  3. Hi CitizenB, I know the feeling ! I realize that I wouldn't end up with an awful lot of my pot back, but do you think it's too late to cut my losses ? A little while ago, my sister suggested Payplan to me or I could try National Debtline or CCCS. It would be somewhat galling to have wasted that money when I thought I was doing what was best but if it means more security in the future it could be worth it. My wife found Immediate Financial on the Martin Lewis (MoneySavingExpert) site, so we thought it would be ok.
  4. Hi all, just back from the re-determination hearing re Shoosmiths/Nationwide. Before I went my DMC told me that if things weren't going well I should increase our offer from £16.08 to £30 (The original judgement was for £647.02). It did start going that way, with the Shoosmiths guy asking for a charging order, the judge asked if I was able to make any increase, at which point I tabled the £30. Unfortunately, it didn't make much difference as the judgement in the end was for £30 per month and he gave the claimant permission to go for a charging order, however it did stipulate that it was for security only. I also chased up the DMC on the Wallers/Northern Rock issue. They told me they had sent the claim forms to Wallers along with a £48 joint offer (I received a letter from Wallers this morning saying that they had received the claim forms and would revert to me shortly with a response). The DMC says I should receive a judgement on this one within 2 weeks. An earlier posting from rebel11 asked if I had been miss-sold PPI on any of the accounts. Well, there was, originally another debt with MBNA which was settled by my DMC for the sum of £2185 in September last year (although at that time it was being handled by Debt Clear Recoveries and Investigations Ltd. I was miss-sold on this one and I think that might be why it was settled quite quickly. I want to chase them, what do I do - does it matter that it was settled ? Once more Thanks to all.
  5. Hi Citizen B, Thank-you very much for your response. In answer to your question, we are paying £240 to the DMC each month, they are making nominal payments to our creditors and the rest goes into a pot for settlements. At present I have in my 'pot' £3082.10 but only £277.54 available for settlements as they hold a certain percentage back to cover their fees should we decide to leave the plan. I do have a financial statement to take with me tomorrow and I will post as soon as I get home. The Northern Rock is an unsecured loan. Wallers, who are acting on their behalf, are unhappy with the payment they have been receiving and feel that, as they have the largest percentage of our debt they should receive a pro-rata payment from the money we pay into our plan. Myself and my wife have completed the claims forms and sent them to our DMC who, have forwarded them to Wallers with a joint offer of £48 per month. In response to an earlier reply I have requested details of all correspondence from my DMC. Whatever info you need, please let me know and I'll get it. Still have to go to work tomorrow so wont have too much time before the hearing but I'll be on here straight after. Thanks again for your responses.

  7. Hi Ford and Wintry, Usual thanks for your input, it really is much appreciated. If there is any specific info you need please let me know. The Northern rock thing was an unsecured loan. Awaiting news of the judgement on that one. Our mortgage is with Coventry and we are paying interest only, we haven't missed any payments yet. Have requested copies of correspondence from DMC. As far as the Nationwide goes, it is an application for variation as the court decided we should pay £647.02 per month, which is well beyond us, we have offered (through the DMC) £16.08. I have to attend on Thursday and the DMC has sent the N245 form to the court already along with our financial statement, apparently they will object at the time it will take to pay off. Our financial statement shows no disposable income after our payment to the DMC. Once again, thanks guys.
  8. Hi, Many thanks for your responses Ford and Wintry. Ford - I wasn't really sure if I was being helped enough or not, I thought that a dmp would help me avoid courts and the like. I will look at the documents you suggest and follow up with new threads, certainly on The Nationwide and Northern Rock. Wintry - You're not alone, I also don't have enough idea of what's going on, it's kinda like it's all happened around me. The dmc has requested the re-determination on my behalf as the original figure was above what I could afford (I know it sounds stupid - but everything gets sent to the dmc and I don't have the facility to copy anything so I can't remember the initial award). Yes I am a homeowner with one child at home and one at uni. There is probably enough equity in the house to clear the debt but that would be about it. Don't know if it was entered "forthwith or not, see above comment in brackets. I was made redundant in January and couldn't find anything else so in June I became an Everest rep. This is commission only, and once I've earned enough it will be self employed. It's hard, and since June I've earned about £1800 and probably spent nearly half of that on fuel and £200 start-up cost. When I started with the dmc they said I would be debt free in 3 years, they are currently dealing with both court actions (so they tell me) and will be sending me some documentation for the re-determination on the 28th. The only advice I've had from anywhere else is from my sister who has had some problems of her own, and she just really pointed me to this site as she got a lot of good advice and help from many different people
  9. Well, here we go, first post. Struggling a bit morale wise. At present I owe Shoosmiths (Nationwide) £3,388.23. They just got a CCJ and I have to go to a re-determination hearing on 28th. I owe Wallers (Northern Rock) £20,074.63 and they are taking me to court on 24th. On top of this I owe Moorcroft (Santander) £4,814.32. Apex (another biit of Santander) £2,287.96. Egg £9,541.06 and Experto (MBNA) £9,990. 18 months ago I set up a DMP with a company called Immediate Financial, I paid them £1,460 (my first 2 payments) up front and have paid them every month since. I had to reduce my payments at the start of the year when I was made redundant and I'm currently paying them £240. At present I have in my 'pot' £3082.10 but only £277.54 available for settlements. Not sure how much easier they've made my life, I don't get calls anymore but having 2 CCJs is a bit of a blow and not having anything spare for birthdays etc is getting me down. Looks like a long road from here. Am I on the right road ??
