  1. Well it took a long time but I did get my Holiday pay for my outstanding years that I was owed. The only down side was that my employment was terminated, even then my employers insisted that I was not entitled to my Holiday, but by the help of CAB, union and my solicitor they realised that they had no option as a date had been set for a Tribunal. When my employment was terminated the union official told them that I had been dismissed unfairly and that they hadn't given me the opportunity to apply for a trainee job that they only gave to someone 2 weeks prior to my termination. Many thanks for the help that I have been given on this forum. The fight goes on.

  4. Hi H B Thanks for your warm welcome. I have been reading up about accrued holiday and have read JonCris's post. When I tackled my employers wages department about Stringer vs HMRC they told me that they had not heard about it. To be honest with you I could do with my holiday pay now, no thanks to the ESA, but I don't want to get started on them Grrrrr !!!! Do you think that I need to see a solicitor? or get in touch with the Emploment Triunal? Many thanks for any imput.
  5. Hi I was wondering if anyone had any advice. My story is quite long so I will do my best just to enter the facts. I was injured at work in April 2009, I got company sick pay for 12 weeks and then went on to SSP, after the 28 weeks we up I got my SSP1 form when I got this form I asked if I could have my Holiday pay, I was told that I would have to return to work then have the Holiday pay,as I was signed off work I could not do this. Last year in September I asked again for My accrued Holiday pay, only to be told that there policy is use it or loose it, I told them that under law I was entitled to my holiday pay but they said that I am not. I have just asked them again for my accrued holiday pay and they have yet again said that im not entitled to any. The way I read the law is that if I was to terminate my employment contract they would have to Pay me, not just for 2009/2010 but also my year in hand. If on the other hand if I was to return to work would I then be able to take all of my accued holiday. I have been with this company since 1982. Holiday year runs from Jan 1st. Any Ideas would be a help.
