  4. I know someone who made a payment to a bailiff, than called his bank saying he had lost the card, later on told the bank he doesnt recognise the payment and maybe someone used it,the bank refunded the payment.the bailiff reported it to police, they investigated and cps agreed to take it further as the name on the card and the warrant was the same as the address.after a year the guy got sentenced to 2 weeks prison and 175£ fine.

  6. Hi all, what are the powers of a bailiff in situation like this. My neighbour got clamped yesterday by a jbw bailiff , she acknowledged that she knew of the matter and had appealed to the council, i spoke to the bailiff and she called the council who said they havent had any coorospondece, after failed attempts to come to any matual understanding the bailiff called a tow truck and my neighbour sat in the car .the police came and said they have no powers to remove her of the vehicle and told they bailiff not to pull her out etc. .. The bailiff said he can use resonable force as he has seized the goods but the police were not to sure and left... Am i right in saying once your car gets clamped sit in it and bailiff or police has no powers to get you out?
  7. Update; The Mrs got a phone call at 930am to bring the receipt book and stuff to the office, while there she was given a letter saying she is suspended until office completes their own investigation.Today at 1pm she got a call from one of the Directors and he apoligised for the action of the line manager and asked her to come and get the receipt book and stuff back but my mrs declined to go back to work as she is too scared something like this might happen again and she would be asked to leave. The director promised to train all the field agent and asked the Mrs to come to Head office on friday to meet him. Thanks all for your help and guidance as we quotes most of what you guys suggested in the letter we wrote to the company.

  10. SHe has worked there for about 8 weeks now,she is part time and her job is to call the clients and arrange time and collect money of them either before they go to work or afters. Well our priorities are that if we pay this £480 then we have chances of missing on the mortgage....If my wife is not legally liable to return the money than we are not gona do it and take the matter to court if she looses her job and thats why before we go court and stuff i would like to know what are our grounds on not returning the money? cheers
  11. Hello All, My wife works for a Scottish financial company and she role is to go every week in our local postcodes and collect loan installments from people and than banking it. The company specializes in this scheme where instead of direct debit people just pay the collection agent in person every week. A certain fella who was about to move address called the office on Monday and wanted to pay the whole of his balance £570 and was told to give it to my wife on her collections rounds on friday. My wife went and was greeted by the guy and offered tea and give her the money ,the Mrs took the money to bank and was surprised to find out £480 was fake notes, the bank seized the money and she called the police and got a CAD number and informed the office of the incident who were really supportive and the manager asked her to go home and not to worry as these thing happen BUT at 430 she got an email from the line manager saying she needs to pay the balance of £480 in bank by 9am Monday or she will lose her job, my wife called him and informed him that she hast got that kind of money spare to bank on someone else behalf, the manager replied that she has given a receipt and she should have been careful when accepting the money and it is her mistake that she took the money and the company cant be responsible for this. My wife informed the manager that she is well shaken and ashamed of this incident but no training was provided regarding identifying fake notes nor was any pens provided to identify these notes so she cant he held liable to which the manager replied ,''you have time until 9 Monday, think about it and bank the money else please bring the company phone, receipt book and fuel card to the office as your services are no longer required''. The company is FSA registered and very well reputed. First of all the we havent got the £480 to spare but we can pay it by credit card if we are legally responsible for this but at the same time we dont want my wife to lose her job. can anyone help please.

  16. The Mrs works as an assistant for a private landlord, the landlord was having problems with a certain tenant for a while months on the ground that the tenant knew the law and the landlord wasn't in favor of this, anyways she gived a notice to vacate and the landlord agreed so on the 29 june she moved out. The landlord himself was in USA so the Mrs went to carry out the inventory after the tenant moved out.The landlord had already informed my mrs that there are some scratches on the wall and class that as wear and tear ,all went well and she returned the deposit back . The landlord came back today and went to the property and now angry at my mrs as the tenant had nails[for pictures]on the wall and left the property dirty. My mrs told him that the tenant lived here for 2 years and we need to paint it anyways to give it a fresh look but the landlord said no and told my mrs she he will be deduction £350 from her wages or my Mrs needs to call the tenant and get £350 back from her,the tenant has already cashed the chq.
  17. seems like you have had quiet a bad experience with a micky moss bailiff.how can a bailiff levy on a vehicle that doesnt belong to a debtor,he can only levy on the vehicle if the DVLA comes positive in the debtor name and the dvla report doesn't come overnight,a bailiff might commit a mistake ..... if he does he can loose his license..or making the company lose the contract cause of his actions..no matter how small or big the debt is surely the council is a phone call away and there to help.
  18. if the debtor doesn't live at the address anymore Marstons cant remove anything.all you do is call/email marston and send them a copy of the new tenancy and explain to them just that the debtor has moved, they might just visit after that to confirm the identity of the new tenants and the case will go into trace.so nothing to worry about just call them and send them the info. secondly this is a public forum and surely they would be a body managing it,you just put your mom in big trouble by writing that she give the police/court wrong address for her ex boyfriend knowingly, mate this is perverting course of justice.
  19. the fees of bailiff are set by the council they are collecting for and are authorized by the court,by not pay fines in first place then shouting in the end when a car gets clamped.even from recieving the first letter the car is not clamped the second day so why not call the bailiff and sort the debt rather than wait for the clamp.
  20. just chill buddy !!! a bailiff cant come to yours recarding the tickets issue at Euro Car Parks NOR CAN THEY take you to court, all they can do is just send you letters,if you wana pay then go for it but nothing to worry about as it would go to bailiff etc.
  21. depends on which bailiff company you would be dealing with. Ok you challenged the tickets and they all came back, now dont wait till the bailiff knocks on your door, call the bailiff dealing with your tickets and inform them as of what happened and explain your financial situation and sign an arrangement or a walking possession[depends on what you can afford]. Now days bailiff goes through trainings and their major task is to collect unpaid monies in friendly and professional way.Be truthful as what you tell the bailiff as now days everything is computerized and he would find out if you lied about anything which will terminate the arrangement and thus you would have to pay everything in full then.
