  1. I worked out that in unfair charges they owed me is £925, I used the template letter and sent it off. They have wrote back to me this morning saying: Your secured loan agreement was regulated by Consumer Credit Act 1974 (CCA). In 2006 there was an amendment to this legislation which took effect in relation to your loan account from 1st October 2008. In order to comply with this amendment we changed the way your loan account was administered to be able to provide you with the required regulatory information should your account fall into arrears as a result of a failure to make monthly repayments. They have reviewed my account and identified some errors and I am entitled to £135.51 and have included a cheque I am sure it amounts to more than that but am unsure what to do now, should I write to them again? are they just sending me the £135 hoping I'll cash the cheque and it will be over for them

  3. When I sent my complaint, I outlined the reasons I was in financial difficulties and included the paragraph the guy told me further up in this thread do I have to include anywhere I am making a BCOBS complaint?
  4. I have sent the complaint twice now they are ignoring it

I have sent the complaint again I have received a letter today from their solicitors saying I need to pay the unplanned overdraft of £225 and make an arrangement to pay the rest of the overdraft or they are going to start legal proceedings and I am being charged interest on a daily basis I don't know what to do now I can't pay what they are asking
  6. The bank won't respond to my comlaint they have said if I don't pay the overdraft fee and I think they must have put interest on because they want over £200 they are passing it on to their collections department, do you think it is worth sending the complaint again?
  7. For the credit card I am paying £20 a month and they have wrote back saying that if I don't phone them to make arrangements to pay they are going to charge me £200 per month interest. The bank won't answer my complaint and have given me 14 days and they are going to pass it on the collections department

  10. I have sent the letter to them and they have just replied to me now saying they want a budget plan is it right for me to send them one as I thought only a judge could ask for one?
  11. I have the paperwork for this account eventualy but I'm not sure how to work out what is an unfair charge and is there a tempalte letter that I can use to send to claim the unfair charges?
  12. Thank you for your help, sorry for such late reply I don't always have access to internet. If I sent the BCOBS letter will they give me a set limit of time to pay the original overdraft because if they give me 9 months to pay I will never be able to pay it within this time
  13. No I haven't they have sent me another letter asking for a budget plan, I'm not sure how to make the complaint do I just send them a letter?

I wrote to my bank asking them to freeze interest and overdraft charges while I try to pay my overdraft off but they have purposely took their overdraft fee out which has put me over the top of my overdraft so they are charging me £5 per day until I am under my overdraft limit, can they do this?
  15. I have another question can Halifax run the debt up with interest and the put a charge on my house?
