999. I defaulted on it as I came out of work. ears later a DC came to our huse & persuaded my daughter to pay £100 off this a/c (she tho' it was a baliff as she was quite youngish at time) Then, accrding to them I paid a D/D (which I know is correct as just got a copy bank statement.) I believed that a) the balance had been cleared directly to M & S?? or that the DCA/Direct debit was after statute barred. I cannot prove this yet as refusing to give me info. When I spoke to M & S they said I was not on their files and also wld not give me CRA details they use. I have looked at Equifax & Noodle. Both clear of any M & S accounts. Having difficulty logging onto Experian so not sure if it'll be on their site.

Hi My brains in knots so not sure what I'm saying lol Yes that's it basically. I contacted original lender M & S but they couldn't find any account for me (prob not if they've sold it on) so can't help me get original documents etc. The question I really need answer to is because I have requested a CCA and informed them that I now consider a/c to be in ispute can they still take court action which they are threatening to do on the 21st April. If they do can I contest it on the basis they haven't given me my CCA (if they don't obviously)

Hi I have seen on these threads about claiming unfair charges etc. I have just got a copy statement from 2007 (for another reason) and I see they were charging me £15.00 every time a D/D or cheque bounced. At this time both I and my husband were unemployed. Surely these charges were excessive I think I read somewhere that £8 was about right (they charge this now) Can I ask Barclays to look at these "unfair" charges etc or am I too late?

Sorry forget to mention they are sayng I paid £60 on 27/8/2007 which I very much doubt and have asked bank for my statement for that period. It can't have been by cash as a) I don't keep cash in house and I was out of work at that time & b) they got Tower Investigation to trace me at this address (where I lived in 2007) in March 2012. -

Hi If a debt is under £750 am I right thinking a SD cannot be issued? If so what other means can a DCA use to try and collect. I believe this is statute barred so that wld be my defence but if I am wrong what will happen next. I have already sent off for a CCA to DCA and infoormed them by e-mail that a0 I do not acknowledge the debt and b) I have requested a CCA. Do I need to anymore yet? Also checked my credit ref agencies and they are clear and also checked with M & S who have no record of my credit card. Many thanks:???:

Hi I noticed in the above posts that the amount has to be £750 or more for a SD. My alleged debt is £730.00 so what actions can the DCA do? Also I informed them in an e-mail that I did not acknowledge the debt and "I now considered this alleged debt to be in dispute" I also, same day, sent off a CCA request. Phone call from DCA threatening to take me to court. So does my e-mail precede any action they take? -
Hi everyone. I have sent a CCA request and also notified Global DEbt by e-mail that I now consider this debt to be in dispute. Yesterday got a phone call from a Geoff Jones of Global I refused to give any personal details etc as advised. He said I paid £60 in August 2007 (tosh tosh) and now were taking me to court. I said good for you and put the pphone down. Now I have made a request for CCA and told them it is in dispute can they legally take any court action etc? HELP!! Sent off , to Global Debt Recovery, CCA request etc and also informed them via e-mail that a/c is in dispute. Today I have rec'd letter saying taking court action in 10 days from date of letter (12th) They have said I made a payment via D/D to Aktiva Capital on 27/8/2007 (Think they may be right) but I want to prove that the debt was at that time statute barred. Their letter says: Yr name is registered as non-paying of a recorded debt. To clear your address now telephone us on the above telephone number and return the completed direct debit below to Global. It is our intention to issue proceedings within 10 days of the date of this letter. Signed by Collections Department. I haven't rec'd my CCA request yet or details of this a/c etc. M & S OC says they have no records for me and is not showing on Noodle or Exuifax. Can they issue court proceedings if I am disputing the a/c? Thanks Frantic:shock:

Hi Everyone. I noticed on my bank account that Npower had taken £153 dd instead of normal £91. I tried to access my a/c online but due to a password error etc could not -too long to explain and thats not the problem.) So rang NP and played merry hell with them as it effected other d/d. She said it was on my bill, told her cldn't access this etc. Anyway gist of the matter is I was fed up of Npower and was going to change my suplier etc. Lo and behold she then said because I was paying by d/d and billed online she cld put me on a cheaper tariff which wld cut monthly d/d payment from next month.I then asked if that was the case then why hadn't the person who set up my d/d/online billing told me I shld be on cheaper tariff? My point is should I go back and ask for a refund, seems they'll tell you about it if you complain/threaten to leave etc.

If anyone rings then here are a couple of options; a) say she's on the toilet, can you wait, I'll just get her" (unfortunately "she's" having a bad tummy day and is on loo for 3 hours) b) Annoy the dog and make it bark, then put the dog on the phone. c) Watch Benidorm especially Noreen and then do an impression of her i.e. "Do you play scrabble" and other unsuitable comments which will not answer any oftheir questions and drive 'em mad. d) Blow a whistle or one of your children's noisiest toys down the phone and keep repeating sory we seem to have some disturbance on the line I can't hear you. I once got a sex pest on phone at work and I after he'd told me what he wanted to do I asked him if he was a private client or if he was on the NHS, and if he was on NH he'd have to get in the queue. He rang off!!!!!!!
