  1. Hi Andy I sent two the letter from capquest and the default notice , I am sorry I don't know how to send them in the format you requested ??
  2. I have not paid any money or acknowledged this debt, should I send them the statute barred letter

Back in 2011 I went through an awful divorce , I ended up being made bankrupt, i opened an account with nationwide at the time they were the only people other than the PO who would allow you an account, as a bankrupt I was not allowed credit of more than £500 by anyone and not allowed an overdraft of any kind. I was given two cards both blue one that my salary was paid into and a savings account card, at that time I could not afford to live let alone save , anyway I bought something for £49 , at that time bank statements were every three months, somehow the bank had let me use the savings card which had no money and no overdraft facility, they were now charging me around £50 a month for an unorthorised overdraft, I buried my head in the sand as some people do. Last year capquest wrote to me to say they had bought the account , I wrote back asking them to provide me with a copy of the agreement when I opened the account which would have stated no overdraft facility, I used the proper letter giving them the rime period to reply, anyway they wrote back saying that the account had been placed on hold whilst they looked into it. In Sept 2020 clear score informed me the account had been removed from my credit score as 6 yrs had elapsed, today I have had a letter from capquest which says Nationwide were unable to provide a copy of my account but that they had included a copy of the default notice ,from Nationwide this is dated 21st August 2014. I can post copies of the letters if it helps , what should be my next move please , the amount they are after is £409.99 Thanks

I would indeed like some help , sadly yestredays work schedule made it very difficult for me to reply also you seemed to be having problems with your server , firstly soon after the incident I decided to leave and got another job , sadly the company was taken over in 2017 I have not been able to get much help form the new firm, the FOS suggested I contact Frericksons and should I not get a reply within eight weeks to get back to them I did contact Fredricksons and I have the original copy of the correspondence and the name of the person who called my work, I have found the e mail from them saying they were looking into it but I will need to go through my files at the weekend to find the letter they sent after that , I will be sending a SAR to Nationwide and Fredricksons today , I will keep you updated , it did not affect my future employment luckily , please feel free to comment on anything I may have missed out. ( note I have tried twice to send this today 10/01/2019 and I get a message that the server is down) I hope this reaches you
  6. If I did decide to challenge nationwide how would I go about it as when I contacted them they said they could not discuss it as the had sold the dept to Arrow

I do not work for that employer any more the charges were applied each month for an unauthorized overdraft , I complained to Fredrickson's and the FCA I have the name of the caller from Frederickson's and they apologised saying he shouldn't have rung me at work they got my employer details from nationwide , have I missed anything out ??

Thank you for your reply, after reading your comments and my post from all those years ago I realise a had indeed forgotten some of the original details, it was a bad time in my life after my wife walked out and left me with the children, I did take everyone's advise after some time I received a letter form freddeis to say that they were sorry for contacting my employer and they were not taking any further action and the account with them was closed it would appear now that the Nationwide (who I still bank with and have my home insurance with) have sold the debt to Arrow Global who have today put an entry onto my credit file , I thought that since freddricksons had closed it it was dealt with how wrong I was .

Ok the evidence I have that they contacted my employer and disclosed information was being called into my managers office and the call played back to me , back in 2013 bank charges were quite crippling apparently I had bought a pay as you go phone I had a contract so didn't need a payg , could you tell me what a SAR is please

In 2012 I had a basic account with the nationwide as I had in the past been bankrupt, this allowed me to pay my DD,s and withdraw money but under no circumstances have an overdraft , later in the year they sent my a new card for a 2nd account , I did not ask for it so I put it in a draw and forgot about it , I then had a letter to say there had been a charge of £49.99 put against the new card and that i was overdrawn , I pointed out that this was not possible as I have no overdraft facility, they said they would look into it , after months they came back and said the debt had risen to £400 pounds as they were charging me £50 a month for being over drawn , in the end the debt was sold to Fredricksons who hassled me night and day and in the end called my employer without my knowledge disclosed personal info to them, as I was in charge of a budget I was demoted and saw my salary reduced , I reported Fredricksons to the FOS who agreed to look into it for me, after some months Fredricksons contacted me to say they would not be pursuing the matter any further (2014) last week I received a letter from the Nationwide saying they had sold the dept to another company , any advice would be appreciated
  12. about 18 months ago I received a letter from 3 mobile saying that I had ended a mobile phone contract early about 7 or 8 yrs ago and that i owed them £391.05 I have been a loyal customer of 3 for around 13yrs, I still am a customer with them , and have renewed my contract with them on numerous occasions without problem, i contacted 3 and explained that I have never terminated a contract early and the dates that they are talking about was a time that I changed my number as I was receiving malicious calls, so they must be confused it was not a new contract it was a number change, after getting nowhere with the call centre I contacted their head office, before I had a reply Lowell got involved , about a month later Lowell sent me a letter saying that they had not realised I was in dispute with 3 mobile say they were withdrawing any action. This week Lowell have started again saying they are now the new owners of the dept and intend to pursue it, any advise please

Hi All A couple of months ago I had two letters from 3 mobile saying I had defaulted on a phone contract (not true) I have been with 3 since 2003 and still am I have upgraded every time and remained a loyal customer, I noticed that the letters were not in the normal format from 3 mobile and the envelopes were different , I then saw printed down one side in small print lowells name and the number of the printer. Anyway it threatened to pass the debt onto Lowell and sure enough a few days later a had a letter from them, it said that the alleged debt was from 2005 and that there had been a delay in chasing it (almost 10 yrs) as I must have moved house, I moved house in 2012 so they had 7 yrs to contact me, so I sent them a statute barred letter last week by recorded post, today I recieved this reply. Thank you for your letter advising that you believe the above account is statute barred . we confirm that your account remains legally enforceable by us and is not statute barred, this is because your debt did no t become fully due and payable until three mobile issued a default notice , which you did not comply with, according to the information provided by three mobile the default date was 22nd March 2013 (I moved house in Jul 2012) therefore we consider that the debt in enforceable for 6 yrs after this date. I contacted three who cannot confirm or deny the debt but say as Lowell are dealing with it they can,t discuss it with me, Lowell have said that they have placed my account on hold while they request copies of statements from three, but should I not agree with anything they have said to give them a call ( not going to happen) HELP it,s driving me mad . Thanks I will do that, to clarify for bank fodder In 2005 I had a mobile with 3 that I used for my own business, I gave up my business so paid to have the number changed so as not to get work related calls, but carried on with the same contract but on a different number. since that time I have had numerous contracts rolling on one after another, I have never had a break in service from 3 mobile or ended a contract early in the 11 yrs I have been with them . I left my previous address 2 yrs ago so 3 mobile have had plenty of time to to contact me regarding this matter, the fact that I remained with three when I moved to my current address would also give them ample opportunity to contact me regarding this they are asking for £28.88 arrears and £205.96 early termination fee, I have heard nothing form them for 9 yrs and 3 months surely this can,t be correct.

Hi I have received a letter from what is supposed to look look like 3 mobile, I say supposed as printed down the side is low106 and the printer it came out of, also it has a Lowell ref number on it ?? it says that I defaulted on a phone contract Oct 2005 but they have not been able to trace me as I may have moved, I moved from my last address two years ago, they had seven years to speak to me about it, there was a phone number for the mobile and on checking it was the one I used when I worked for myself, when I went into employment with someone else I paid £10 to have the number changed so as not to keep receiving work calls, but still under the same contract, it was never an early termination of it, I have been with 3 Mobile for 11yrs and have always upgraded and continued to have mobile contracts with them after over nine years with no contact this must be statute barred at the very least, any advise would be great .
  17. about a year ago, nationwide upgraded my account (they did it to anyone with a cash card acc) I received two cards one for the account I have my salary paid into and one for a new savers account that I hadnt requested, both blue in colour and almost identical, I had no overdraft facility, a few days later I needed to make an emergency purchase of £49.99 which I did by card no probs but I used the wrong card by mistake the savers one , I don,t get paper bills so about four months later nationwide write to me and they have charged me £50 a month for an overdraft which I did not ask for, the transaction should have never gone through I Would have then realized I had used the wrong card, so I challenge it , next thing you know I got a letter last Sat 18/10/14 from nationwide saying they have handed it to fredricksons , the calls started first thing Monday followed by the texts, and today the call to my work, just had a meeting with my boss he is not happy at all and has warned my he dosn,t want it happening again

Fredrickson international started hassling me about a week ago via text , calls ect, over a £400 dept to nationwide, today they phoned my employer, causing me no end of problems, I have a meeting with my line manager later today, I have written to them, saying I will only deal with them in writing, I asked for a means test form, as I am a single dad living in a rented furnished property , after my wife kicked us out, please can anyone advies me what to do, before I lose my job. Good morning two months ago I got an e mail from scotcall saying that I owed 3 mobile £375 , I have been a customer of 3 for about ten yrs and to my knowledge I owe them nothing , I sent off my CCA request and my postal order and have not had a reply for six weeks , today I have received an e mail from scotcall Saying "in response to your request for a copy of the singed credit agreement , we have been advised by 3 they they are not available" how would I like to proceed, as I cant find a template letter in the library could someone perhaps give me a hand to word a reply, thnk,s
  21. the last date of any payment was 1995/96 so should I now go ahead and send them the S/B letter ?
