  1. Update: After receiving the rejection letter to the initial detailed appeal that they completely ignored, I wrote to PATAS with the enclosed form by the help of this and another forum. I've attached the appeal letter here as well as the recent reply from Newham Council saying THE FULL AMOUNT of £265 WILL BE REFUNDED. They started with "After further investigation..." What?????? So do you ever check ANYONE's appeal? I strongly believe they have a generic template that they first send back as a default response and so many must fall for it as it sounds air-tight. Then as we took it further, PATAS then send it back to the council to see if they agree of wish for it to be taken further at which point they actually read it. Beware of the Newham Council Legalised Daylight Robbery [problem]. I am posting this to thank everyone who replied to this thread. You're all part of the victory. Then again, the money isn't back in my hands yet so I don't even trust the letter fully as it says "Newham London" at the top.   6. Too late, the pseudo-legal jargon was already sent and yes I did understand it before I sent it. I never claimed there was no sign. I said it wasn't seen due to its location as the approach was from the road before it. Also, the sign was 2-3 spaces away from the suspended area and not close enough to the suspended area for it to be seen. And finally, the sign facing the road was non-compliant and the compliant sign was facing away from the road as in there were two different signs. All that is clear in the representation. The signs are also in my photos that I took but that's not the issue here.

  10. Got the reply today after 5 weeks NOTICE OF REJECTION Followed by their normal template about why and where ticket was given. They did not respond to my letter or the points made within All it says is "I have taken all of the circumstances described in your representation and mitigation into consideration. However, I regret to inform you that I am unable to cancel the penalty charge and refund the removal fee on the grounds stated" Honestly, no answer or anything. Should I resend the original letter stating it hasn't been answered whatsoever? Or shall I fill out the form attached with the rejection letter and so it gets forwarded to an adjudicator? Finally, in the form, it's asking if I want a postal decision or a personal hearing. I don't think I have the patience for a personal hearing since the council mugs and steal from us legally. I swear if I could I would happily move out of this terrorizing police state (UK). Anyway, please let me know if it makes a difference whether it's a personal hearing or a postal decision.   14. How does this happen and how does one get away with it for a year or so? Who is to blame for this daylight con in the name of the law? The council who set a target? The 'respectable' clampers and tow trucks who steal the car and demand money and threaten that your car will never be seen again? The extremely strict traffic law where even if a centimetre of the wheel is out, your car's gone? The citizens/drivers who stay silent while rights and money is chipped away from them? The police who don't take traffic enforcement complaints seriously enough? The system where the only people who can be heard are those who can financially afford to be heard? Have I left anyone out?!!

  16. Clamping should be outlawed. How clamping helps I will never understand. It's like braking a footballer's legs because they got caught offside and asking for them to cough out cash if they want their legs repaired.

  18. Sorry I don't understand that. So it doesn't refer to short suspended bays as in this case? From another forum: I don't know how to put this in a scary law type statement to prove how the suspension of bay and the pcn was incorrect. Any help would be great
  19. Thank you. Does anyone know if this page legislation.gov.uk/uksi/1992/1215/schedule/made refers to suspended bays or road closures or both? Where there's a parking suspension, are they required to put a sign up at each end of the suspended bays? I would like to add that I've read hundreds of pages before actually posting all this. Believe it or not, all the top google results and best information always points to TheBogs's posts. Smashing work

Hello pfriend1, I'm working on a similar PCN where the sign was not only not clearly visible, but the legal or required sign was literally facing away from the road and towards the wall of the house. You haven't received much help in this topic but I was searching for previous answers. Did you appeal it then? Are there any updates?

But you're right, it's best not to rub the pirates in any way when appealing I can't post links still.   23. Thanks for the quick reply Sam, Yes that was the one and only sign on this side of the road. green_and_mean posted something which might help here too. I have edited it to match my pnc I would appeal on 3 grounds a) the signs do not comply with the law b) the sign's locations do not comply with the law c) there is nothing to indicate which 2 parking spaces were temporarily suspended at the side of 250 Browning Road hence the notice was ambiguous and the PCN was issued for purely financial reasons. Would I be correct to put "c"?
  24. This is outrageous. I suggest that you do not let this go. I once appealed a bus lane ticket which was ridiculous for almost 2 years and they did eventually stop writing back to me and I did not pay it. As you have paid this and they are sending you in circles, remember to quote each person/department that forwards you to another (in writing). A lot of the times, they catch us out with poor records of communications because they reply weeks or sometimes months later. Create a file and list entire event and all steps taken. I can't help you in legal terms but I am certain that you should not feel this a lost a case. No matter how long it takes, it's your money which they forced away from you by threatening to steal your property and sell off and to be honest, ALL councils and governments are ripping us off in every tiny little way they can. Please keep us updated on your progress.
  25. Hello everyone, I have read the topics on here and they make me feel positive about appealing this unjust and harassing PCN + Car Towing. Before I complete the appeal, I wanted to be sure I understand everything and the few legislations I came across. I'll try to keep this simple.... Got back from a drive up north at 2am. No parking around my house so parked on next street which is the same zone. Other cars were parked there as usual. One space available so I parked there. Post with sign ___|__________Car parked here -------------------| The car was parked at the end of the road, in the bay. I got out, turned right and went home. Here are my issues: 1. I turned right to go home, am I supposed to go both ways each and every day of my life when I park the car to see if there's any restrictions? According to (plz add www).legislation.gov.uk/uksi/1992/1215/schedule/made Does this mean that a sign was meant to be posted in the direction I went too (as in both ends)? Please see attached photos (I went in the direction behind where I took this photo from) The red line is where I was parked 2. According to (plz add www).ticketfighter.co.uk/parking.htm#suspended Does this apply to the sign in the attached image too because it does look very similar and the required sign is literally facing in the opposite direction from the road. 3. The notice itself reads, "East Avenue E12 suspension of 2 parking spaces side of number 250 Browning Road 8am to 6:30pm 17/1/12 to 23/1/12 Offending vehicles subject to removal" Firstly, even if I had seen the sign, the side of 250 browning road starts from where my car was parked up to approximately 5 car spaces. It is absolutely unclear which 2 parking spaces were suspended.. So do I have 3 valid cases here? Have I misunderstood anything? Will copy and pasting other letters available here regarding the sign being unlawful along with the rest be sufficient? I am sorry if I am being too cautious but I have £265 depending on this coming from a father of 3 on low income supporting whole family. So this is a huge amount for me and I don't want the appeal rejected on technicalities. God bless you all for the help you provide to citizens that the council are meant to be providing but steal from us instead. Regards PS.
