    Fredricson still phoning even though I have sent them a letter telling them to stop. I have sent the Solicitor a letter, since then Fredricson has sent another letter demanding full payment or court action.

    Hi. I have an MBNA card that I have defaulted on, I have sent CCA note and have had several collection agency’s give it back to MBNA as I have subsequently sent them the default letter. I sent the default letter to Fredricson who have said they have sent this back to MBNA. I have now got a Solicitors letter saying that (If you dispute liability for this debt please state your reasons in writing and supply us with documents in support of your defence to any claim. Before the account is referred to us to litigate you still have an opportunity to contact Fredrickson with your payment proposals. In order to avoid further action you should telephone them immediately). Your advise on what I should do next would be very welcome.
  6. Just send them the account in dispute letter and they will have to leave you alone. Then it will go to the nect collection agency and so on. It seems to do the rounds every so often. Its their fault for not keeping your paperwork. the reason MBNA have not replyed to the CCA is because they dont have any info on you any more.

    Hi again. I now have Fredrickson trying to collect. What letter do I send them as I have already put this in dispute with allied. Do I start again with a cca or another letter of dispute. If a dispute letter advising them of allied not being able to collect what do i write regards:)
  8. I have a claim in against Norton and they used the same reason for declining. Its been sitting with the Ombudsman at the moment waiting their decision.

    I want to pay this debt but on my terms. Do you think if i contacted MBNA and suggested a payment agreement they would go for it. or will they sell it anyway?

    Hi, just thought i would mention. I got reply after putting the account in dispute and it has now gone back to MBNA (it worked lol) Thanks for all your help.

    Hi again. I had sent the CCA off to Allied, and their reply letter today came. Thank you for your recent letter which I have attatched for ref. As we are only acting on behalf of MBNA in respect of recovering the outstanding debt on this account, we are unable to fulfil your request. Such requests need to be addressed to MBNA directly. They have sent my £ back With a nice note at the bottom May I also take this opportunity to remind you that the full outstanding balance on this account is due and owing. You will need to contact our offices upon receipt of this letter on telephone No ************** to prevent recovery action being taken, they didnt sign the letter. Now the SAR has been sent to MBNA what do I do with respect of this letter.
  13. Hi all, Just looking for some advise. I had a Halifax CC. In 2005 I hit some trouble and Halifax agreed to accept £1 a month. They also agreed to cancel the interest. In 2008 they put the card into default (I can understand that). My wife deals with all my finances mainly because these people irritate the hell out of me. Anyhow when it went into default my wife told me that they are still adding insurance as well as interest on the account. I contacted them and got them to cancel the insurance, and came to an agreement to pay £50 a month and the interest stopped. The thing is the card went from £6000 when I first told them i was in trouble to £10000 when i found out they had added the insurance & interest ( I didnt even know until then that i had insurance)

    Just checked credit expert and they defaulted 30/12/10. no letter telling me this though. Allied want the full outstanding balance. I have posted a CCA of to Allied to see if they own the debt. i cant understand how it is legal for a company to sell off your debt to another company. I know it is legal but it doesn't seem ethical. What really cheeses me off is that they see your expenditure form but still demand more and when you cant keep up the payments they wonder why. I have a lot of debt all cards and have kept most of my back (just) for the past 5 years. but things are getting harder now and im fed up with it. When it all come to light what i owed i contacted the cccs and they suggested i go bankrupt, but i didnt want to go down that road, i wanted to pay it all back. But these people dont make it easy for you.

    No they haven't, but Allied have contacted me demanding full payment. MBNA haven't sent me anything at all.

  20. Thanks for the info. I only found this site a couple of days ago, and the info is great. I dont feel threatened anymore, now i realize i do have rights. The thing that really anoys me is that I know I have an obligation to pay back my debt, and i am willing to. But i am not going to put my family in hardship. They will get only what i can afford. I sometimes think that if their attitude changed and they became more helpful they would get more from people in the long run. I have several cards on £1 a month and have for years but they never hastle me, because they know my income. I have been trying to pay them off one at a time but it gets tough sometimes. Im just fed up with their aggressive stance, talking to me as if im a peice of c**p. It just not right. I was thinking of recording one of the calls and making an official complaint.
  21. I was just wondering, because they state that all their calls are recorded, I would have thought it wouldn't matter if I recorded the call. It would mean that the call is duplicated only. Surly they would have to produce the call if requested, and if they had edited it or said they have lost it i could produce a copy. Just curious that's all.
  22. Hi I was just wondering, where would I stand recording a phone conversation with one of this lot. They are very aggressive and keep demanding full payment. Not only that they keep threatening bankruptcy and debt visits. I know they are only threats, but they will not even discuss a payment plan. And would i be able to use this in a law court.

    Hi thanks I take it this is the CCA request letter This letter is a formal request pursuant to s.77/78 of the Consumer Credit Act 1974. I require you to provide me with a true copy of the credit agreement relating to the above account, together with any other documentation the Act requires you to provide. I expect you to comply fully and properly with this request, within the statutory time limit. You are reminded that should you fail to comply with my request, the provisions of s.77 will apply. If it is your view that you are not the creditor, s.175 of the CCA 1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. In the case of an absolute assignment, you are a creditor as defined by s.189. If you contend that you purchased the rights but not the duties of any agreement, you are reminded that s.189 of the Act is clear that an assignment is of both rights and duties. Your attention is drawn to ss.5(2), 3(b),6 and 7 of the Regulations 2008 (CPUTR). I enclose a postal order in the sum of £1.00, which is the statutory fee. Note that these funds are not to be used for any other purpose. If you are unable to comply fully and properly with this request, you should confirm this in writing at the earliest opportunity, and certainly within the statutory time limit for compliance, and return the fee.
