  1. Hey all Firstly If this isn’t in the right thread could it please be moved to the right one. back in 2011 I was made bankrupt and over the years I’ve randomly checked my credit file but didn’t bother to much due to the bankruptcy. Ive done it this week for the first time in a year to see if my BR had come off of which it has which pleases me. Howver i then spotted I had a CCJ issued against me in May 2017 from a property I moved out of in Feb 2013 ! I remember the bill for £1500 to a housing association which I disputed and was told it was dealt with and that’s it and not to worry. This was in 2013, so to my horror I’ve now got a CCJ for £1500 which for four years I’ve heard nothing from them, no letters or phone calls Where do I stand on this, I’ve known nothing about it until today
  2. Sorry but I find that hard to believe. When speaking with the council they send they can do it and also informed me that as I'm claiming ESA they will tell the DWP and will wait for the new award notice. Now if they can't do this, why do they say they can ?
  3. Back in Aug this year i had a letter come through stating i am under investigation for benefit fraud, i went for an informal interview and found out what had happened My wife gets paid cash in hand for 3hrs work a week and i didnt disclose it, even though i have a recorded call form them stating otherwise. 1-0 to me. Secondly, i hadnt informed them my tax credits had changed, again its on record i did ring and was told not to send the award notice in as they can go into the DWP system and find it anyway...2-0 to me. Then at the interview i was told i had been overpayed £650 in housing and council tax benefit. i argued this and done my own figures to prove it was approx £40m when they saw my workings out they agreed !!!...3-0 to me. Then tuesday i had sent them info of myself claiming ESA as i wasnt entitlied to SSP, BUT im still employed, even though my income went down by £50 a week so i though nothing of it. That was until friday, i had a letter asking for for my WTC and CTC award notice to be sent to them as im not entitlied to it even though im employed over 16hrs, want my wifes pay slips for the last 5 weeks, (dont get them, payed by cash, i sent them a form her employer filled out!!!!) In this letter it stated i had another over payment of over £200 as they nolonger allow my wifes DLA to be used in there calculations for the disability element, BUT if i cancel my claim and redone it in her name then the over payment will be removed and it would sort it self out. Funny thing is shes had for over a year and they have used it in there calculations since OCT 2010 but are no longer willing to do so as its in my name. Ive never had to claim before and our income from 09 went from 65k a year to 7k due to her illness etc So enough is enough, im taking them to court and im gonna beat them so hard, firstly for having to work out calculations there dept should be able to do but i had to, what happened if it was someone who didnt know like i did???, they would have payed the £650 !!!, secondly for the way there acting now, because of what happened in Aug, im being treated differently. I have already helped 2 other people who are self employed get the full amount as they done there caluculations wrong !!!
  4. Hi All A friend of mine has a debt with HSBC in which her ex forged her signature and obtained credit. Now it has been ignored for a while but i have offered to get this sorted, it was passed to mackenzie hall DCA which i CCA'd and that went pass the deadline, got a reply from arrow global DCA who it seems have the same email address as mackenzie hall saying thanks for the letter we are not the creditor but have passed the details on, this was a full week after the CCA deadline. Two days before she received the letter i sent off a failed CCA request and am waiting for a reply from them, nothing on her credit file ref to this, whats the next phase? Thanks
  5. Agree with the above, i have just been considered for an early discharge, but do you homework and you'll be fine It was the best thing i have ever done, i only heard from the OR 3 times since my BR date and that was just asking for more info etc. They will only freeze the account if u have a debt with the bank it is with, so open a parachute account, co op basic account is brilliant and get eveything payed in there if u have no debt with them. I asked about this and the OR said no as i had no debt with the company and i can go ahead and use it as normal !
  6. Hi All throwing this up for my brother, hes been off work for 7 weeks and does not earn enough for ssp, so he received his ssp1 from the employer and has sent this back to the job centre as well as his medical certificates from the gp. Now, he was told by these people when he made his claim over the phone that he does not need to contact the WTC office as he is employed at 16 hrs a week but only is gonna get ESA until hes fit enough for work. Does this sounds right?, and will he have to attend the local job centre for any reason Thanks
  7. NO they cant ask for them, but if you really want help get the MALG guidelines medical evidence form and get that filled out and sent off. Its there to help, if you dont how do they know how ill or how much suffereing is going on, it could just be a pack of lies, Ive done the form myself and know a few who have and in total had about 50k wrote off on medical grounds, so dont listen to those who say dont do it as you will never get rid of any debt etc, your choice !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
  8. Dx i understand this, but it takes a bloody long time it's alot of work to do and can cause a serious amount of stress and agro. Bad advice IMOP Its best to sort a DMP then go that route, which you can still do and at least you know where you are now. Even then, reclaiming might not have to happen if they realise how much they owe who, but that depends on which company
  9. Sorry sequenci.....i havnt put it on the forum as of yet because as you know "they" read these. If they see the plan etc then they can be prepared and when someone has severe mental health issues the longer this drags out the longer the pain and suffering etc. However, i did put up my case on the other section when dealing with lloyds
  10. [email protected] this is the CEO's email, hes very very good and gets the message passed onto one of his PA's and my issues was sorted within 2 days
  11. Look here and ring this number in that post.......there very helpful with mental illness etc, by law they have to be. Do u seek any other medical help, i.e mental health professionals? http://www.consumeractiongroup.co.uk/forum/showthread.php?309943-Lloyds-Customer-Support-Debt-Management-contact-details.(1-Viewing)-nbsp
  12. One i dont understand is about the default, i have 2 that were placed after my BR...i have been told there are allowed to do this but when my BR falls off the defaults wont have as they been on there 3 mnths after being declared. Apparently they are allowed to do this so say the 3 CRA's
  13. Ring the national debtline there better than payplan, personally a DRO is for the individual so the property is nothing to do with you so it should have nothing to do with the DRO
  14. if the house is only in his name no they cant touch it, council guy is talking crap.....you had the debt or incurred the debt before you went BR. even though you have only found out about it, he said that as he wants his money lol
  15. and here, look at the answer http://bankruptcy.org.uk/archives/item/8050-what-happens-if-i-forget-a-debt-in-bankruptcy You'll be fine as BR is the person and not the creditor
  16. http://www.beatmydebt.com/news-articles/I-forgot-to-include-a-debt-in-my-bankruptcy-can-I-add-it-later.htm look here, 4th paragraph, states if debt was incurred before you were declared and forgot to add it, you can now include it in your BR
  17. As you still an undischarged bankrupt, ring your OR and explain all of this new debt of which you have only been made aware of. See if you can include into your bankruptcy......im think it is possible to do so but you dont know if you dont ask. You havnt had the debt after your BR but leading upto it so it might be included
  18. Same as myself, where i live there is no public transport and i work nights, i was allowed to keep the car due to work but also my 3 year old has to go playgroup in another village with no public transport and my wife cannot use public transport due to her illness so for trips, shopping or appointments i was allowed to keep it. My OR is a very nice women.
  19. debtinfo.. I've leanrt alot from you and as im in my bankruptcy you have opened my eyes to what i can ask as such, i was worried about my IPQ but like you said if i dont i ask you wont get Thanks
