I took out a loan with Provient last year and was paying it fine until I moved, I notified provident at the time and my mum told the doorstep collector my address on 2 separate occasions, The Provident area manager came to my new address in October of last year to confirm i lived there and told me a new collection agent would be round with a week, I didnt hear anything for a couple of weeks so phoned them 4 times over the course of a month telling them my new address and that i wanted to clear the balance but on one ever came, one thing after another came up and I forgot about the debt until yesterday when i got a letter from Moorcroft Debt recovery saying "I am disappointed to note that desipte our letters and attempted personal calls by our local representative no satisfactory agreement has been reached" I've never had any correspondance from them or anyone call at the house, so the content of the letter is very rude. My query is although I dont dispute that I owe the money has Provident broken any rules/laws by ignoring my repeated requests for someone to collect the money and by just passing it to the debt collection agency?

Hi dont know if anyone can help, my other half has received a letter from Red asking to pay an outstanding debt to which he has no idea whats its for, he has phoned them today asking for more info but was told by a rude man the he should know what the debt it for and that he had to pay the balance to find out who its for. Obviously hes not going to do this, I thought there use to be a letter on here that could be sent saying that dispute the charges and wanted further info but I can't find it. Any advise would be helpful.
  3. Hi all sorry if its in the wrong place. Basically i took out a loan with Welcome back in Feb since then ive lost a couple of jobs and only made between 2-4 payments, the other day a rather stroppy woman came round from welcome to tell me that I needed to pay £170 (monthly payment) then and there other wise a "fraud alert" would be placed either against my mums house (were i was living at the time i took out the loan) or my landlords house (im now renting) has anyone heard of a "fraud alert" also she told me she could re do my loan cutting the interest so id only have to pay back £78 a month, left it at that then a couple of days later a get a call from one of her collegues saying that if I pay them £85 then and there they'd be able to get my monthly payments down to £78 explained that the 1 woman i spoke to had told me this had already been done, when i questioned her what the £85 was for she got all flustered and said she'd phone me back tomorrow (that was last week) Any advise on should i pay the £85 and if a fraud alert is genuine would be great thanks guys
  4. just spoken to the evil witch and apparently the fraud thing is because you have to pay 6 months of a loan before you circumstances change, is she telling the truth with this? i've never heard of it before
  5. yeah but if i dont phone her today, shes gonna turn up at my house and charge me £25 for the privilidge
  6. she was saying that because i took out the loan and then lost by job and was unable to make payments its fraud because i took the loan out under false pretences (because i must have known i was going to be sacked) she is a really horrible woman!!

Took out a loan with them back in Feb at the time i was in a good job with a steady income, ive since lost that job and have taken a significant pay cut, i have tried explaining to them whats going on my they dont seen interesting in my situation, they want me to pay £80 a week even though ive explained i can afford it the woman is really rude and is threatening to report em for fraud because i apparently took the loan out under false pretenses. Can someone please help me with this they wont listen the womans rude and they wont help me in any way shape or form, ive got to phone them later as ive missed payments so if anyone can give me any advise it would be much appreciated, especially if anyone knows if they can instruct bailiffs without going through a court first and also if they have to except any reasonable payment plan i offer them
  8. Hi all I won a claim back in July 06 for £2000 of charges, since then I've racked up some more, as i excepted there offer in full and final settlement can i start up a new claim for the charges accrued since they last paid out?

  14. no they ignored my SAR and subsiquent no compliance letter (they banked the cheque though) think i need to take them to court but not totally sure
  15. I sent my S.A.R - (Subject Access Request) back on 4th August which they received and they banked the cheque, 40 days came and went so I sent them the letter giving them 7 days to give me my info but surprise surprise it was ignored. Has anyone else had trouble getting their info from them?

Hi Just wondering if any one else had had the same thing as me, i've recently started 2 moneyclaims again Marbles and Barclaycard but it seems that instead of banking the cheques back in July when I sent my SAR off they are banking them now when they receive their claims from the court. Has anyone else had this problem and are they aloud to bank the cheques so long after the SAR? Any advise would be helpful. Thanks

  19. thanks guys that was what I was getting confused with (NCO now own the debt by the way)so as of next friday (30 days) they cant chase me for the debt anymore is that right? this is what I was trying to tell the bloke. I've also written a formal complaint to them about his as he was very rude and unprofessional, its a good job im quite a tough person otherwise id have been in tears he was very intimadating!!
  20. NCO are acting on behalf of Barclaycard, and rats got confused with it all. Oh well on the upside ill be filing a moneyclaim next week for Barclaycard, so alls not lost I spose. Thanks

Hi guys I need some help think I may have srewed up, I sent this letter to NCO on the 8th August to which I've had no responce to I need to know if this was the right letter to send because when they phoned chasing me for the money yesterday I explained that I wouldnt deal with them until id had a responce to me letter and when I tried explaining the case law that supported my letter the guy on the phone said "your having a laugh arent you" and "you dont know what your talking about" after him getting very arsey with me I once again stated that until I got a responce to the letter I wouldnt speak to him or NCO any more to which he said "we'll see what happens when a bailiff turns up at your house" and he hung up on me. Heres the letter With reference to the above agreement, and a call made to your office today I must request that you supply me with the following: 1. A true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 cheque in payment of the statutory fee. 2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists. 3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974. Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities. I look forward to hearing from you. What I need to know is was I right in sending this letter and demanding a reply or was the rude man at NCO right and I didnt have a clue about what I was talking about. I really need help with this as i dont want bailiffs turning up to my mums house
