  1. My friend filed a claim against me demanding £3000 that she thinks I owe her. I do not owe her any money and have all evidence to prove it. I received a letter from court and sent the acknowledgement by post and then hand delivered my evidence in the court a couple of weeks ago. Last week, I got a letter through post which was a Default Judgement against me. I rang the court straight away because this is not what I was expecting. The person at court said that they had not received my response. They did not receive my acknowledgement which I am assuming got lost in post (I know it’s my fault, I should have sent it through registered post or special delivery). I was told to pay £80 and send in my paperwork again for the Judge to review the case. I am 100% certain that my evidence will be more than enough to prove that I do not owe her anything but what I am really worried about is that what if Bailiffs knock on my door even before the court reviews my case? I am not entirely aware of what the process is and whether I would receive any communication from Bailiffs before they come out. Can anyone help please? I would be very grateful. Thanks
  2. Hello Everyone I have been following this post as I have also received a letter from RLP and they are claiming £137.50 on behalf of Debenhams. The difference is that I never stole anything.On 2nd February 2012, I went in store to exchange a purse that I had bought the day before because it had scratches on it. I looked at all the other purses and because they were all worse than the one I had already bought, I decided to keep the one I had and put it back in my bag. What I did not realise was that I never took the original one out of my bag and effectively had put another in thinking it was the one I had paid for. I was stopped by security as the alarm went off and that is when I realised that I had made an error. I was leaving for a 3 week holiday next day and had a lot of last minute things to do which ended up in me being stressed and absent minded hence I made this mistake I explained to the security officer that it was an error I made and I offered to pay for the purse (the value was £25) but he refused it and I was taken in to a room. The police was called and I was given a fixed penalty notice. The police woman who issued the notice told me that she believed me but because the store security officer was adamant that I had stolen the person she gave me a ticket. She advised me not to pay the fine and appeal against it. I have enough evidence (or I think I have enough) to prove that I am innocent. A couple of hours before going into Debenhams, I had sent my husband a text asking him if he could go to Debenhams and buy a new purse and then I would return the faulty one later on as I had a lot to do and it would make a bit easy for me to manage things. I have a record of that conversation on my phone and also on my itemised phone bill. It just proves what I told them originally that I was under too much pressure and I wasn't focusing on what I was doing. I also have receipts of shopping that I had done in the same Debenhams the day before. I spent nearly £300 and this purse was one of the items. I am worried about this whole thing as I feel that it is only right to defend myself as I never stole anything so why should I pay any penalties but I am worried what if this case goes to the court. My job is FSA regulated and my company does very regular good repute checks and I really don't want any court judgements against me and ruin my career. I would be grateful for your advise. Thanks
