  1. Hi again - it has been some time since my last post regarding DLC and a lot has changed since then. We heard nothing from them for months and in the meantime moved counties and forgot about them. They have started to contact us again (well, my husband) and I guess got our info from the electoral roll. They are asking him to contact them to arrange payment of the outstanding debt. a quick summary so you don't have to go back through this thread: original loan with abbey national, debt cancelled by them in 2008. DLC (Hillesden) contacted us "on behalf of abbey national" and said they were taking over the collection of the debt. We had not been told this by AN but believed them and continued to pay them for the next 5 years (until I found the CAG). Before I got wise they used threats on a regular basis and our repayments just kept on going up and up. in 2013 we received a letter from Santander stating the debt was sold to Hillesden in Nov 2007 . We had no such letter prior to this, and this wasn't mentioned on the debt cancellation document however we were with Payplan for a couple of years so it could've gone straight to them. Payplan claimed they had 'lost' our file some years ago. We have submitted a SAR, CCA request (in 2012), harassment letter etc. No CCA has been provided so far by the DCA. They acknowledge this but state the debt remains owing either way. I am getting really fed up with this lot. The o/s debt is approx 6K, they have already had over 5K from us prior to help from this forum. What do we do next (nothing?) We have moved in the last 2 weeks to a new rental and have yet to register our new address on the electoral roll. Any advice most gratefully received as ever. S x. p.s. We tried to get a mortgage recently having paid off all our debts (bar this one) and having a lump sum from my husband retiring from the forces. The DLC debt did not appear on Experian or Noddle and we were cleared for a mortgage until the lender decided they didn't like my husband's zero hours contract. Could this have triggered new interest in us from DLC? I haven't paid a penny to them for 18 months and for 10 months prior to that only a pound a month. Of course my instinct is to ignore the latest letter but my husband is really worried. He never really got involved in our finances when he was in the forces but now he's opening his own mail he's really shocked by this. I have tried to placate him but it's not working!!

  3. further to my last - I received a letter today (addressed solely to me - why??) from DLC stating the letter I sent to MDB was passed to them. They state whilst they are not able to provide a copy of the T&C's I am still "liable for payment of the monies originally borrowed. Please note that a request for account documentation is not to prove a properly executed agreement exists but is to provide customers with information about the account. We have provided a copy of the agreement you signed in November 2001 to assist you." They then go on to say statements from Abbey & themselves were provided and show payments over the last 11 years "so we question why you claim you do not acknowledge the debt". They also say regarding a Doorstop Specialist - "should one be appointed, they would give you reasonable notice of the timing of any intended visit, which is all that is required." They then request that I contact MDB to discuss repayment options available to me & if I am in financial hardship to have to hand monthly I&E so an apt payment plan can be agreed. I am at a loss what to do.
  4. thanks all - I have typed the letter, scanned and copied the DLC letter and am just about to go to the postbox and hope and pray these eejits leave us alone!! I couldn't do this without your help - thanks everyone yet again for your invaluable advice and support X

Today I received a letter addressed solely to me from MDB stating they had no response to 1st letter (I emailed them) which they find disappointing because they want to resolve this matter without involving a third party. Extract: "Part of my account management process involves profiling accounts to pass to doorstep specialists, who may arrange to visit your home. However, should my enquiries show that you are a home owner or employed/self employed, a third party may be instructed immediately to begin further collection activity." He then says to avoid this I should call him. We are not home owners but are employed. At the same time my husband had a letter from DLC addressed solely to him stating that although they can't provide the original T&C's due to the age of the account. They say that although they can't enforce the agreement the monies remain outstanding. Thisis very confusing - they are saying it's not enforceable (to my husband) but to me via MDB that it is. Please help!! Thanks as always X
  6. Hi Brig, please see post #141 there is a copy on there (albeit a bad copy). I have been paying £1 a month since October and made a payment on 1st Feb 13 to DLC. thanks x
  7. I do have a copy of the CCA, it arrived very recently after months of waiting. OC has confirmed they sold the debt to the DCA in December 2006. I have SAR's from OC and now DCA. DCA has also just responded to my SAR with statements etc and almost immediately have passed the account to MDB. We just want to get these people off our backs. They (appear to) have proved that they own the debt and have acknowledged all past payments we have made. It isn't SB because we have paid in faith every month. I feel I haven't a leg to stand on and must pay (unless you know otherwise)... just wanted to add - we did get a discount letter in October 12. I had reduced the payments from £112 pcm to £1 and they offered a payment of £10 pcm or 50% of the balance for the debt to be written off... thanks x
  8. I wasn't sure our debt qualifies as SB? Can I just clarify; is the debt SB because I haven't paid anything in the last 6 years to the OC? I ask because of course I have acknowledged the debt insofar as I have been paying the DCA. Thanks for all your help as ever. x
  9. I have already set up an email address for this very purpose. Should I make an offer of payment? I can't see any other way forward. They have provided what I asked for and I guess it is owed (despite the fact they must've bought the debt at a rock bottom price and I have paid it back twice over). I really am stuck now, I don't know what to say to these people....
  10. Hi, today my husband got a nasty letter from the woman at MDB threatening 'doorstep collectors'. I have received a separate intro letter from same co. Can we ask they deal with us as one rather than separately? Also I guess I can send the no business by telephone letter? She has asked we call to discuss options. It has a menace to it! There is an email address which I think I might use... Any tips with this new approach? Thanks x
  11. I just spoke to OC collections and they confirm they cancelled the debt in Dec 06 then sold it to DLC. They don't know for how much (won't say?) and suggest I ask DCA!! What should I do next? Thanks Sally

  13. well, I received another letter this morning from DLC enclosing the CCA from OC but minus the loan T&C's (to follow when available). First para states they acknowledge request to write only with the proviso we keep them regularly updated!! They say dispute is not valid (as stated in last letter). They enclose the same statement as enclosed in the SAR but also one from satans bank. Funny how they couldn't provide me with one! Payments go back to Jan 02 ending Nov 07. DLC statement commences Dec 07 as it should. The OC transaction summary shows loan 15K, interest charged £4996.20 - total £19996.20. We paid off £9571.77 before DLC took over leaving them a balance of £10424.43. The statement they sent me this time has been added up correctly!! The letter apologises that the transfer to MDB was made in my husband's name only and have now arranged my side of the account to be transferred also. So does this mean I have got a whole new set of people to deal with? I feel ill... Thanks x
