  1. still dont quite understand how I can claim for interest, penalty charges, late payment etc from bc if they told me in the cca at the beginning what their charges were? Or am I missing the point!!
  2. How would they be unlawfull. It was a normal BC debt under a CCA. I know I owe it, but after reading notes on the forum see people have received charges back. I cant quite get my head around getting charges back. Do you mean late payment charges, over limit charges, but not interest? Thanks for helping.

  4. sorry hope that didnt shound too rude! I have noticed people have had money back from the likes of Barclaycard! Does it go back to the beginning or the date of the default? Do they usually refund when challenged. There is so much info on this site. Ive been reading for hours, not sure its done my brain any good! Battered:lol:

  6. thanks very much for the answer I do not have the statements, unfortunately. What is a SAR? IF I tell lowells im asking for these will they hold off on the SD do you think. Time is a problem
  7. that was a nice reply and very honest. ITs just having the balls to start doing it. Im looking at all sorts, sometimes there are too many options and advise you get confused to say the least and I suppose every ones case is different.

I was in a similar position, where Lowells the DCA threatened me with a Statutory Demand, I rang to arrange some sort of amicable payment, the debt was smaller than yours, and they said at first they wanted 50% of the outstanding balance before they would consider accepting a dmonthly payment. They then went to 25%. Im not sure what to do myself about this, whether just to pay to get them off my back and not lose my home etc. Anyone any ideas?
  9. Youre reply to the last paragraph. I have unsecured loans and sim[;y did not pay after marriage breakdown and lack of funds hoping they would take me to court, so I could pay something off as agreed by the court, but they have just sent me a Statutory Demand, and Ive not been to court. in fact the court has not been involved with either the original debt or the DCA who bought the debt. Any advice?
  10. After having some useful advice, I have another query. After having received a SD by normal post, and on reading some other threads, can I ask Hamptons at this late stage for a CCA and do you think they would hold off the SD till they sent me what im entitled to!?
  11. Its good they gave you the charges back. But what were they for? just general charges of excessive ones. I might try that with Barclaycard, but mine was just a normal cc account, im not really sure what charges other than interest they have put on? Can you just advise me what is a SAR, im not sure. Ive worked out most of the other abbreviations!
  12. thanks for the info and your time. The SD has already arrived, last saturday. I contacted them to arrange some sort of payment, but I have started by own thread, eventually, but now not sure how to find my own thread! being a bit dipsy!!
  13. ive read on the forum here, but cant remember where now! that a DCA was chasing a debtor and subsequently he wrote to BC asking for a statement and asked for charges to be refunded. What they could be Im not sure. He got the knock back at first, but a second letter to them and he received £920 back. and they said they would let the company that bought the debt that it had now been reduced. I was just wondering if I could do the same. DOes anyone know of this please.

Just need to know why an outstanding barclaycard debt which was sold to lowells, quite soon, bc didnt take me to court, so I thought lowells would. they havent , just loads of letters, now been landed with a SD by post. I have rang them under duress, thought I would do the right thing and arrange a payment plan with them, as I do owe the money. Very pleasant!! wanted first 50% of balance upfront for them to consider a monthly payment plan. but in September last year, they offered the usual reduction and also offerring me £60 per month. Thought I would take them up on that, but they said it had gone too far. I only received SD on saturday gone. Any advice?
  15. did you do your own DMP, Im in a pickle and not sure what to do, IVe got lowells chasing me with a SD. Not sure whether to let them get on with it, or fight it, maybe a dmp might be the answer. how are you finding it?

  17. after a sd from hamptons and if you make an arrangement and pay off some of the debt as they ask and you have it in writing from them of the agreement, how likely are they to stick to it and not follow for bankruptcy, does anyone know?

  19. how can you have a defence, if you actually owe the money? Im in a similar situation but cant think what defence I could have to have it set asid? any ideas or am I getting this wrong?
  20. should I ignor lowells as well with a SD, they say they have power over me, because I own my own home. Three months ago, they offered for me to pay £120 pmonth, now ~Ive rang them cos of the SD, they say they cant accept that now, as its gone legal, are they serious. They are looking for 25% off the debt for them to consider accepting a £150 p monthNot sure what to do now, any ideas?
  21. I am in a similar situation. Received a SD from Hamptons, contacted them to try and sort out, I had not previousy contacted them, the letter said they will try and help me, but were insisting on a big payment,k obviously didnt have it, but they have not been too helpful, saying it had gone too far and if I dont respond by the 9th April they will petition for bankruptcy. Told them there was no equity anyway, and then if they did that I would lose my job, have nowhere to live and they wouldnt hardly get anything! But he said it was their decision. Any comments or help!!
  22. Just a query if you could help please. I do owe this money to Barclaycard but its been ages now, but not six years. I put up with all the correspondence etc. I received a letter from Barclaycrd saying they had sold the debt, is this not enough. I cant see how I can set it aside as I owe the money. I am tempted just to ring them to agree a repayment, althought theres not much spare to give them so it will take ages. Can they alter the amount at any time if you have made an arrangement?
  23. Hello. I am just writing to let you know that I also had some buy to let mortgages with MEX. They were being looked after through an agent, who collected the tenants rent, but did not forward it to me to be able to pay the mortgages. They were mostly then 3 months in arrears at which time I started to get the rent sent direct to me and managed the properties myself. I arranged with MEX, after having told them what had happened, to pay the contractural monthly payment plus an additional amount to clear the arrears. They accepted this. I continued to reduce the arrears and pay the current payment for over a full year. All going nicely at least I thought. Out of the blue some numpty at MEX decides to play heavy. He wanted more money off the arrears, which I could afford to pay and unless I gave him a full income and expenditure for him to consider whether i could or not, he would apply the Law of PRoperty Act on all my BTLs. He did do this, they went to the receivers and they made a complete hash of things. However most of the properties are now in credit, arrears cleared, because another year has gone by with payments from the tenants. Can I have them back? no he said. The credit of the rent will be deducted off the oustanding mortgage.! They charged me the ususal £1000 added to the mortgage debt, other expenses and also the percentage off the rent for doing a rubbish job. So the outstanding mortage just got worse. Whereas if they had left it alone, they would have still got their money, the arrears would have been cleared, and the mortgage debt wouldnt be as big.
  24. thanks for that. Still a bit worried, I suppose they just hope people respond and pay something, is it just a matter of staying power!!
