  1. thank you both for such speedy replies . DX i wasnt sure i could pay council direct but has definately giving me something to think about as bailliff fees have taken up a good portion of the amount im paying . And brassnecked i will send email as wasnt confident in phoning them so shall point out that it was natwests blunder etc and see what happens . should i get onto natwest also ?
  2. hi all , have been paying jacobs baillifs £20 month for old council tax and use there automated payment line , it was due on the 20th of june and tried paying on 18th but as natwest were having problems i couldnt pay it . tried again several days later and again on the monday but no luck . forgot all about it until later that week and payment was successful . Now this morning i have had a letter from jacobs saying that as i havent kept to the arrangement i now have 4 days to pay in full otherwise a bailliff will come to my property and more fees will be added , i have only £173 on one and £701 on the other so really dont want more fees , is there anything i can do as i did try to make payment .

  5. hi uncle,have cancelled d/d and have been to courts in colchester only to be told there is no fines officer and that the court manager was not in and that he would only tell me to contact bailliff as the debt has now been handed over to them .im willing to pay an amount i can afford but who would i pay this too ,straight to the courts using online system or phoning bailliff with a reasonable offer ,though i understand he could refuse and then im back to square one again .

  7. hi guys ,i know everyone is busy but really need to get this sorted by end of the day so should i cancel d/d to marstons as £162 is coming out on thursday and pretty sure i will not have funds to clear ,i know bailliffs will be round again but im prepared for that ,also if this does go back to court i am willing to pay the courts in the meantime using there online system so they know i am paying .also what do i do about bailliffs fees , sorry to harp on ,but im full of flu at the moment and probably not making much sense but if you read my latset post it explains more on the situation ,thanks again guys all your help is much appreciated as always

  9. hi guys i was fooled into believing he was hceo but further advice on here proved that he was a bailliff , at the time he said he could arrest me ,pretty scary stuff .But he is a baillif for marstons. Im looking for some advice on the last post that i made so any info would be greatly appreciated as i have till tuesday to cancel/or not cancel d/d .
  10. just a quick update , went to the courts this mrng ,politely asked to see the fines officer or court manager and was told that they have no fines officer in colchester and nearest one was in southend, and that the court manager was not in,when i asked when he would be in they just said they couldnt say .They then asked what it was about and explained and when they said i needed to phone blah blah i said that i had already done that and was told to phone bailliff direct and i said that i wasnt prepared to do that as i find them very intimidating and he wouldn't listen , a man in a cloak then said if i couldnt pay then it would go back to court and then i could explain the reasons why im struggling to pay , now im happy for that to happen as then i would have a better chance to explain my position , but in the meantime should i cancel the d/d to baillifs and i know they will come banging on my door but i know not to let them in also they have not levied on anything and also i havent sighned anything with the bailliff, also in the meantime i can pay something towards the fine weekly so that when it does go back to the courts they will see i have paid towards it ,i know im probably jumping the gun here but there seems to be little choice ,any more advice greatly appreciated guys .

  12. thought they were talking out their bums and did say that i needed to see someone regarding the fine and that was what they said ,oh well another trip to court tmrw morning and can i insist on seeing them regardless of what reception say ?
  13. wonkeydonkey advised me to go into the courts rather than ring them which is what i did but was told by the guys sitting at reception that this was not how it was done but to ring CENS enforcement office , really dont know where i go on this
  14. just a quick update , didnt get round to going to courts before 1st date of payment as we all was very ill with flu and stomach bugs so allowed the 1st payment to go through, now have been to magistrates court this morning and was informed that i couldnt see anyone from the court but to phone the CENS enforcement office and discuss lowering the payments with them , so phoned them and was then told that now the fine was with marstons they too couldnt do anything but had to phone Marstons which i did and spoke to a very rude woman who said i had to phone bailliff direct.Now i know for a fact he wont agree to lower payments as he was adamant that £162 had to be paid every month by D/D , is there nothing i can do as we are really going to struggle paying this on benefits ,also told courts that we was on benefits but still no help.Really dont want to talk to bailliff unless thats my last option , any advice would really be apreciated here ,thank you

Hi everyone ,just after some advice really concerning my landlord ,guinness trust . we have lived quite happily in our association house for 20 yrs without any problems untill recently . my 19 year old son is a mechanic and like most boys likes to tinker with his car and occasionally does repairs on ours ,nothing major just changing brake pads ect , now twice in as many months a woman from our local office (5 miles away) has apparently just happened to drive past and seen him repairing his /our car ,1st time she told us would let it go as we are not allowed to do repairs on our driveway and if caught again then matter would go further , but we desperately needed our break pads changing last friday so son on his day off changed them and this lady again was just driving past and caught him doing this ,had a right go at my son and said final warning was being sent by letter over wkend .Now im not sure of my rights here ,are we allowed to do minor repairs to our cars on our driveway that is next to our house or is she right that we cant , we have always had a car and always done any repairs needed without any problem at all ,now this woman has been at this office for about 9-12 months and is very pally with our neighbour who is a bit nosy and caused no end of problems on our street in the 4 yrs she has lived here,got a feeling as soon as toolbox comes out she rings her up and thats why she catches us but cant be certain that is the case , any input would gladly be appreciated on this as ive no idea whos right .
  16. from what i can understand ,donkey was taken to a donkey sanctuary for disposal and lady there said she would pay , my sons girlfriend then had a letter from vets to say this had been paid , now out of the blue this lady has txt sons g/f this morning demanding £250 as it was cremated instead ,she was unaware this had happened
  17. my sons girlfriend has just had a phone call to say that she needs to pay £250 this afternoon for a vet bill that she was told had been paid by a mystery donor and has proof of this in a letter that was sent to her , this realates to her donkey that died suddenly a few months back and called vet for removal of body and was told it would be sold as meat (yuk) now she has found out that donkey was actually cremated and now demanding full amout today ,can anyone please advise as she works but on a low income (she,s 19) and is very worried , thank you

Thank you so much WD ,i understand not to ring courts but to prepare I&E ( is there a form or could i just write everything down on paper ) and then pop along to local courst and just ask for a means testing hearing , sorry to sound so thick but i need to prepare in my head as dont like courts/baillifs find them very intimidating . will also ask for enforcement to be put on hold if dont get to speak that day .Also have paid £20 -£30 of the original fine making it £200 + baillifs fee that has now risen to £493. will do I&E tnite and go to courts tmrw ,many thanks again .

Thanks to everyone for advice ,just have a couple of questions that im not sure about , 1...the court hearing was in colchester magistrates court (my town ) but other correspondence with fine was essex magistratesn,fines enforcement office in southend,so who do i need to contact to apply for a means tested hearing ,and what dept do i ask for ? 2...will i need to attend court for the means tested hearing ? 3....the total amount of the original fine was £233.00 set by the courts , now with baillif fee it is now £493 is that right ? As soon as i have all info will get onto it right away as first payment is due out on 1st march ,ahh just remembered another question ,as we are in reciept of pension credit ,child tax credits and child benefit can i ask to have payment taken from benefits ?   20. i will remember that for future reference guys ,though hoping not to go down that road again .Also is it worth asking courts for a means tested form as we are really going to struggle making the monthly payments that baillifs want .
