    - We need to understand what is where. 

     

    So - Are you 100% sure this has not been to court yet for any form of enforcement action? 

    They need to get a CCJ and 28 days to pass before they can consider it :) 

     

    If they are acting as a Debt Collection Agency in its current form before going to court then - They will say anything to get you to pay. 

    What boundaries are we working to here fedup?

    3rd - Questions

    Have you had a CCJ for this issued against you? If so when was it done? 

    Please do paste up a copy of the PCN that you were sent.

    Are they acting as a DCA or have they gone for a CCJ? 

    That would be interesting to know! 

     

     

     

  4. If you have legal cover and insurance, you can try going ahead with your Insurer. They may be able to refer you to their "Legal Partner" but do your research. 

    If you know where 3 of them live, you can attempt to take them to court, but in todays climate, going legal will not get you the result of £15k that you are after. 

     

    Others may have their own input - But in reality you are asking for £5k from each of them - Might find it hard to recover that in a timely manner. 

    Like I said earlier - Your option maybe to take the hit now and factor it in to future tenancies. 

  5. So technically you could push it via the courts with the clause in the AST (I remember seeing something about this recently) 

    However if one has left the country - It might make it hard to recover it all from the others. 

     

    How would you look to bring action against all parties involved? Do you know where all of them currently are? 

    You can service to last known address but as you know they have moved on - It could be held against you by a judge if it goes all the way. 

     

    I think you need to consult a solicitor on this one - Its a complex claim against multiple people rather than a simple Creditor vs Debtor claim we see here.

  7. I think the issue here is more taking it higher. 

    A credit reference agency has mixed up your details with another member of your family - Would you have guessed that I have had to deal with this for a couple of people in my family before? 

    They both ended with a payout of £250 each as a result of this. (Transunion) was the culprit 

    I can help you put together a complaint along with relevant forms if you like. But you need to get all 3 of your Credit Files and find out how deep it goes with the mixup.

  8. Its unlikely that recovering the money would be possible from students. Sometimes in the game of property Management, its worth just letting go - You maybe likely to recover this long term. 

    Also with the tenancies, did you have an additional term added into the tenancy to make them liable for all costs?

     

    Do you have a copy of the tenancy agreement minus personal details we can see? 

  9. I hate these conversations - Because you will never find an answer.

    You will never ever always get approved for a financial product because it depends on the lenders criteria for lending. Also whether they are actually lending. Sometimes companies wont lend for a while. 

    I remember my brother ordering from Currys during the pandemic and he got a decline. He was furious - Turned out that Creation had really tightened their belts up (Existing customers too!) 

     

    Honestly? Use a good comparison site - Itll give you some good options while only soft searching. Also the drop to your Credit Score (Which is worthless I might add)  will be because of these 2 hard searches. Stop doing Credit applications for a little while.
