  7. Yeah I went, it was great, I REALLY enjoyed it. There opening gambit was "You're a very naughty boy, you need to manage your money better.....imagine their suprise when I opened up with "that isn't the issue...unfair terms & condtions, etc etc. " I had done my homework. The poor manager didn't know what to say. They just said thankyou for coming in, we will get back to you - they never did ! court forms now filed. It made me feel 200% better ! Bring it on !

    Get online to BBC Watchdog http://www.bbc.co.uk/watchdog and email them your complaint. Enough people doing thisd will make it prime time news. Lets get them on the TV and watch them squirm !
  10. This worries me, I am going to court but if I lose and the bank claims travelling costs, two 1st class returns to London can total £500+, I can't afford that ! HELP !
  11. To add to this, I visited the bank manager and complained about a £75 charge that was due 3 weeks after the meeting. At the meeting they agreed to refund the charge and indeed did it on the computer whilst I was sat there. BUT when the day came for the charges to be applied there were two entries on the statement, one saying "total charges to...date. and then another saying Refund of cahrges so they can't even stop it when they want to !
  12. Just going on what bankfodder put in the guidance notes, he said...quote.. On the issue of that the charges are merely a profitable service:- * You are arguing that under s.15 Supply of Goods Act the cost of the service is required to be reasonable. S.15 says that where no price is agreed at the time the contract is made, that a reasonable price will be implied. The cost of blocking a DD and sending letter is most probably less than 50p (or whatever you think that you can argue). The bank is a High Street business. Normal mark-ups on the High Street are 100%. It would not be reasonable for the bank to mark up significantly higher than this without a full and detailed explanation. The actual cost cannot be very high because the service is highly automated and operates millions of times per year so that the cost is spread and shared widely. The bank has been invited to provide a detailed breakdown of it costs and it will not do so. You can bring in useful documents as well where for example the bank has argued that the charges do only allow then to recover their losses. If the bank argues this then it effectively destroys their case that the charges are he reasonable price of a service. That's where my point comes in. Are you saying I shouldn't put this is my moneyclaim notes ?

Yes, but.........by the bank sending you details of revised charges by post as and when they change them and by the fact you continue to use your account you are accepting these charges and as such the variation to your contract terms and conditions. I'm happy to gop into court (soon) and argue the unfair contract terms angle but this one is a no-win as far as I can see.
  14. In the briefing notes there is a statement that says "S.15 says that where no price is agreed at the time the contract is made, that a reasonable price will be implied." My question is does thgis really apply as when you join the bank you are directed to their current charges and as such you are agreeing to those charges by taking on the contract.....arn't you ?

I ask for this information to allow you to demonstrate that these charges are fair and not punitive and do not form a penalty charge. To be classed as fair, I understand that these charges should not exceed your costs in applying them and hence a full and detailed breakdown will allow me to make a more informed decision. I would request that you supply this information within 10 days of the date of this letter. Details of Charges Date Detail Amount date Total charges to xx month yy £80.00 date Charge recall S/O-D/D £30.00 date Charge card misuse £30.00 date Charge unpaid item £30.00 Total Please note, this letter does not alter the position I laid out in my previous letter of 09/03/06 but allows you the opportunity to provide added detail for my consideration should you so wish.   16. One of the letters I read in a thread began with the phrase "without Prjudice". If you "google" that for its legal meaning you get : Negotiations with a view to a settlement are usually conducted 'without prejudice', which means that the circumstances in which the content of those negotiations may be revealed to the court are very restricted. I suggest people be very careful when using this phrase as it may invalidate any correspondance you wish to use later.

    Read the FAQ's and most everything else (but may have missed it) what I was (am) looking for is such as unfair tradings act 1928 or contractual terms act 1805 etc.

  19. OK - but isn't it worth hearing what they have to say ? they may just want to apologise unreservedly, refund everything and give me some chocolates as a bonus !!! OK that may be far fetched but if I just sit and listen and don't agree to anything and follow up with a letter after the meeting summarizing and saying my initial claim still stands, I'm OK yes ?

    Ah! OK. It's a HSBC account in England, normal current account and claiming for overdraft charges, returned items, cancelled DD's etc.

    Anyone got a good reference point for all the applicable law when claiming back these charges - so I at least sound like I know what I'm talking about :?
  23. OK, so I created the letter and addressed it to the manager at my branch and dropped it in at the counter this morning. The phone has just rung and they want to meet first think Monday morning top discuss - now the butterflies are kicking in! Any advise on strategy, what to say or not to say etc GREATLY aqppreciated.
