  1. Ok, it seems my defence should have been in by the 29th August, and was not, as I was expecting, 28 days from when I submitted my acknowledgement. It seems that BC 'have not proceeded as of yet' and the lady advised I enter my defence as soon as possible. I have written the following; Not sure what my next step is... To head off any further action, would I be advised to submit a monthly offer direct to Aktiv to see if they will accept (will be in the region of £25/mth)?
  2. Hi everyone. I have received a Claim Form from the above relating to an Egg CC I took out circa 2007 ish. It had been passed through various debt agencies before ending up at Aktiv/BC. I have paid very little off with token payments here and there. POC; Debt was approx £4150 in Sept 08, and BC are asking for; Amount claimed - £4435 (approx) + Court and Solicitor Fees - £165 Total - £4600 (approx) There will be no PP to claim I don't think. BC sent a letter stating that they after failing to make repayments they have issued litigation proceedings in County Court. I received the Court Papers about 1st August 2011, acknowledged on the 8/8/11 and requested the full 28 days. I sent BC a CPR 31.14 on 10/8/11 and BC sent me a letter (dated 15/8/11) stating; "Dear XXXX We thank you for your communication regarding this account. We have referred the matter to our client and will revert to you as soon as we are in receipt of instructions. In the meantime we confirm that we have placed the account on hold. BC" Initially I clicked partial defence online, as the debt is mine, but the value seemed incorrect, was this the right choice? Today is the last day I think I can submit a defence (will phone the court in a moment to confirm). I am assuming that BC will not have contacted the County Court to put anything on hold. Will I have to submit a holding defence pending any documents received from BC? It has been difficult to keep on top of this since I sent the CPR as my wife gave birth a week and a bit ago and I just haven't had the time to chase due to the problems we were encountering both prior and during the birth (mother and baby both doing fine now ).
