  1. Well my letter has been tweaked adn will be sent recorded tomorrow.... so now we wait. HUGE Thank you to Gbarbm for the help and advice. I shall keep you all informed.
  2. PM sent...i hope its not too confusing. And thank you
  3. Thats just it though....i dont know if the information i have actually proves they did. All they did was send me quite a few award notices and amended award notices asking me if the information for that period was correct....which it was. i have it all written down in date order as i have written the grounds for appeal today, but havent sent it yet if you want to have a look at it? I can PM it to you?
  4. Thanks Gbarm. Do i dispute it or do i wait? I havent sent in a dispute yet, but looking at the paperwork, it seems as though they have made an error...nowhere on any paperwork does it say they will be using £23651 to calculate 2011/2012's tax credits. All it says is "this is the information we have please check it is correct for 2010/2011"... which of course,...it was!
  5. Ok, so im just going through the awards as follows - hope this makes sense to someone becaus it definately doesnt to me. I have the following: Amended tax credits award for 06/04/2010 to 05/04/2011 which says i have told them we started work in October 2010. I gave them an estimate of £12000 for me (my salary was £24K) so 6 months left, and just over £9k for my husband as that was what we worked out he would be earning up till the april giving us a combined income of £21438 This was dated 15th November 2010. I then received an annual review dated 04/05/2011 in which it states that i had told them we both started work in October 2010 on the dates shown which was correct as was everything else so i called and comfirmed it was all fine. The next one i have is dated 22nd July 2011 -my husband had been getting Jobseekers prior to his new job and we didnt know how much and had to chase the DHSS for the info so were late passing that on. We also changed bank account which the letter acknowledges. It says it is an amended award for 06/04/2011 to 05/04/2012. This one states that our income for 6 April 2010 to 5 April 2011 is based on an estimate provided by us and gives a combined income of £23154. It was an estimate because we never got the amount from the DHSS so had to work it out, but our income was given from the P60's as being £10838 for me and £12316 for my husband It actually says on this award (and quote): Income gone up? - tell us now to keep your payments on the right track. This does not usually affect your tax credits payments for this year. They will stay the same until April 2012 as long as there are no other changes in your income or circumstances (this is REALLY confusing!) From 6th April 2012 your payments will be based on an income of £23651.80. If your income is more and you do not tell us yo umay be paid too much from April 2012 It also says check all the details are correct...which they are! I then had another one dated 7th Feb 2012 which is a Final tax credit decision for 06/04/2010 to 05/04/2011 ( i am REALLY confused by now as its feb 2012 and they are sending me a final decision for 2010/2011??) which is an exact replica of the one dated 15th November. It is now from April 2012 they say we have been overpaid to the tune of £6000. This is what i do not understand. When we started work in the october I told them, and told them or actual income in the April, so have they failed in their duty ie: Have used a 6 month wage instead of projecting it to a 12 month income therfore giving a much lower figure? I cannot for the life of me figure out how this has happened. Is it obvious or is it me being thick? I can scan in the letters etc if anyone can help me and needs to see them. Thank you
  6. Thanks Gbarbm. I am so fed up. If we have been overpaid we will pay it back, im just at my wits end now and when he said we will get a debt colelction letter i just went to pieces. I am goign to dog out past award letters and see what they say and i will post back. Thank you again x
  7. Just an update. I DID give them information from the P60's which would have been the amount from October 2010 when we started work to April 2011. I also included my husbands benefits prior to that, so i am a tad confused. I called the payments place today to see what the score is, as i am already paying back an amount from 2009 which was a single payment and they said at first there was a record of me setting up a payment plan but no record of me actually paying it!! After some insistance i was and telling them my bank statement showed this he went off and came back and said it was actually TWO overpayments I was paying back and it had been set up wrong, This is news to me i was not aware there were 2! He said i am paying off the last overpayment before the first overpayment hence why it is not showing as being paid (confused?? I am!!) He said the overpayment was £300 ish,,,,but i have been paying £23 a month since 2010 so by my calculations i have overpaid them. He said that we had to set up a seperate payment to pay this new overpayment off as becasue the first overpayment was a single claim and this is ajoint claim...they cannot run one after the other. I am REALLY confused now and do not understand whats going on I got quite upset while on the phone with the man at HMRC and even worse when he said we would get a debt collection letter. I dont know what to do
  8. As far as I am aware you are only required to send off the notification to the DVLA and your statutory requirement has then been completed. It is then up to DVLA to prove that you didn't post it and NOT for you to prove that you did. I am sure someone with more knowledge will be along shortly. Meanwhile have a look here: http://www.bitterwallet.com/dvla-act-unlawfully-whilst-losing-your-letters-and-blaming-you-for-it/29151
  9. Just an update. We paid the £65 yesterday and the surveyor has just been round. He didnt say much apart from it was an unusual house lol, and quite a bit larger than it looks. He was also surprised we have stables as it isnt obvious from the outside as we are gated in. Fingers crossed
  10. How would we find out who the valuer is? Would we need to speak to the mortgage adviser??
  11. Having run another check on rightmove its showing houses that are nowhere near as big going for over £115k!!
  12. Thanks Dotty. We googled and have just done it again to chek the postcode in our area. Zoopla is thorwing back a 1 bed terrace on our street at £59K.... ours is a 3 bed detached over 4 floors (3 roomed cellar) with seperate outbuildings which used to be a stable with a hayloft and it was valued at only £98k......whereas a 3 bed detached up the road in the same first half postcode sold for £186K a couple of months ago....it makes no sense to us??
  13. Hello everyone. My husband and I have applied for a loan to add on to our crrent mortgage with our current lender. We are renovating and lots has gone wrong and been ncovered so we need the money to get it finished. We googled property prices and found or home appeared to have 85% LTV in it for the amount we require. The mortgage adviser was great...we told her we werent convinced our home was worth more than the googling showed but we were approved and she said a surveyor would call and arrange to come round and value the house. That was saturday....i called today and she said that she wo0uld find out what had happened. She then called me back and said they had made a decision....and had valued our home at only £1000 more than we paid for it. We have already compelted asome renovations so surely this cannot be right? And how can they value a house without even looking at it?? We wanted to borrow £20k, but she said they can only loan us £7k now which wont be nearly enough. She said we can appeal and pay £65 for a surveyor to come out but i dont want to lose £65 if we are kidding ourselves. Any advice?
  14. I have had a look at COP 26 and im not sure if any of that applies to us. We started work in October 2010, in April 2011 i gave them the information of both our P60's. My husband gives me a sum each week for housekeeping and i did not know hat he earned up until recently when we had a blow out about it....thats not an excuse but when i gave them the P60 info this April it was a lot more than last years.I couldnt have checked through the year becasue he gave me a set amount every week out of his pay so I wouldnt have known anyway. I havent called them yet as im too frightened that they are going to ask us to pay back a lot more than we can afford. We have no spare cash at all and im very very worried.
  15. Thanks Gbarbm. I gave them the information they asked for every April since we have started working. They are adamant they sent us several letters through the year reminding us to check our earnings and make sure we were right. I dont recall ever getting any reminders of any sort and even if we did i thought the info we had given them off our P60s was right! We just dont have any spare cash,we bought a house last year and we're in it up to our necks as it is.We re just about keeping our heads above water, but my husband is talkign about going bankrupt now becasue he is so fed up.
  16. Please can someone help, we dont know what to do. We have had a letter today from HMRC saying we have ben overpaid £6000 from April 2011-April 2012 Oct 2010 my husband and i started new jobs within weeks of each other and HMRC were informed. In April 2011 i informed them of our earnings for that year. During 2011, we bought a house and moved to a completely different area, new job is about an hour away now. At NO TIME did we receive any correspondence from HMRC and to be perfectly hoenst never gave it a thought. I renewed as per usual a coupleof weeks back when the renewal pack came. Told them our earnings and that was that. Then the letter lands through our door today....£6000 over payment. I called and the woman said we should have known from our wage slips we had earned far more than we had told them, i never even thought about it! But if we have been overpaid then we will pay it back, but i dont know how we are goign to to that. We are in debt up to our eyeballs and are trying to work hard to pay it back...my hisband is doing 50+ hours some weeks to try and get us straight. What HMRC use ie: before tax pay is rubbish, we earn nowhere near that once all stoppages have come out. We have no spare cash and im seriously worried. I suffer with anxiety as it is and im having a meltdown right now. Also, when i worked out the payments, they paid us £5000last year so how can we owe over £6K?? My husband is going mad, he's saying that it cant be right, Please help I am worried to death.

  18. I dont get the bills through the post. I knew last quarters was high at £400 but we havent had the heating on, and i did think it would go down this quarter, so im really puzzled as to how it could be this high.
  19. Willt hey allow me to switch though if i owe them £800 Bang?
  20. They said that we were on the best tariff? I sant seem to find a cheaper tariff and i have called them and they confirmed this and said my bill was right
  21. Hi there, i hope someone can help me. We moved here over a year ago and there was no gas meter. we had one put in and I have been giving readings online regularly. Over the past 6 months our bills have crept up and up butnothing that we thought wouldnt even out int he summer. Today i gave a reading to find that we now owe over £800!! Februarys reading was 2554, todays was 3833. We are paying £65.00 per month by direct debit which is now clearly nowhere near enough! We have gas central heating- we had a brand new boiler fitted in September last year and we have a gas cooker. This seems terribly high. Does this sound about right? We are with Southern Electric and its not an imperial meter. Thanks in advance.
  22. Thanks everyone. We really want to help, but cant give them the money back as hubby bought a van with it so we dont have it.It was a private sale, we dont buy and sell cars...i doubt we'd ever sell one again after this lolWe gave them the receipts and everything for the head gasket and water pump sot hey knw that was done 2 days before they bnought it.Thanks again x
  23. Last weekend we sold acar to some people we know. The week before it broke down and the AA came out to my hubby. The head gasket had gone but the AA man said it looked fine other than that! Head gasket was replaced and also a new water pump put in as it had a slight leak. Tope end was clean as. Once car was running and had a little service we put it up for sale as hubby really wanted a van. Acquaintances decided they wanted to buy it. We explained what had happened that it had a bit of a rattle and might need looking at becsaue engine management light was on but this could be becasue of the head gasket going and would need a garage to turn it off.. Also car has moon and back miles on it. Acquaintances said they wanted it and even insured it before coming to look at it and take it for a drive. We knocked £100 off because of all this sale was £500 They had it a week then yesterday got a text saying engine was knackered. When i asked what had happened was told that car had a rattle on sunday was taken to a garage on monday and acquaintances were told engine was knackered, it had an oil leak, the electrics wanted doing and the engine could blow at any time. Husband is car savvy and said he couldnt understand it as it seemed fine. Was told it might cost £600 to fix or a new engine adn that car was left at garage as was told unsafe to drive. We did some research and have priced up a reconditioned engine with warranty and fitting for between £250 adn £320. We have offered to pay for the engine. Acquaintances have said they will wait and see what their garage says. I rang their garage today and asked what problem was. The man said the engine had seized, then said it hadnt but it was about to blow. I asked how he knew this and he said, because it was knocking. I asked if he had actually looked at it, he said no but he could tell from the noise it was making. I asked where the oil leak he said it had was he said he didnt know.....if he hasnt looked at it how can he tell? I texted acquaintances today and told them that we would pay on credit card towards any repair bill - their garage doesnt take cards cash only apparently. I said we would collect the car, take it to a reputable garage that DOES take credit cards, get it looked at and if necessary pay for the new engine. I have been told that they now want to wait to see waht their garage say and that i can give them £250 towards the repairs!! Errrr....no!! The offer is reputable garage instpection and any repairs, or if necessary new engine. Not to pay some backstreet garage cash for a job we can get sorted for half the price or give them cash! We feel bad enough that the car is apparently rubbish, and have offered to sort it, but it appears that this isnt acceptable. Do we have to give them cash? We dont have it as hubby bought a van with what they paid for the car. I can pay on my card though but it appears they want the cash. The car went in on monday and STILL hasnt been looked at. We would have had this sorted by now, and forgive me for being cynical but if i bought a car and this happened and then the seller offered to sort it id be snapping their hand off. Where do we stand on this one? Thanks folks.
  24. Hi I told them i had never agreed to it and that i would never buy PPI over the phone anyway, which I wouldnt.
  25. The DVLA have it. They have it because my husband got flashed by a speeding camera and it had our old address on so he sent it off to be changed as the fines office want it to add the 3 points and have advised him to send it off and get his current address put on it before sending it off to them for he 3 points adding. I guess hes just annoyed that he has been driving round for almost 2 years without any knowledge he was apparrently a high risk offender and now the DVLA are demanding 96 quid and 14 days to respond. It just seems ridiculous that after all this time they suddenly decide that he needs a medical and want him to pay for the priveledge. He's taken his punishment, paid his fine, yet they want even more money and the threat of revoking his licence if he doesnt comply. It seems very unfair to do this now. Thanks for the response
