  1. very true as they seemed to agree right away once questioned with the right facts, i will have a refund if only temporarily tomorrow and i will donate right away
  2. little update i was in branch today for other reasons and spoke to a lady on the desk. stating how i was treated etc, a sit down with the manager where i pointed out what i had been told on here, and a call to department on my behalf and surprise surprise they are now starting a chargeback and if that fails they are going to pass it on to the fraud department to put in a claim, thank you guys SOOOO much is there a donations link for this site as id like to say thank you
  3. thank you, i will write if that is the better option i am just on the phone to visa now and they are being funny with stating they are a USA based company and so help for UK complaints will be handled via email yet cannot explain why the number is for visa Europe and has a UK London based number yet they will only deal with USA based inquiries on the phone, it must just be one of those days today

  7. two orders where placed online with a firm who where based in china (the fact was well hidden and this was only discovered later on) one was for £67.33 and the other £72.34 (i have added a scanned letter from the bank to the topic) both orders arrived safe enough but right away i noticed the items where just not right they looked nothing like the genuine items i had already owned so i took them to trading standards and also choice store who confirmed after time that they where in fact counterfeit trading standards went as far as saying i couldn't send them back for a refund and sending counterfeit goods int he post was illegal so i contacted nationwide who stated i need to fill out a visa dispute form and provide proof of order and receipts etc which i did, i today get a letter saying they wont be able to do much about it the letter attached to this topic explains it better then i can do i just drop it or can i take it further

This is my second topic about the same shady letting agent letting agent A rented the property to me from the 23rd of September 2010 till the 9th of September 2011 (when letting agent B) signed a contract with the landlady and she wasn't happy and had left letting agent A) now between September 2010 and around march 2011 Letting agent A stated (with no proof) i was x amount in arrears and so started a court case they said they could use my deposit (which they never protected even do my tenancy states its protected with mydeposits.co.uk) and bring the arrears down while i look into the case a few days later i got a call to state i am not in such arrears as they had miss laid some payments and so the court case was suspended and that was that, now they are doing all they can to make mine and the landlords life hell they sent me a rent statement saying i was £1915 in arrears (rent is £814 a month) yet that statement not only never shows the £907 deposit they said they was gonna use and refuse to give me back but also rent charges on the dates below which where obviously dates they no longer had any rights over the proprty as Letting Agent B took the property over from the 9th of September so in theory even do i don't agree with the arrears and never have as they them self's have made numerous different mistakes and errors they have still been able to get BOW county court to restore the hearing how can that be, and how can i stop it 12/09/2011 19/09/2011 26/09/2011 03/10/2011 10/10/2011 as if you believe the £1915 arrears removing the above dates rent so that's 5 x £207 leaves a balance of £880 which is not 8 weeks rent
  9. can i ask one more question as i stated my deposit was never protected, even do my tenancy stated it was when they told me i was in arrears and was taking em to court i panicked and agreed to them using my deposit to offset the arrears while i proved they was in the wrong they asked me to sign a peice of paper they said in the post - it stated i agree to allow '' bla bla agent '' to use my deposit of £975 towards rent arrears now i am told by shelter this is illegal and the whole reason the bond protection scheme is in place they was contacted on my behalf by newham homeless unit (i was at one stage going to be homeless) and they stated he cannot get his deposit back for the above reason am i stuffed now ? should the letter i was going to send them from above template be edited to let them no i no my deposit was never protected and that i will take them to court if needs be
  10. the lady owns the flat as shelter did a land search i think it was for me my new contract with winkworth is between me and the landlord them selfs
  11. thank you so much, that's a great help, does the fact the section 21 has not expired yet and they threatened court action against my landlord station mr bla bla is our tenant and as such taking him has broken a set of rules and sections they quoted, does that not mean im still class as a tenant of there's ?
  12. thank you for your help is there any sort of template with what should and what shouldn't be written on the letter i sent, i was told not to inform them yet that i no that my deposit wasn't protected thanks snorkerz
  13. on my tenancy it states THE TENANT - with my name and address under it THE LANDLORD - with the letting agents name & details under it
  14. but the landlord never received the original deposit this was given to the letting agent who where the ones who kept it and never protected it, in fact my original landlord new nothing about a deposit. They have not requested a new deposit no as they stated '' they don't ask for deposits and never have '' so i am confused as to why the landlord is the one who has to deal with it as i had no contact with the landlord (other then them fixing problems in the property as they didn't trust the letting agent) my contract was with the letting agent and the deposit was also provided to them which they confirm in writing when they state they can use it for the arrears that's its in there possession
