Just a quick update, Still waiting for FOS although have just had a letter off them saying they are under pressure and it will probably be another year before anything is done, i'm sure if they where chasing me for money it wouldn't take this long, oh well at least it's accumilating interest while I wait

Sorry, yes they have got a liability order and are useing Rottendales, but already there is a discrepancy as 1 amount for 2012-2013 is correct but for the 2011-2012 is higher than the amount provided by the Council, but I thought that they had to clear the earliest one first before collecting for the second one, obviously i'm wrong -
Wow i'm amazed this is still going on, to clarify a few points, The bailiff pretends it has gone through a court but actually it has not, it has gone through the traffic enforcement centre, different thing altogether. The Bailiff was not certified, yes Equitta did say he was, the bailiff in question said he was, the courts in fact said he was not. So correct me if i'm wrong but an uncertified bailiff does not have the power to enforce. Why or how am I removing my details? Sorry, do I have to post my name, address and phone number? I would be extremely happy for the bailiff company or the uncertified bailiff to to take action against me, If you knew me you would know i am not a liar as you seem to be implying, at the end of the day why would they have returned my money had they been acting in accordance with the law? When someone knocks on your door and demands money that is ok, after all we had not paid the pcn. What I have disputed is the extra charges applied, yes I would expect some charge but what really set the alarm bells off was when my wife rang the traffic enforcement centre who I must say was very helpfull and put the pcn on hold while a late witness statement was sent in, she then rang the said bailiff who went off on one and said to her that he didn't care what the court said and YOU'D BETTER PAY UP OR ELSE. then demands cash. That was when I started doing the checks and realised something didn't add up. SO TO ALL YOU DOUBTERS................................................. Are you honestly telling me you wouldn't have done the same thing as I have done and put this wrong right? By the way I have kept every letter sent and every letter recieved fom the council, the judge,the bailiff and the bailiff company, PROOF

I believe the original loan was paid off but I really don't know whose name it was in. I have requested documentation for this and so far have recieved none. Have asked again so will post when I know more.

Quick update; recieved letter from provident saying that my wife has signed for a new fresh start loan to pay a previously unpaid debt irrespective of whether the original debt was statute barred or not. Any help would be much appreciated

I have sent their solicitors a letter stating exactly that and I hope that is an end to this nonsense. It's amazing what these people are like, we borrowed money when we were first starting out and struggling and then years later they are coming out with this S**T. Unbelieveable!!!!!!!!!!!

Ok thanks dx, i'm going to send off to the solicitors,a letter stating thanks but no thanks but go ahead and take me to court for a statute barred debt!!!!!!!!!!!!!

Had a letter off providents solicitors today offering a 50% reduction if paid within 14 days, should we pay or tell them to go away?

No we did not get any money, I'm just trying to get them to go away!! Oh and one of the letters they sent back did say it was a new start

Just a quick question for anyone in the know. In 2002 we took out a doorstep loan for £150 and as far as we are aware it was paid off. In march of this year we recieved a letter off a DCA saying we owe Provident £135 so I rang the DCA and asked for proof. The guy said they would send some but none came. At that time I was not a member of CAG and did not realise it would be statute barred anyway. About a month later a Provident caller knocked on the door when I was not in but my wife was and she signed an agreement to pay this £135 as she was embarrased about it so she just signed it. So I sent provident a letter of complaint saying even if there was money owed it was statute barred to which we recieved a letter from C. K. Edrupt solicitors saying the account was now in default and basically pay up or we may take you to court. So I sent another letter to Provident complaining and they have sent a letter back stating that because we acknowledged the debt by signing the agreement on the 07/07/2011 then you are liable and must pay. So are we stuffed? Will we have to pay? If not what should we do to get rid of them? Any help would be greatly appreciated

oh I do definately want this one to go to Court really to give me some better knowledge and understanding, even if I lose it will be a good learning curve for me to take on the bigger ones. Will get the lba done and sent off this weekend. Thanks
