Certianly did. By the way - what has happened to the marks on your register. I mentioned this as part of the deal throughout my communication with HSBC but as I had to get somebody to deal with the final stage for me (while i was on holiday) i didnt check that this was part of the deal.
  2. I would prefer my bank to charge me a monthly fee , above board (and all the bonuses - free holiday insurance or whatever) than sneakily get money out of me using charges. There are plenty of us here who have had charges of over £150 a month - i cant imagine many people would open an account with a monthly fee that big.

I'm delighted I just wanted to say thank you to everybody who has helped me along the way and to the people who started and all those who mod this site, it's a wonderful thing. - Just off to make a dontation to the site -

i'm on holiday from this tuesday (2nd) so i'll probably be away when the solicitor contacts me. I' could get somebody to check my post though - maybe i can call the solicitor from abroad to tell them i'm away, or do you think i could write before i have any communication from them to let them know? z

Hi Sar, thanks for that - much better. And yes, that does include the interest so i'll mention that too. I'm on holiday until the 14th. Do you think that's going to make a difference to my claim? zoe

Hi everybody, I have drafted this letter to the bank based on some others I have seen - what do people think? Is it okay to mention the court fee and removal of the default notice here? ------------------ Thank you for your letter dated 26th July 2006. I acknowledge your offer of £1850.00 and accept this amount as a partial settlement of the £2191.73 as stipulated by my original timetable. As stated in my letter dated 7 July, I will now require you to remimbuse the £120 court fee (this claim was made on 26/07/06 and has the claim number of 6QZ49341). The full payment now required is £2311.73. I remind you that in addition to full payment of the sum mentioned above I require that you remove the default entry from the register. Please note that mere correction or amendment to the entry will not be acceptable. I require repayment in full of this money and removal of the default notice within 14 days. If you do not do this then I will be forced to proceed to court. Yours sincerely --------------- thanks, Zoe:smile:

i got back from the pub on thursday night and found this letter from HSBC. I thought it might be useful for some of you who havent got this far to see it... ---------------------- Thank you for your letter dated 7 July 2006 requestion a refund of your bank charges fo 2191.73. In circumstance where you have authorised a payment that would, if met by us, lead to your account going overdrawn or over an agreed overdraft limit, we have to consider whether tto make this payment. Afee is payable for this service provided by the bank, details of which are clearly set out in our published price list. The circumstance in which the fee with apply are clearly set out in our personal banking terms and conditions which you were provided withe a copy of when you opened your account. if your claim for a refund proceeded to court we therefore believe we would successfully resist any legal challenge in relation to these fees. HSBC is, hoever midful of the mangement time and irrecoverable legal costs that it may incur inrelation to such a claim. For those commercial reasons alone, and without any admission of liability whatsoever, HSBC is preparet to make a payment to you in the sum of 1850.00 representin the charges applied in full and final settlement of this matter. If you accpet this proposal please sign and return the enclosed copy of this letter to us within 10 working days and we willarrange for a refund to be made to you. Please allow 7 working days for your account to be credited fro receipt by ourselves. If we do not receive your signed acceptance within this timescale we weill take it that you have declined our offer. I trust that this matter has now been addressed to your satisfaction. If you are not satisfied with the bank's response ou hafe the right to refer your complaint to the financila ombudsman service. Further details abotu the Ombudsman scheme are set out in the enclosed leaflet and you hae six months from the date of this letter, within which to refer your complaint to them should you decide to do so. thanks you again for taking the time to write Colin Langdale Serior Service Quality Officer ...................................... I am of course (having read this forum and learnt the drill) going to accept this as partial payment and continue to request a full refund. the only question is does anybody have any idea of how long this is going to take as I am worried about getting more charges in the meantime? Zoe (ps i know it's really sad to be in doing this on a saturday night)

    Confidential offer?

Hi, Dont worry - it's really not as difficult as it seems. The spreadsheet is the only bit I had trouble with. If you know somebody who is good with excel then you might be best getting them to help you like I did. I dont know how much money you are owed but mine was over 2k and interest only came to £130ish. it might not be worth your while. You could just add up all the charges and save yourself the trouble. Yes, MCOL, Moneyclaim etc are all the same thing. There are two different ways to do it, either by post or online. If you can pay on a debit/credit card it is probably easier to do it online. to do that go here and fill out the stuff you know. You dont have to pay until you submit it. Dont submit it until their 14 days since you sent the LBA. Keep at it - it'll be worth it in the end...

    Confidential offer?

Hi lauram, It does seem that people get treated very differently as I have read a few posts by people who have had quite a lot of corespondence from HSBC. But like you I have been completely ignored (if that makes you feel any better) and I sent both of my letters recorded delivery so I know they've got them. It is funny how they send a lot of letters when they are taking your money but arent so keen when you're asking for it back. I suppose it's just a case of waiting. There 14 days since my LBA was up yesterday so I have just gone ahead and issued a court order... you can do the same in a oouple of weeks so just hang on. - good luck -
  13. Thanks Micheal, I just needed a bit of reassurance. My fingers are crossed
  14. Hi, I've just read your thread and am now worried that i've done something wrong as I havent recieved any correspondence from HSBC since i sent my first letter (asking for money back) and I started at the same time as you. they ignored my LBA completely and i have now done an MCOL. i really hope i hear something from them soon - is anybody else in the same situation as me? Good luck with yours phunkymunkeh
  15. hi Lizzy, Sounds like you're best dealing with this in writing. It takes longer but it's definitely less stressful. I started this process a month ago and have found it quite easy (I'm in a similar situation to you. My mortgage and accounts all with HSBC.)- everybody here is very helpful. Just ask if you get stuck. Try using the step-by-step guide on this site. http://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/243-step-step-instructions.html Its really useful way of keeping track of where you are in the process. You just need to get your statements and add up your charges at this stage. Pretty simple as long as you're okay with a calculator! Good luck x zoe

Hi, I've finally sent my mcol and for the first time in the process I am terrified. I really hope i havent made any mistakes. Just a quick question. I'm on holidy from next Tuesday so will be away 14 days after I submitted the mcol. Has anybody else been in this situation? Do you think it will be okay? Zoe
  17. so you wrote ... "I calculate that you have taken £XXXXX" and left it at that?
  18. So do i ignoer the interest bit of the letter - below ---------------------- I calculate that you have taken £XXXXX plus £XXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXXX. ----------------------- or is this something different. sorry to keep asking - I just dont want to make a mistake at this stage zoe
  19. hi, Maverick told me to send the letter before action (the template letter on the site mentions interest). I have already sent the preliminary request. sorry if i'm being stupid - zoe
  20. Hi, just out of interest, why didnt you include the interest in your letter before action? I have in mine, but havent sent it yet (I'll do it recorded delivery tomorrow)I think i'm in the same situation as you. I sent my prelim letter about a week ago and got an identical letter to yours from HSBC on Wednesday. zoe

I sent my preliminary letter off a week ago and today got a letter saying --------------------------------------------------- Thank you for your letter dated 27 June 2006 requestion a refund of your bank charges of £1972.00. In order that we can consider your request please provide a full item ised breakdown of these charges to include date, descirption of the charge and the amount applied. Please also include any proposed new charges that you will have recieved a pre notification advice for. Thank you for taking the time to write. Yours sincerely Mr Colin Langdale Senior Service Quality Manager ------------------------------------------------------ A couple of questions. Should i now send the letter before action or should I enter into a dialogue with this person. I am also unsure of the reasons for some of the charges as they just appear on my statement as CHARGE. I know that there are some for bounced cheques but the majority are from exceeding my overdraft - mainly due to the spiralling charges. I'd really appreciate any advice All the best Zoe
  23. Hi, sorry I'm new here but my statements are now available through online banking. I have printed these out for the last two years (since they started charging me). Do I still need to send the data protection act letter. Thanks x zoe
