  1. Yes, I do know of it but think it may be statute barred. However, I have a few debts and approx. 2007/2008 two gents came to my door but I cannot remember which debt they were asking me about. I do not remember whether I made a payment to them or signed anything. So, it may have been this debt but not sure.
  2. Wescot have been calling lately about a credit card debt, had a previous letter from them a fortnight ago and today received a letter from Nelson Guest...the usual 'make payment within 10 days..or further recovery action will be taken'. Do I ignore or send a prove it letter to Wescot?
  3. It's not on my report and I recently found a report from Experian from 2009 which does not have the debt on it. Of course, it could have been on Equifax and Callcredit. My thinking is that if it was not on in Sept 2009, it was likely to have defaulted pre Sept 2003, which would make it statute barred. My problem is that I wrote to them in Sept 2008, which could be seen as acknowledgement. However, if it was, indeed, defaulted pre Sept 2003, I am assuming that it would still be statute barred as the 5 year period in Scotland would have passed.

  5. Does the likelihood of it being statute barred come under the discount offer as well?
  6. Is getting a discount offer like this a definite pointer that it is unenforceable?
  7. I need to find out whether a default was on my file about 5 years ago which would tell me what the default date was, as I need to find out whether that default is now statute barred. Can I get reports from a few years back or do you only get present day reports?

  9. The problem with that is that it would wake them up to the debt again. As I said in my comment, they haven't been in touch with me since Dec 2009 but that may be because I've moved again. There must be some way of finding out whether the debt is statute barred without contacting the creditor. Nobody seems to know, as I've tried lots of forums.

Aktiv kapital have been after me for a credit card debt and I was foolish enough to write to them in 2008 and 2009(which is when they last contacted me) which I believe starts off my 5 year period again. How do I find out what my default date was as there is a possibility that it was in 2003 which i think would make it statute barred. Would it simply be a case of getting a credit report from e.g. 2006 as it would more than likely be on it then or is there another way of finding out when you defaulted? It wasn't on an old Experian report in Sept 2009 which suggests that it may have defaulted c.2003.
