  1. thanks for the reply bud, I know it's late MBNA stated over the phone that they can't verify if the cheque was cashed or not, but the paper trail states it was sent - at the very least they received it and never cashed it. Would it be a fair ploy to refuse payment until this is all sorted out - i've got a lot on my plate financially and personally at the mo with mum dying on tuesday. what's SRA stand for?

  3. Hi guys, As from my previous threads, the Mrs. and I (should have done this myself, I know that now) signed up with a lawyers firm that would reclaim the miss sold ppi and credit card charges. At the time I thought it was only myself that had passed on the info on the credit cards to reclaim. two of the PPI refunds were accepted pretty quickly along with refunds on all of my credit card accounts at the start of this year. Recently we thought that we should just do the same with Mrs. Hunka's credit cards too as one was closed last year and we thought that it might be fruitful. we send all the various SAR's off and we discovered that there were refunds issued on the two credit cards my partner has!!! We received absolutely no info from the lawyers or the companies regarding this. The closed account sent a cheque to the lawyers LAST YEAR!! (all detailed very well in the SAR) but the lawyers have stated that they have received nothing in the way of this info. Now all this came out two weeks ago and they haven't got back to us regarding this. BUT today (my mother died two days ago) the same lawyers left a message as I haven't paid them the £100 per month repayment plan for the refunds on my charges!!!! They've basically been sent a cheque for over £500 and haven't given us our 66%!!!! I've asked several times for them to pass on to me the details for the final loan with outstanding PPI - which was for over £22k paid back over 3 and a half years so I could maybe chase them up too, but each time they said they'd forward me the info, but haven't Any info on what I should do next, I think I'll be telling them they aren't getting a penny until they sort this mess out and pull the finger out and deal with it. Can I do that? What are my options for a formal complaint? Thanks guys
  4. yeah mate, it looks pretty interesting as at the end of the day, we'll be paying all of the money back. Going the CCA route and charges reclaiming route to get as much of the balances down and then we'll go from there - should be able to get one paid off in a couple of months and we'll go from there.
  5. it's for 3800 - I have tried to set up a payment plan with them, but they have refused out right stating they want proof of income first, I do not want them to know any contact details of my work place. I do want to pay my debts - I can afford at the moment £80 and hopefully can increase it as I get extra shifts from the agency I work with over and above my full time job....

  7. Thanks for the reply bluedog I have about £300 spare per month after my monthly expenses - the missus would probably be slightly lower than that. That's good to hear about the house being safe - what kind of IP fee's are wee looking at?

Hi guys, my partner and myself have been having some problems with our debts recently and we have some significant arrears - we've just found out we are pregnant too, so obviously I don't want us to be under much more stress. We started thinking about trying for a trust deed, but would like some advice first - we own our own home, now, there isn't much in the way of equity - maybe 2-3k at a push, but with today's market, the house wouldn't sell for valued price. I know in some instances you need to release equity on your home, will wee need to do that? what if we can't sell our house or remortgage to include the equity? what are the chances of getting a mortgage after the trust deed is completed? - we would like to move from our flat to a house at some point what kind of monthly amount would we be looking to pay on roughly £22k of debt between both of us? this site has been great to us so far, thanks for the help guys and gals
  9. hi guys, I posted a thread a while ago relating to the enforceability of a Burton's store card I've had since 2000 - it appeared that the CCA was enforceable, so I went about trying to arrange some kind of payment scheme with them, all were refused stating that they wanted proof of income prior to starting any kind of plan - something that I simply wasn't willing to do. So I decided to SAR them and finally got some info in - interestingly, the statements are sparse at best, but they included a transaction description that detailed everything back to 2005. But they also included all notes on the account which went back to 2000!! Anyway, there isn't much in the way of reclaimable charges on there, but the noted on the account did state that it went back and forth to collections - which most likely means more charges. How is it that they can keep the CCA and the notes to file, but delete the statements? So I was looking at the notes on the account and as of 17/1/11 it states that it was financially written off, now I'm not so lucky for that to mean that they have written off the debt, but does that mean they will soon pass it on to a DCA? After going through my finances, I can probably afford £80 per month - do you guys suggest that I just begin paying that? there are 13 late payment charges which after including 8% interest and the contractual rate will come to £161!!! Thanks for all your help
  10. sorry about the bump. Does it matter that I didn't receive terms and conditions from back then? I only got current terms and conditions - also the fact that there was no credit limit on the form? What get me is that it states that it's an application to open a burton account, but it's still a credit agreement? I've also started the process of reclaiming the charges against the account - I've sent a SAR about 2 weeks ago, but there's nothing yet in the way of a reply. So here's hoping. I've yet to send payment, I will do so in the form of a check tonight - I want to make this as difficult as possible for them, the amount they've had out of me in charges and interest would have payed of the balance about 4 times over.
  11. by all accounts it's still owned by RBS, but AIS is collecting on their behalf.
  12. thanks mate, since it's £600 from reclaimed charges that'll be added to my balance will I just reword it to reflect this? something like: "We can confirm that we are unable to offer to pay the money which we owe in full. However, I can raise £750 and I want to offer this as an ex−gratia payment in full and final settlement of the account this includes £150 payment from myself and £600 being credited from RBS themselves for unfair charges. This offer is made on the clear understanding that, if accepted, neither you nor any associate company will take any other action to enforce or pursue this debt in any way whatsoever and that we will be released for any liability." Does that sound alright?
  13. I know, in retrospect, I should have done it myself. There have been no additional charges added by AIC, that much I'm pretty sure of. What kind of wording should I use?
