Creditor is Royal Bank Of Scotland and would guess that the account is at least eighth years old and until loosing my job was in perfect order and payments were in order, unfortunately I do not have all my statements. Didn't receive any statements while Triton and RMA were on my case but all of a suddenl I received one yesterday demanding full repayment.
  4. Thanks for reply. To make long story short due to being made redundant I struggled with making repayments so was handed over to Triton who set agreement which I managed with some difficulty to meet but every few weeks they would call quite aggressively and kept increasing the repayment amount.Eventually the I was unable to meet the increased amount ie £230 per month on £5000 debt (It started at £100) but continued with repayment of £200 per month. I was informed that it was not enough and had both Triton and RMA hassling me incessantly so in desperation I looked for CCA,hoping to reclaim some control of the situation.I do not deny the debt but I would like to agree a realistic solution for repayment.Now that they have confirmed that they cannot find a CCA I hoped that they would be more reasonable but in fact I have received demand from them for full payment now. Just wanted to know my options at this stage.

I have received a letter from my credit card company today admitting that they are unable to find my CCA due to It being "misfiled" and accept that the "agreement is currently unenforceable" but go on to state that will take "such action as is legally permitted to pursue the outstanding debt" What action can they take if the debt is unenforceable? Are they likely to take it court in any case? What does unenforceable actually mean? Appreciated any help.
