  1. @ Heliosuk Yes I sent the dealer three different letters outlining the problems and asking for a satisfactory solution to the problems, i only received a response to the first letter discounting all the claims I had made and stating that as the car was sold Cat C and with a warranty that they are not liable, the warranty being one which i had to ask and pay for myself.. Interesting to hear about the common problems with the turbos on these cars, i imagine the dealer may try to use this is as a defence in court if he finds out about it..
  2. cheers for the response, I paid £7500 for the car which was 56reg and had only done 58000 miles.. also its a BMW 120d so this kind of milage for that car is towards the lower end of the scale i would imagine? I thought the same about the air box but BMW attribute alot of turbo failures to blocked air boxes as they can have a direct affect on the turbo apparently.. it just seems too coincidental.
  3. Hi all, I bought a second hand car from a dealer last July, it was previously category C but i was informed it was fully repaired and had a completed VIN check. The car seemed fine at the garage, everything worked but the dealer did point out what he described as a missing engine 'cover' which he said was purely cosmetic. I had it for three months but The car broke down in october on the motorway with a loss of power and warning lights. It was found that Turbo was blown with the acuator becoming faulty. the garage then found the Air box was missing from the engine, this turned out to be the 'cosmetic' cover that the garage informed me of. BMW told me that the missing airbox is often a cause of a failure in the turbo as it effectively chokes the engine. I am taking the dealer to court as he has responded only by saying he is not at fault, and has already filed a defence against my claim saying that the air box missing will not affect the engine and that he gave me a warranty (Car broke down after this ran out) Would be great If anyones got any feedback on whether this is a case that has a good chance of winning before I take it even further? Any advice is much appreciated.
