I will badger him to donate at least something to this site as although he has not used it, I have been on doing so on his behalf. Thanks for the help everyone.   8. Just a quick update. My brother received a letter from the court (on Friday, I think) ORDERING NatWest to supply the answer to our 'Request for More Information' by 21st February. Things could be looking up........ Will keep you posted.
  9. Joe90, Firstly, put all this thought of losing out of your head. The banks DO NOT want to divulge their charging regime. Just imagine the landslide it would cause and every NatWest would probably get all of it's branch windows kicked in by other banks .... Just sit tight. If you have not done so already, you will very likely receive their defence along with a request for further information. There are templates in the stickys to deal with this stage. Just DO NOT WORRY. It is a waiting game and you will just have ride out all the crap they throw at you before the cheque arrives. Take a look at some of the other posts to give yourself a little more confidence. Make sure you read the FAQ's and follow the guidence of this site. You will not go wrong! Good luck Steve

  12. Westy, Thank you for replying. They received the documents last Friday, but today seems to be the first time they have looked at them. I gave seven days (adequate for an organisation their size, I would have thought?) - time is up tomorrow. Do you think I should hold off asking the court to either order them to disclose information asked for or find for me (my brother)? After all, the court ordered me to comply with their CPR18 request.   13. Hi Looby, Initiate the MCOL and take it from there. Have you read through the FAQ's on this site? You will be much better off by following the tried and trusted methods used by thousands successfully to date. Complete the spreadsheet to give you the figures you need for the MCOL claim, copy and adapt the wording for the MCOL claim form and take it from there. As you have already noticed, all the banks try every trick in the book to hold things up and to put people off of claiming. Have your own timescale and stick to it. Good luck and keep us informed.   15. Hi JeniL, Thanks for the support. I would just like to get the Court to agree that they have to release information on their charges, or pay what they owe. Put up or shut up type of thing. Once I have confirmation from one of the big boys re my last post, the letter will be on it's way to the Court. Answers anyone ?? ;-)

Re: His letter states he is sorry we have been unable to reach an agreement, and he is sorry he has not yet been able to respond to me and asks i bear with him in the meantime and he is investigating and will respond as soon as possible. Stick to your own timescale. This is a stalling tactic by the banks. If you have given 14 days and the time is up, send the LBA no matter what. As you have had communication from SH, send the letter addressed to him at the Borehamwood address - it matters not which one, it will get to him pretty quickly. Steve

Hello again, Have just spoken with Cobblers, but not LB as she seems to be constantly unavailable, and eventually (after I mentioned that I had sent the same to the Court and that they had received it??) got from them confirmation that they have received the bundle (most of which is above - posts 12 & 14). I then pointed out that there was a request for further information from me and would they be likely to provide a response by the deadline (tomorrow). They said they would have to consult with their clients to find out what the NatWest wanted to do, which would take 2-3 weeks. When pressed, although I was not told this in so many words, I was given the impression that the NW would not respond positively to this request. Now my question. Should I now write to the court and request that their defence is struck out and the case be awarded to me? If so, is there any previous instance of this happening, or a template I can amend, as I don't want to get the Court's back up so that I look like the bad guy? Any help much appreciated, as ever.   22. Hi Amanda, Looking good now. Should soon be over. Referring to your points. 1. Yes 2. Yes (but I'll be knocked down with a feather if they do!!) 3. Yes (I presume the order says to supply these within 14 days of the hearing? If that is the case, wait until the day that 14th day before supplying the bundle to the court as you may well have a settlement before then.) Good luck Steve

  24. Thanks Deller, Emailed letters (and instructions) off to my brother last night. He will post (recorded delivery) today, so with a bit of luck, it should be over fairly soon. Will keep you updated. If successful, maybe the letters above could be posted as a sticky. I had a hell of a job trying to put everything together from all the threads.   25. Hi Andy, They may certainly suspend or close your account, but even if your account is closed, you can still reclaim unlawful charges that have been added during the previous six years. Just go on ahead with your claim as if this wasn't happening. Steve
