  2. Thank you for the replies. Yes he does have an employee handbook and a contract. He has brought these home tonight and the relevant bits say: The holiday year runs Jan 1st to 31st December. You are entitled to 6 weeks holiday a year calculated at the rate of 1/52nd of the annual entitlement for each complete week of service remaining in the current holiday year In addition to your holiday entitlement you may take and be paid for Christmas Day, Boxing Day and New Years Day. Carrying over holidays - You MUST take your entitlement durin the holiday year, holidays may not be carried forward into the next holiday year nor will you receivepayments for holidays nottaken. (they have been doing this for another employee) There is a bit more but it is just about what they class as public bank holidays and how they will be paid and that they wont agree to a holiday which is longer than 2 weeks Hope this helps.

  4. No its definately right huggy. They are saying he can only take a maximum of 2.5 days. He put in for 4 days leave and was told he could not have it as its a maximum of 2.5 days per month that he can take in any one month. He has been up to the office this morning to try again and the secretary up there said he had been refused yet again becasue he can only take 2.5 days each month
  5. Hi everyone, hope someone can advise My husband has been working for the same company for around 3 years now. He works on average a 50 hour week with overtime. He put in a request for annual leave a few weeks ago and was told that leave is now restricted to 2.5 days a month. He is pretty peeved as there is a bloke he works with who has just gone off abroad for a week, he also gets his holidays carried over or bought back off him if he doesn't use them. My husband does not get this but they do the same job. There is nothing in my husbands contract that states he can only take 2.5 days per month and nothing about accrued holidays Is his employer allowed to do this? Many thanks in advance for any advice
  6. Thank you raydetinu. The boss has been this morning and agreed the work isnt up to standard and has promised to complete the job to my satisfaction at no extra cost.
  7. We have at the moment, a firm of painters and decorators in to do some work paid for by our insurance company. They were one of 4 that quoted for work and the insurance company told us it was acceptable to go with them. They started work yesterday and to be honest its rubbish. We had brand new windows and door fitted 2 weeks agao and they have GLOSSED over the wood effect UPVC sills round the door! They have also splashed paint over a cast iron radiator we paid over £200 to have restored. The paintwork hasnt been prepped and there are lumps and bumps all over it. They also said they werent going to line the walls prior to papering. Since they stripped the walls its clear they need lining and the boss has told me if iwant it lining it will add an extra day and extra cost onto it. The quote says prepare walls and ceiling - does that not mean lining also?? The boss is on his way to see the door frame and the woodwork, but i could do with some quick advice as to where i stand. I certainly dont want the quote being more as i doubt the insurance company will pay it.

  9. Hi dx100Uk Having found the original Toyota folder that has the details of the car in it, it appears i was never issued with a copy of the credit agreement. The folder contains all the information i was given pertaining to the car. In it there is a copy of the vehicle order form, a small information booklet about the car and a booklet about how to keep the car in showroom condition. I also have the same folder for the first car with exactly the same information in it - with no credit agreement for that one either? I am quite particular about these things and can lay my hands on every single credit agreement i have... except this one, and it seems very odd how i do not have one for either car. I know i signed one in the showroom for both. I do have the default letter though.
  10. I forgot to add...they also included a letter addressed to someone else at another address informing them that they had defaulted also! This is obviously a mistake, but what do i do about that also? Do i send it to the person in the letter?
  11. Hi everyone, I had a car under a personal contract plan. i started this in October 2010. In february 2012 i had a letter from the dealership asking if i wanted to change my car. I took the opportunity to change to a car that was cheaper per month. Several months in and my hours were cut and we couldnt afford to keep up the repayments, i contacted them and asked to do a voluntary termination. The lady explained that there would be a lump sum due at the end of it but that i could make arrangements to pay. I surrended the car a month later. They sent me a financial statement and said the amount i owed was a little over £4000. I sent the statement off with an offer of £20 per month for now,as that is all we can afford. I then received a phone call a couple of weeks later saying that the offer of £20 was not acceptable as it would take 15 years to pay back. I again explained that we could not afford any more and i was told that they would put a charging order on my home. I told them that i wasnt refusing to pay and how could they do this. She told me her manager said this is what they would be doing. Yesterday i received a default notice. It says i have breached the agreement becasue i have failed to pay the amount due in accordance with clause 10 and am required to make apayment of £4267.47 before august 22nd 2012(which has already passed!) and that they will take action to recover the goods - they already have the car and must have sold it in order for me to owe this amount of money. It also threatens me with court action. I havent refused to pay, i just cannot pay this amount of money to them imemdiately and i have offered a payment. It isnt much, but its something. What i am worried about is the threat of a charging order. My husband and I jointly own the house and we have 3 children, one of whom is 18 now and in full time education. We are worried as to what we do next and would be grateful of some advice. Thank you in advance
  12. Thanks ericsbrother. I have emailed them again tongiht to be told if i dont get it by saturday let them know....but they dont say what they are going to do! Looks like i will have to wait till saturday. Im really not happy but theres nothign else i can do other than wait i guess.
  13. All i keep getting told is its in the terms and conditions. Which may be as well, but when goods are not fit for purpose then i dont expect to wait a month...and still be waiting. I agree wholeheartedly with what youa re saying Dweezle, they are shocking. I am a long term customer, i paid off my account last year in full which was just over £1500, and have paid whatever i owe straight away ever since and they treat me like this!
  14. I am waiting for a refund on a sofa that was collected on 8th december. I asked for a refund and was told i would have to wait for them to get the goods back and be inspected - they were alreadyinspected in my home by one of their representatives in November, They refunded just over £1000 to my shopping account on 28th december, i requested the refund on that date and still have not received it. I have been told it may be in "processing" and then was told it was sent on 28thh and can take up to 14 days to reach me. Why is this? I sent a birthday card from Yorkshire to Basingstoke on 2nd January and it arrived on the 3rd. So no sofa, sitting on the floor and still no refund.
  15. Hi everyone, hope you are all wellI need some help with a little problem I bought a suite from Littlewoods last October - it was delivered just before Christmas 2011. Over the year this suite fell apart and was clearly not good quality so I wrote to Littlewoods. They sent a chap out who agreed the sofa and chair were sub standard and that i would be hearing soon. To cut a long story short, collection was aranged for 5th december - which came and went and no sign of Yodel. My son took a day off work to wait in as i could not.Turns out their van had broken down - couldnt they have phoned me?? They said they would collect the following week. This wasnt acceptable as none of us could get anymore time off work. It then transpires that they were only going to collect the chair..they had no record of the sofa. So many phone calls to them and littlewoods later and i manage to get it sorted so that both would be collected. I was also told that I would get a refund as soon as they were received at the depot. The refund was over £1000 and I told them i needed the items collecting on the saturday as i needed the money to go and try and buy something new before xmas. I was told this wasnt possible but someone wouldbe in touch...yeah okS So Saturday the 8th December came - and at 10am 2 men from Yodel turned up to colelct the suite - fab. What ensued the following week was a nightmare. Constant phone calls from Yodel trying to arrange collection, despite me telling them they already had it and i had a returns slip as proof! I left it until the wednesday 19th as I expected my refund by then - nothing I called Littlewoods who told me i would have to WAIT for it to be inspected before they would issue me with a refund. It HAD been inspected in my home already and the bloke had taken photos! But that didnt matter I explained i needed my money back as we were sitting on the floor, i was told i could get a refund to my card - I had paid my account off in full last year so owed nothing. That didnt seem to matter either. Anyway - On monday 28th I noticed that they had refunded the money back to my littlewoods account. I called, but they were busy so i emailed and asked for my refund. I received an email saying a cheque had been requested on that day. Cant say i was happy about it as i would have preferred it to my card,but to them be told it could take FOURTEEN DAYS?? I didnt query this at the time as i was under the weather and in all honesty did not want the stress, and thought the cheque may arrive today at the latest if it was requested on 28th. I called today as i STILL have not go my refund. I was told by the chap that he could not see how it was refunded and went off to see if he could find out. He said it was requested on the 28th. When i asked if it was sent he said he didnt know. I am furious. I told him i wasnt happy and that we were now in our 4th week of sitting on the floor after enduring it all through the holidays, and could he tell me when i would get it as we need to buy another one now. He told me I had to wait 14 days for a cheque and 10 days for a refund to my card!I have never heard of any refund taking this long so i dont understand.Again i told him this and he went off again - to tell me it was actually sent by cheque on 28th (although im not convinced as i think he might have just been telling me that because i was annoyed) and to allow 14 days. By then i will also have to allow 5 days for it to clear.Is there anything i can do to hurry this up? I just want my refund and to be waiting 4 weeks now after i returned the items is a bit much. We desperately need something proper to sit on now! Thanks
  16. Linzi contacted me and had sorted out a courtesy car wih no charge. I dropped my car in on the way home, so now have one i can use. Once i explained the problem to Linzi she was right on it, and sorted this out very quickly. My car probably wont be fixed until 3rd January at the earliest due to christmas, but i am happy for them to keep it for aslong as necessary as long as it is fixed properly, and i dont have to worry about the cam chain slipping off the tensioner and wrecking the engine!   18. Thanks for the reply Sam. I wasnt aware there was a rep on here. All i want is my car to be sorted properly. The nature of my job means I cannot just get out of work at a moments notice, hence my frustration.
  19. Its a John Cooper Works Cooper S. A BMW one. Its a 30 mile trip to Carcraft from my home and another 40 miles to work. Carcraft is nowhere near any train stations or anything. I have no one i can get a lift from as I dont know anyone here, Ive not been here long, and i cannot take time off work as I work in a hospital and i have clinics booked solid until Christmas. So short of cancelling my patients (which is not going to happen so close to xmas) there is nothing I can do. The only reason I was able to get away this afternoon is because i was on CPD time. If i could drop the car in one evening and have a courtesy car no problem, but they say I have to pay for that.
  20. Hi everyone I bought a car (foolishly) from Carcraft in July. After 4 weeks there was a hell of a rattle and i had to call the RAC who warned me not to drive it and towed it back to Carcraft. i was told it was the cam chain and a cam kit was ordered and it was replaced. I had it serviced 3 weeks ago and was told i needed new brakes and discs....errmm.....?? I enquired as to why and she said i had done a lot of miles and the car would have been "showroom standard" and brakes acceptable when i bought it...ok fine. It has now developed another rattle. had it back and been told its the cam chain adjuster. I told them this was all done 4 months ago to which i was told it could be a faulty part. They want my car for the day...i cannot get anymore time off work now until after christmas, and they will not provide me with a courtesy car. They say they will arrange one through Enterprise...at my own expense!! I am naturally fuming. I have also lost trust itt hat they will actually fix it this time. Its a Mini Cooper S I have to drive from Yorkshire to Wiltshore on Sunday and i cannot get my car in before then. What do i do? any advice?? Thanks in advance.
