  1. Bazooka Boo and Nailpost, Thank you for replying, i haven't been online and didn't realise. I wasn't ignoring your advice and do appreciate your comments. Since i received that statement we have also been sent the a copy of the CCA, signed. It does have PPI added to the amount and it was for a loan. We have no idea how much of the amount they are claiming is for charges though. We cannot check the credit file. we tried online but couldn't answer the =security questions and don't have utility bills in my partner's name to send them for proof. We are going to send a SAR to the bank but think if it is not SB it is only a few months off being so. Also a letter to the DCA saying it is in dispute. Does this sound right? Thanks again!!
  2. Thanks, it didn't say it was in reply but it is the first thing we have received since we sent the letter at the beginning of August. I get confused between prove it letters and cca requests, sorry, the one we sent was this: Dear Sir/Madam Ref: You have contacted me regarding the account with the above reference number, which you claim is owed by me. I would point out that I have no knowledge of any such debt being owed to I am familiar with the CPUTR 2008 and the Office of Fair Trading’s Guidance on debt collection, which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question. I would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. AND in not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods. Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment. I would ask that no further contact be made concerning the above account unless you can provide evidence as to my liability for the debt in question. I await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to Trading Standards and also inform the Office Of Fair Trading of your actions. I look forward to your reply. Yours faithfully
  3. Hello A prove it letter was sent around 2 months ago regarding a outstanding debt from a loan from possibly over 6 years ago. The response is what 1st Credit is calling 'a latest annual statement' detailing all financial transactions from xx2010 - xx2011 and on the same piece of paper (i.e A3 folded in half, this is on the second page) a crudely typed breakdown which includes: account number statement number 3 amount of credit opening balance interest rate (but there isn't one it just stated %pa) date of agreement and then some t&cs Now i know this isn't anything like a CCA, so should we now send an official CCA request, before it was the prove it letter template from here without a postal order.   4. Thank you, it is for my partner and he did include the account number but i guess they need more proof. We do not have any bills in his name, would a bank statement be ok?

Hello I recently sent a SAR letter to the HFC bank and the letter and postal order have been returned with a letter saying i must resubmit my full request with the following additional information: Personal Information- details of any previous address history Proof if ID Orginal letter to be signed The address i am living at has never been made available to this bank so they will not have any record of it, all recent correspondence about this debt has come from 1st Credit. If the signature is crossed, is there any additional harm in providing the addresses and a copy of a passport? Thank you very much ftp

  7. ta, can i just clarify who i need to send it to, is it finance company who arranged the loan or the bank? The credit agreement has the finance company's name across the top and it was 'signed on behalf of xx bank'. cheers ftp
  8. Great I have been looking for this letter template on this site and using Google and seem to have found different versions. This seems to be the most relevant one: (i can't post the link unfortunately but it is from this site and is summarised below) (A Subject access request which is an alternative to one being made for a charge reclaim. Geared more towards debt collection...You should send a £10 postal order with each one and address it to the Data Controller at each company (send recorded or guaranteed) they have to respond in 40 days) would this be the one you would recommend? Also, looking at the credit agreement it is for a finance company on behalf of a bank, which one do i send it to? Sorry for all the questions, i just want to make sure we get this right.
  9. Ok, will do. Thank you. I was wondering about the dispute thing as i don't want them starting proceedings whilst we are waiting on the bank to provide the requested info. One more thing, what is the best way to send the £10, would they accept a postal order? Ta again ftp

  11. Quick reply! thanks Brigadier2jcs This is sent to the original creditor then, i.e the bank? Do we need to respond to the dca to let them know we are looking into it or can we just ignore them for now? Could they start court proceedings whilst we are waiting on info from the bank?

Hi again, ok, here is where i am: partner has had old debts resurface, 5.5 yrs at least since last default he has lived abroad for years for work, back in UK now partner has very low income now as looking after children during day and works only evenings absolutely everything is in my name 2 letters from dcas sent prove it letters received one response after 3-4 weeks with signed cca. (This details PPI and interest on PPI totalling almost £4k on a loan of not much more than that!! A few grand had been paid off before defaulting.) tried to access credit file online with equifax and experian but no luck due to not knowing enough about the debts to get through the security and past address being overseas. Phoned up and was advised to send copy of passport and utility bill (can't do that, as all bills are in my name). It is his cca but could be sb, do we request statements to check this or offer some sort of payment plan? Hope this summary is ok, let me know if you need any other info. Thanks again ftp

  14. Hi again Thanks so much for your help, and sorry but i didn't see those last two posts so apologies for not responding. He sent the prove it letter and heard back for one of them around 4 weeks later. A signed CCA was included and a standard letting giving options, i.e get in touch about payment or prove it is not you. We are sure that if this is not statute barred it is probably only a month or so away from it. Do we send the statute barred letter or the one asking for a statement of accounts with £10? He has avoided checking his credit file online since returning to the UK, should he do this now? I'm also shocked at the credit agreement as the total repayable is one and a half times the borrowed amount, due to high interest and PPI and subsequent interest. If the debt is not statute barred could we at least get it reduced because of this? Sorry for all the questions, but you all have helped so much and i'd much rather listen to your advice than work it out for ourselves and get it all wrong! thank you thank you ftp

It's 1st Credit and 2 high st banks, i'm a loathe to give too much detail though, i'm cynical enough to think they read these forums too. there is nothing to link him to this address other than his bank account. I was hoping he'd be able to drag things out but also wonder if a payment plan for the younger debt would ease stress levels. If his debt is not linked to me how would we do a budget for him if requested as i pay mortgage and all bills and his salary just goes towards that?

Hello My partner has received 2 letters from a debt collection agency, due to separating from his wife and living abroad for a number of years he had not received letters previously. 1. is for a loan debt not acknowledged for possibly 6 years, definitely 5.5 years. We hope this is statute barred. This letter threatens a CCJ. 2.is for an overdraft not acknowledged for 5 years. I understand from reading these forums that he needs to send a cca letter which he is about to do. Do we send a statute barred one at the same time or wait for proof? My partner has no assets (house and everything within is mine and in my name) and is on a low income as he looks after our children during the week and works part time at weekends. We are not married. If he offers a payment plan for debt 2 will we have to supply details of my salary and all our outgoings or will they base it on his income alone. After our outgoings we have nothing left so would they accept a token payment each month of £10 or so? If he ignores the letters what is the worst that could happen considering he cares little for any sort of credit rating and has no money of his own? Could the bailiffs come and seize stuff even if nothing belongs to him? Any help will be much appreciated as this is incredibly worrying. Thank you! ftp
