  1. Good morning I have returned from a weekend away to a CC Claim form with Lowell Portfolio 1 Ltd as the claimant ... They state it to be £150.23 to Avon cosmetics, but I cannot remember such a debt and if there even was one it was around 5 1/2 years ago! I never received a default letter from Avon (they say in the claim they sent an assignment in 2015) but I can honestly say, I never received anything. They are claiming #150.23 + #12.02 (8% interest) + #25 court fee + #50 legal representatives costs ... total is #237.25. My husband just says to pay it (I can't even see how I can do that as no payment details are attached) and I really don't think I owe anything! I have no idea what to do next & the clock is ticking on me doing something with this. Any help would be very gratefully received ... I don;t have a cheque book, so it would have to be a BACs payment (If I do just pay for it to go away) . .. but i'm not happy to pay fees, interest etc. on something I really don;t think I owe! Many thanks
  2. Hello, I am desperately hoping someone can help me ... i'm running out of ideas! My husband (stupidly) got a magistrates court fine, was in and out of work and we paid as much as we could - even though the court enforcement team were difficult to deal with to say the least. In December 2010, the payments were stopped being taken - he moved house and was under the impression everything was settled. In February 2011, we received a letter saying the balance was outstanding and 7 days to pay ... due to the bank account (now closed) we tried to get to speak to someone at the court - but all they kept saying was - we can;t help - you need to speak to Marstons. We called Marstons and they were unhelpful - asking for payment in full. Rather than not pay anything we paid a 'Gesture of Goodwill' of £50 directly to the court to show we were not dodging payment. We continued to do this over the last 3 months as no one at the court nor Marstons were any help. Finally we discover that a Warrant of Distress had been issued, that Marstons were going to force entry into our home - all whilst we were trying our best to get a statement of account and track our payments etc! June arrives and Mr. XXX arrives from Marstons - pops two letters trough our door - both with incorrect balances - we call him to advise the situation, he becomes rude, aggressive and abusive intially to me and then to my husband - who is a burly rugby player LOL We go along to see our MP, he writes to the court and eventually in 15th July they send a response. We still await the bank statement from the closed account - but paid another £250 so the debt was atleast settled with the court whilst we sorted out tracing the payments. Our MP writes to us and advises that he assumes this matter is now setlled etc. 1st August, Mr XXX calls wanting his £275 in fees - we refuse and say it is paid directly to the court and he needs to contact them. He refuses - says he will be at my home at 06:00 to force entry and take our goods. I should add the goods are all my wifes as I moved into her home and she has a Stat Dec to that effect. He says doesn't matter and he can take what he likes - I advise she's pregnant and her son is also at the property (age 8) - he laughs. I really disagree with paying the bailiffs fees. It has taken us 5 months to get a response from the court and we have spent so much time - I am stressed to hell and constantly worried. Can anyone advise if he can still force entry for his £275 fees - also the distress warrant was issued 24/02/11 - so 180 days takes us to 23rd August 2011 when it will expire? Any advise would be greatly appreciated ... I have appealed to the better nature of the court but they advise they do not have the authority to recall the warrant?
