  1. Hi All I know there are a number of talktalk threads but I couldn't find one that addressed our particular problem and I'm hoping somebody on here can help and advise. The situation, in brief. My girlfriend was with TalkTalk and had been for quite sometime. She was not in any contract period etc. she was moving house and decided to switch to BT after having had a dreadful quality of service for quite sometime, including dreadful phone and broadband quality coupled with industry leading poor customer service practices. after spending hours trying to find a way to cancel the service without ringing their expensive 087 numbers she found an online form for cancellation and filled it in. This led to a phone call during which she cancelled her contract giving one months notice. So far so good. She moved, BT did a fantastic job at the new property and all was well with the telecoms world. she got some redirected mail which showed that talktalk were still billing for the line and hadn't disconnected the services. I won't bore you with full details of what followed, you've read it all before. Endless attempts to call, transfered around departments, hang ups and no help with the upshot being talktalk claiming she needed to ring a week before the end to confirm she wanted to cancel. We are now several months down the line and they are trying with the debt collector threats - thank god she had the sense to cancel her DD immediately. We already know there is no point talking to them, we've tried writing a letter of complaint, all to no avail. They claim she didn't cancel, we know she did and I'm confident any county court judge would interpret the contract in our favour. Now to me it is clear this is simply a racket based upon the fact that enough people will simply cough up to make it worthwhile but my girlfriend is less used to this than I am (I've had my fair share of debt issues over the years and as they had destroyed my credit rating I simply bin their letters and await the legendary doorstep collectors) and she is a little worried about what to do next - and this is where you all come in. I'd like to simply issue some sort of claim in the small claims court for costs and distress but she just wants it to go away. Are there any organisations we can go to who will deal with this or can you offer any additional advice, steps etc etc, other than wasting more hours of your life on the phone to people who are a mixture of the unwilling and unable to help?   2. Just a quick update on this. As i have no correspondence other than a text demanding I call I decided to wait until they got back in touch. So far nothing, not a call, or text (unless they are trying my landline which I never answer). Considering how persistent these guys usually are I'm surprised I've not heard more.
  3. Hi Misled I got a call today from the same company -they tried similar scare tactics with me - though the call only lasted 4m 55s. I was less than helpful and haven't, as he demanded, called back before 5PM with my address - apparently something terrible would happen if I didn't call back. I imagine I'll get a further call tomorrow where I will tell them its statute barred. After this I'll need to get some call recording equipment.
  4. I'm going to call them later once I've got the ability to record the call so that I can get an address to send the correspondence to. Should I just send the statute barred letter or should I first send teh CCA letter?
  5. Hi All As you can imagine I'm here seeking help and advice. I hope I've put this in the correct forum - if not my apologies. The reason for posting today is not about my current debt problems (I'm reading all the advice on that separately) but relates to a very old debt. This morning I got a call on my work mobile. The number was unavailable but that is not unusual for my work calls. When I answered it the caller asked to speak to 'My First Name Only', when I queried he then used my full name. I advised I was he, and he asked me to confirm some information, which I refused to do. In short he used all the usual tricks these jokers try (data protection etc) but got little joy. He did eventually say that he was representing LTSB over a a credit card debt. He gave a fair amount of waffle about how I had signed a legal agreement, about how the only reason the 'bailiffs' had not taken goods was because I'd moved without leaving a forwarding address. The address they had was my fathers old address - he passed in 2005. In the end he hung up saying he was sending me a text with their number and adivsed if he didn't have my address by 5 today they would 'go to court' (not sure which address they'd serve papers to of course ) The debt they are after is 13 years old (at least). I'm fairly sure I've had no communication with them on is since around 2000 - but at worst it would be 2004. I'm not aware of any CCJ relating to it and having searched the relevant addresses can find no record of a CCJ. Based on what I have read on here I believe these debts will be statute barred. I wondered what my next best step is, ignore them or what? I certainly have no intention of engaging in any telephone conversations with them and don't have any address to write to. I'm half tempted to have some fun winding them up as I'm sure the debt cannot be enforced and I'd be interested to see how desperate their threats get.
