  1. Update: Silent (withheld number) calls have started again. Another 3 calls, on the most recent i said hello and the fools started threatening again but they won't speak first. I'm definitely taking these fraudsters to court, gonna start proceeding with this next week when i'm off. I've just spoken to Orange who advised to speak to the police if the nuisance calls continue. They can't block withheld calls but have offered me a free change of number which is going through shortly. So now the only way to communicate with me is in writing which is what I asked for. The judge will be hearing about the measures I have had to go through to stop being harassed.
  2. Update: The text messages have stopped since I almost contacted the police. If you are not happy with the police response ask to speak to a Police superior. The feeling of harassment and silent calls in this menacing way is a criminal offence and not just a domestic business issue. The key is to stress the actual person (not Toothfairy company) on the end of the phone (silent calls / sending texts directly after calling you) is the person you are threatened by and this person is personally causing you distress with these tactics and upsetting your family. Sending a blunt "we're sending someone round" from an uncertified bailiff (calling themselves bailiffs) after 6 silent calls IS an offence full stop. You need to remove Toothfairy from the equation and personally focus on the person who calls you because these are the crooks that are overstepping the line. Its similar to the Data Protection act when an employee breaks the rules they themselves can be held liable. I am now only dealing via email with Toothfairy/aliases and I'm still waiting to hear back from my council's trading standards special "anti-loan-shark" team and OFT etc before I take my next step. Taking these thugs to court may be the way forward. I'm really busy with other things right now but should have some spare time at the end of this month. Will update again soon
  3. Thanks I was worried because the DCA is the same company as the PayDay Loan But as a matter of interest, if a PayDay Loan company was to setup a direct debit on my account would I get any notice online banking before I could cancel it in time?
  4. So I'm finally taking action against a DCA [edit: Paydaylloan same company] who has been threatening me for some time. Anyways last week I told my bank I lost my wallet and ordered a brand new debit card (new card number last 4 digits different, different exp and security code). However I am worried about the DCA setting up a "immediate" direct debit for the whole amount. Years ago my bank used to write to me when a new direct debit was setup but this doesn't happen anymore. I check internet banking on a daily basis and can see all my DD's but I'm worried that a DCA could setup a sort of same day direct debit and empty my account? My solution maybe to transfer all my funds to my savings account, then pull of sneaky transfers on my mobile when I need to use my card for shopping etc but it is a bit of hassle. How soon can a DCA take funds via Direct Debit?
  5. Just found this post after another Threatening text message/private call from these guys yesterday and today. They have been harassing me for months and months under various names and I have had enough. Yesterday I wrote to my local trading standards to complain about Toothfairy not having the correct Cosumer Licence when they claim I took out their loan. My city council has a loan shark department who are investigating. I've told them ToothFairy/MH Bailifs and N are all the same company even though they claim my Loan was with ToothFairy. But my biggest complaint is the way they threaten me and my family. I too have received letters, phone calls but even more aweful is the "countdown text messages". They basically say you have 3 days to contact us or a bailiff will be round..then the next day 2 days etc. Unfortunately for them my smart phone has saved every single message they have sent me (56 various threats). I've just printed them all out back to back and I'm certain a court would interpret this campaign as harassment. That is exactly how I interpret them and my family. I have now told them I will only deal via writing and if they call me again I will Call the Police immediately. And I am so upset about their actions that I promise I will call my local police station to report an harassment complaint against whoever is on the end of the telephone. I'll let everyone know if I have to dial them and also how I get on with Trading Standards and the ICO.
