  1. I've 3pts; if I accepted fixed PCN I would've got 6pts...not disqualified. Cheaper than going to court but I choose to fight this as a matter of principle...its so unfair to accept what I didn't do just on basis of cost. 4×4 or MPV marked police vehicle. Red light was flashing on top. I don't know if camera was working or fitted. I sent email to cto requesting for evidence they have that I committed said offence they replied saying the evidence is what police officer observed.
  2. It was only one police officer. I was originally on lane 2 when I noticed police car speeding towards me from rear view mirror and upon reaching very close to my car he indicated red light I thought it was alert for hazard. I reduce speed but carried on he then overtook me nearside and slowed down to be alongside me (nearside lane 1 whilst I was in lane 2); I slowed down and made eye contact and he pointed at the hardshoulder and immediately moved to hardshoulder and stopped there; I then checked mirrors and followed suit and moved to the hardshoulder and stopped some metres infront of his car on the hardshoulder. Despite the confusion created by red light not usual blue light I still manage to stop where he instructed me to. My action didn't put anyone in danger or anything like that. If I'm disqualified I'll lose my job which is Delivery driver and my kids would suffer. I have been told by a solicitor that since this is a case of my word against his; the court tend to believe police officer most of the time.

  4. Offence charged: stopping on motorway Magistrate looked at case (single justice notice I completed online pleading not guilty); and afterwards referred it to full hearing ...reason for trial. No..There's no initial hearing in magistrate court.
  5. Hi All, I'd appreciate with thanks any advice regarding this case: I was stopped on motorway by cop early Nov last yr for reasons I dispute. He said he thought I was looking down on my lap and my car was wandering but steady in the lane. He drove very close to rear of my car indicating red instead of blue light; this was confusing as I didn't know he was coming after me; couple with fact I was not doing anything reckless (not speeding, etc). Noticing that I didn't think he was intending me to stop he drove to hardshoulder as if to overtake me but slowed down side by side to my car; then I realise his intension; so I slowed down made eye contact and he pointed to hardshould and said stopped; then I stopped and switched on the hardshoulder. He then checked everything: mot, docs, tyres, etc.. everything was fine. He then turnaround and said he will report me for remaining stationary on lane 1. I said no I slowed down I didn't stopped. After 2 weeks I received fixed pcn 3pts and £100 which I turned down. After about I received single justice notice I plead not guilty; then the following month a got summon for full hearing initiated by chief constable. I did request for evidence from cto for alleged offence they said no video or camera evidence; that only evidence is statement of said officer. I read said officer with a big surprise especially where claimed he indicated blue light and I only wish there was camera evidence. I'm not financial bouyant to pay solicitor fees and tried to get legal aid but was told no it's minor offence. I did complain to the local police force professional std unit but nothing was done. I'm thinking of writing CPS to reconsider prosecution decision as I doubt if its code or guiding principles were followed in listing this case for trial in crown court; but I'm not sure if this is right step to take....so advice urgently needed please. I think it'll amount to unfair hearing if I end up defending myself again cps solicitors. Will this be full hearing with jury, etc? Solicitors I rang for initial consultation said it's not type of case beyond majistrate court sitting. Any assistance will be appreciated. Thanks.

Hello All, Update: Please note that I received NTO last Saturday 6/5/2016 stating: failure to £70 within 28 days may result in them proceeding with debt recovery action and/or issue court proceedings against me. I wish I could appeal this via email... I really don't want to waste postage cost for this guys www.ce-service.co.uk
  9. Thanks martin2006. Update: I was listed as a creditor, invited for meetings. Liquidator now appointed. I hope I get any money from what I'm owed.
  10. Oil leak might not affect road-worthiness but the amount of oil leak is substantial and says a lot about the condition of said car. Excessively worn out car must not be sold but scrapped. Yes brakes need changing this has been confirmed by peugeot dealer; disc 90% worn, corroded and starting to brake up....exact description by the dealer. Scrap cars are sold less than £500. I know how to count my losses, accept my mistake, learn lessons and move on. Some yrs back I bought car £700 from private seller after 2 weeks overheating, hot liquids and smokes coming out of bonnet, etc, I took it on chin and moved on. However, if it is a car trader I'll sue with all resources I have. It doesn't matter if I paid £1 for it, if the law permit me to reject bought car I'd refused to be cheated. I'm not here for people to tell me what I want to hear, I only need to know what I'm permitted to do by the law in situation like this in which I feel cheated by dodgy seller.
  11. ABS lights on means MOT failure. Peugeot dealer has looked at this car and found more damages...... the leak is substantial, etc... they also provided a video which I've forwarded to seller. Seller has not acknowledged or replied to letters so far
  12. Your points are noted King12345. In fact I don't have problem replacing all brakes; I have already replaced exhaust. I paid to diagnose ABS warning light, given that I bought an old car I know I may need to fix something in future but certainly not so soon and for loads of stuff. I stand to be corrected, I think it'd be balance to state that car dealers must describe exactly the condition of car they are selling, for eg if it's for repair or parts; they must not sell everything, they should be honest enough to scrap some cars instead of putting those out for sale. The scale of repairs this car needs speaks volume of the integrity of said dealer. My question now is? do I have right to reject this car given that it's still less than a month I bought. Under the consumer rights act 2015, it seems said dealer has a responsibility to repair, refund or replace this car. I now would appreciate any comments about my legal right regarding this matter.   13. Car traders should check car he or she intends to put up for sale so that it would be honestly and properly described, otherwise a buyer may feel cheated if he or she needs to fix so many stuff having had car for couple of days
  14. Oddjobbob, I understand that £500 is a banger amount but, shouldn't said seller described faults such abs, etc so that I know I'm buying scrap car. If I add money to be spent on fixing this car to banger £500 then I was cheated by this dodgy seller. Irrespective of amount I paid for this I'll pursue this matter to logical conclusion.
  15. Hi all, I bought a car on 01/04/2016 from car sales trader for £500. After a week ABS fault light came on, exhaust blowing, brakes and 2 front tyres worn. Halford Health check said head gasket leaking oil, all brakes disc and pads needs changing, clutch worn. AA breakdown patrol man confirmed that clutch is worn (high) but not slipping. I paid to get exhaust replaced due to needing a car to work and school runs desperately. I paid a garage to use diagnostic equipment to check ABS warning light on dashboard. I spent these money before I learnt of clutch and oil leak issues. I don't mind spending to get brakes, tyres, and exhaust fixed but, clutch and oil is a no no and too expensive for me for a car which I purchase less than a month ago. Trader not polite on the phone, shouting and hanging up on me because, receipt/invoice stated non refundable, no warranty given or implied. Guys, do you think I have any leg to stand on concerning this matter. Many thanks for any help or suggestions.

  17. Many thanks guys for all response, I really appreciate them. I didn't see any sign post saying don't park where I parked. If per chance any of you know North Manchester Central Hospital, I parked in zone 2, left of Entrance 1. In front of main entrance gate is a parking zone Disabled/Elderly Patients, That is clearly sign posted even on the ground. The left of this zone is zone 2 where I parked (in white marked bay not disabled bay). I still don't understand why I was issued PCN. I stand to be corrected if anybody knows this hospital well
  18. Good morning All, I bought parking ticket for duration of my hospital appointment at General Hospital in Manchester. Upon return to my car I notice PCN stuck on windscreen from Civil Enforcement Ltd for reason 'parked in incorrect zone'. I find this strange because last time I attended said hospital for same medical reason I parked in the same zone, bought a ticket to cover my stay and no problem. Any advice on how to challenge this would be appreciated, thanks in advance guys

  20. thanks martin2006 A liquidator hasn't been appointed yet, I checked with company house, said coy is still active.....it seems they've just decision to go bust or are in the process of liquidating. I just resubmitted invoice to managing director. no response yet. meanwhile the meeting of creditors is scheduled for 7th April 16
  21. Thanks for your tip Martin. From their letter of notice for liquidation, do you think I'm supposed to attend the meeting they said is for creditors? I haven't been invited though.
