  1. Hi My husband has been at the same company for over 30 years. He remembers distinctly when he joined he worked a week in hand. He has now resigned and going to work at another company. The company he originally worked for were acquired by a big blue chip company. He has emailed HR and that say that the onus is on him to prove that he wasn't paid the week in hand when he changed from weekly to monthly paid about 20 years ago. He does not have his wage slips for 20 years ago. Is the onus really on him? He distinctly remembers not being paid that money and he wants it. Any advice on what the law really is. Thank you
  2. Last Saturday I had my shopping delivered by Asda. The bill came to £308.00. I thought it was very high, but I had ordered a lot of fillet steak for my daughter's birthday. Then I received a voice message from the store to say that I had been overcharged by £92.00. Since that time I have called so many times. They admit the overcharge, but still nobody has refunded the money. It is now 8 days and still no refund. Everyone says they will call me back but they never do. All calls go through to South Africa. I managed to get through to the store the other day and they said they would get it sorted out with the Accounts Department and that I should not worry about it as it would be refunded. I am really getting angry about this. I want to take this matter further. Any ideas on what I could do to get my money back asap??
  3. In view of the advice I have read on this site; I have emailed them to make an offer of payment (easy payment terms). I wish this had never happened. I am usually very well organised financially and this has really put me under stress since I found out.
  4. I moved house in October 2013. I provided the correct meter reading in line with Southern Electric's instructions. I was then issued a refund on 26 November. Last week I was sent an online 'amended' bill asking for this money back. I spoke to Southern Electric who informed me that on 6 November they realised that they had mistakenly made the last bill up with an estimated reading and not the actual reading that I had provided them with when I moved and therefore the refund was incorrectly issued and I would now have to pay it back. They said they left a message on my phone. I asked if I could listen to it. They said they couldn't find it. Why did they not email or write to me to tell me about this on 6th November and if they knew about it on 6th November why did they issue a refund on 26 November?. This was apparently an oversight, but surely their accounting systems would not let them issue a refund if there was, as the lady told me, a mistake on the account (logged on 6th November). They are now asking for the money back. They are offering me £60.00 compensation. I really am not in a financial position to pay this money back at the present time. What should I do as this will cause me hardship as it was a large amount of money they refunded. My combined gas and electric monthly bills amounted to in the region of £220 a month which was paid by direct debit. I always thought it was very expensive compared to everyone else who I asked at the time so when I got a big refund of £500 for my electric I was not particularly surprised as I thought I had been overcharged. Do I have to pay this money back months later? To pay this money back will cause me hardship as I have spent the money!

  6. Hi I think if you appeal it is free? I think the system is so unfair. I went to view a Tribunal once and it was obvious that the employer was lying, and they tied themselves in knots, but still they believed them and not the employee! I think it is really difficult to win a tribunal. I pulled out of mine at the pre-hearing review when it was obvious I wasnt going to get a fair crack of the whip as already my previous employer had been telling lies and they believed it. I think maybe you shouldn't waste any more of your precious life on them. They know they have lied. Alternatively you can appeal and see what happens. i wish you all the best. I hate to think of people lying and getting away with it, but it seems that the odds are stacked against honest people in the tribunal system.

I withdrew my case, but feel so pleased that there are people like you who don't give in to pressure and obstacles that are put in your way. Well done already on what you have achieved by being so determined! Please let us know how you get on.
  8. I have read your threads. I want to wish you good luck. I have withdrawn my ET claim because of the stress it has caused me and the never ending lies the respondent has told and their twisting. They too said I had not mentioned sexual harassment in my ET1 when in fact I HAD. I hope you are successful. You sound as if you now have everything under control. Please let us all know how you get on.
  9. I don't think Employment Tribunals are fair. It's just my personal opinion, but I have watched a Tribunal case and felt the complainant had a good case, but the judge found in favour of the Respondent. In my eyes it was black and white that the Respondent's were lying as their stories didn't match, but still they found in their favour. Is it worth spending more time and effort complaining? I would seriously ask yourself this question.

  11. Hi Yes when I spoke to the ICO they said I could ask for everything and give specifics too. I worded it a bit like this. "I would like you to disclose all emails, letters and correspondence, which express an opinion about me or which contain information relating to me or which refer to me in any way". If you know the existence of a particular document you can ask specifically for that document. You are entitled to see anything relating to you. When I first asked for this information I didn't head it "Subject Access Request". They ignored it. Then when I emailed they said that they didn't realise it was an SRA. So state in the heading that it is a "Subject Access Request". Good luck. Can you keep me posted - especially if you win!
  12. Yes they sent me an incomplete personnel file. I know there is more information emails/letters etc. but they were not forthcoming even though I clearly stated what I wanted. I think if you do not get what you want you must complain to the ICO as I have done. It is your right to do so. I hope you get somewhere, but in my opinion everything is weighted in favour of the employer!
