  1. I was put in the wrag group without a medical assessment (provided medical evidence) - I was expecting support grp and asked for further information....app my condition (agoraphobia/panic disorder) does not come under any of the support descriptors and therefore placed in WRAG. My question is can I appeal it does not mention this in DWP's letter?

    About 5 years in total....but in varying degrees. Became more severe after being involved in an RTA close to home. Thanks to all who replied.....and your very helpful links / suggestions. I will investigate these further.

    Does anyone have experience of being treated for agoraphobia on NHS? Mine has not been very good....I was referred for treatment sometime ago - had to wait about 9 months for an assessment apt with a therapist - and was then told I would need to travel 10 miles to their centre......they do not do home visits - this was despite being told by my GP that they would come to my home and take me out....... Rang GP and he said there was nothing more he could do - although he did ring the MHT and got the same response as I did. Stumped now as to what to do. I live alone and do not have anyone in a local radius that can help out. GP said only option would be to go private but at £50 a session minimum that is way out of my reach.
  4. yes think I've been very naïve here as perhaps my GP was as well - I had a period of sickness about 5 years ago with the same condition - but I was still employed at that time.....and Occ Health rec this amount of working time to my dept....upon my return - gradually increasing the amount.
  5. yes he does. He had been providing certificates for DWP who requested them.....I am well enough to start looking for a new job - with reasonable adjustments - ie phased return to work.
  6. I've had a period of sickness over 2 years but GP has now signed me off to return to work...(got to find a job first)....on his fit note he has written a phased return and ideally 2 half days to begin with. How do I broach this with future employers?

I won my appeal in august this year but the appeal judge said if they could have based their decision on facts at time of appeal I would have been out in support grp.....(they had to make their decison back to DWP decision date of 2011). I was advised to submit all supp evidence to DWP for a re-assessment...but they will not do this? What do I do now? DWP paid me my back money I was due and have not had to attend any wrag grp interviews....
  9. Would I still have to provide DWP with sick certificates again? If I got re-assessed/zero points? I've got all the info from before - and my Rep attended on my behalf.......its just the amount of time it takes for appeal to be heard......18 months this time.
  10. Great all sounds wonderful NOT. I'm applying to my former employer of 30 years pension fund for an immediate payment of my deferred pension due to my disability....fingers crossed the Trust approve this. I presume if I get zero points again - I can re-appeal? as of now? I'm not getting any ESA now as I'd received it for over a year - and I have over the savings threshold.
  11. So what do I do now? Do I have to submit a new appeal / start the whole process again? It took 17 months for this appeal to be heard.
  12. Firstly I won my appeal this week received 24 points (as opposed to Zero from DWP). However I was only put into the wrag group which is not helpful as I have severe agoraphobia/anxiety. I had a representative who represented me at the Appeal hearing. The judge made a comment that said they could only make their decision based on the facts from March 2011 (when I submitted the appeal) and not now. She said that if they could make their decison as of now I would have been put into the Support group because the law had changed? What do I do now? I am not fit to go to work - (GP's latest certificate to DWP runs out mid December 2012). Am I going to start getting letters from DWP asking me to attend work interviews? which I cant poss attend. ? Do we have to submit another Appeal as of now? to get into support group? Am I entitled to receive the wrag element of ESA from week 14 of my claim to 30th April 2012? Does this happen automatically? The Judge also put on her decision letter that I would not need re-assessment for 2 years. Is that 2 years from now ie August 2014?
  13. Hello yes it does.....but my condition remains the same........below is the wording....... Appeal is unsuccessful, you should only issue further statements if their condition worsens significantly or they have a new medical condition. My GP is very reluctant to go against DWP advice. Perhaps I should contact practice manager?
  14. My certificate has expired....and he has been written to by ATOS and told not to issue any more....
  15. I'm currently half way through serving notice thru dismissal with ill health and on an re-deployment plan. What happens if your GP is instructed to sign you back to work as your ESA tribunals failed? My role is supernumerary and I do not have a role to return to. I have been off sick for over 18 months after being involved in an RTA and have a disability. I'm still expected to submit sick cert's during the notice period.
