  1. Right folks, I am writing my appeal at the moment. One of the main issues of the apparent "breach" is that my friend and I arrived at the service station around 2am. Therefore, it was dark and the car park was not lit. The parking signs were clearly not apparent otherwise I would have set my alarm (the intention was to catch a couple of hours sleep during our journey) to ensure that we would move within the 2 hour limit. Do I use this argument in the appeal or merely use the legal argument?

  6. Hi folks, Apologies if the answers to this have previously been posted but there is an awful lot of information and discussion here! I have received a charge notice for £100 from CP Plus for overstaying in the car park at a motorway service station. My car was photographed going in then leaving. The charge notice states that notices were clearly and prominently displayed but, as we were in the car park overnight, it was dark and was not lit. The car park has free parking for two hours and the car was parked for 2 hours and 47 minutes. What are the options open to me? Any help you can give would be greatly appreciated.
  7. I reckon you want to go to the very start of this thread because it appears your initial answers are all addressed. There's a pro forma latter on page 1 of this thread which will keep them at bay for a while and force them to at least correspond properly with you.
  8. Cool, will do. What Link sent is my statement from SLC (headed paper, etc). If I send a SAR to SLC will I just get the same statement from SLC? Am I in a corner?
  9. I have just noticed that Link's letter to me states that I continued to defer payment with the last period ending in May 2005. Then there was a large payment in 2006 and small payment in 2007. I have no record of any of this. Help!

  11. Ok, I need to send a letter back PDQ as they are calling and threatening again. I'll send something back to reaffirm that no payments were made for more than 7 years prior to the 2007 payment meaning that it is still SB'd. Thanks again for your help. More power to your keyboard!
  12. I used to defer payments up to around 2002 because I was studying a PhD then I think I stopped. I think I took a wee strop because they kept taking money from my account despite yearly deferments. I can't actually recall what I did after that apart from the fact I totally forgot about it! If a payment was made in March 2007, that is less than 5 years. Would this not mean the loan is NOT time barred and I am obliged to pay?
  13. Thanks for the prompt reply - much appreciated. They have supplied me with a copy of my Student Loans Statement which shows two payments one in 99 and the last one in 2007. I'm assuming that they will suggest this is sufficient proof?
  14. I have now had a reply from Link stating that I made payment in March 2007. What's my next step? Any quick help would be appreciated. I obviously can't recall paying this, but if it is proved correct, can I ask to stagger payments? I asked Link this before but they said they do not accept staggered payment and threatened me with court proceedings (again).
  15. Er, no. Should I? Do I have to pay for that service? Never needed to do it before - never had any bad debt...
