  1. Hello, Just fuming with the RBS! This month I am moving house - next Saturday to be precise - and becasue of this I cancelled the direct debit for my loan payment this month so that I would have enough in my account to cover all the payments I need to move. I did this last time I moved and was advised by the lady at the bank that once the loan bounced they would write to me and set up the DD again. I see today that they have taken the loan eventhough the direct debit is cancelled! When I called to ask how this was possible, I was told that they have the right to take it because I have signed a form to say I'll pay each month. So, my question is: what is the point of having a direct debit for this amount when they can take it as and when they like anyway? Is there anything you fellow forum users can suggest as I am really not happy about this. I am trying my best to reoganise my money so that I can live and RBS keep sending me up the proverbial creek without a paddle! I will now be changing bansk so that my wages are paid into my Co-Opertive one account. Poor show RBS and I've been with you for over 10 years! They just disgust me to be honest!   2. Hi Hallowitch, Thanks that's very interesting - I'll defo be looking into that. The baliff is Equita. I feel quite calm at the moment. The DCA's have also calmed down - they've stopped phoning me at work, so that's under control.
  3. Hello Plodder Tom and thanks for your feedback. I have all the details you've mentioned above, the letter from the council included them all. I have negotiated a 14 day break from baliff calls to fill in a budget sheet so that's great. The say they will look at the account once I fill in the details they ask for. Will keep you updated.   4. Hi Determindator, Yes - there's been an update. I emailed the council asking them to call off the baliff, and sneekily paid another £10 through the online payments system, until we had at least finished the budget sheet process which they have agreed to do. So, I have 14 days grace from baliff visits. However, the council are saying that I need to pay at least £100 each month. There's just no way I can afford that and they'll see that's the case when I send in the budget sheet to them. The baliff has not left anything detailing how much hey have charged us, just the standard removal letter and a schedule detailing what they wanted to take. Thanks for your help I will update as and when I've sent in the budget sheet and had a reply.
  5. Hello, OK I will ignore the baliff, anyway my partner will be out most of the day and will have the car with him. Plus, it is parked in a gated carpark which requires a key code to get in. So, hopefully, that side of things will be alright. Should I call the baliff and tell them that I am negotiating with the council? In answer to your questions Martin: Yes, the council did respond in writing. No, I've not returned the form yet, have been getting the figures sorted out so as to be accurate - getting balances from credit cards and the like. They got the liability order sometime in November I think - don't eall know as I never recevied the summons to court and I've told them that too. Incidentally, I find it astonishing that you can be summons to court with a letter that is not even sent recorded delivery. When I pointed this out the council said they can't do that as there are too many letters and they only have to prove they sent it. I did some researching on lost post from the royal mail and found, from their own figures, that over nearly 97,000 complaints of lost, misdelivered and unconfirmed delay or loss were reported to the royal mail in the first quarter of 2010/11! Anyway, sorry back to topic. The council have also confirmed that some of the mail sent to me has been returned to them unopened, so it's possible the summons was included in those letters. The arrears is £366 so far with theis years bill due now as well. I've received a new summons for this years bill too! However, in the letter from the council I was advised that a final reminder should arrive and then the summons - Iv'e not had the final reminder. I am not on any benefits - I am one of those people who just fall outside of the criteria for claimimg anything, but don't quite earn enough to keep afloat! Will start a separate thread for the DCA issues. Your help is really appreciated!

  7. I have a council tax debt that has been passed to the Baliff, Equita. They wrote to say they were coming so I wrote to the council tax dept, including a £10 payment and asked that they take the debt back and negotiate with me directly. They responded by accepting the £10, but refusing to take the account back from Equita. But, he has included a budget form for me to fill in and return. Today the Baliff claims to have been to remove goods - although I doubt it as my partner has been in all day and says he's not seen anyone. Amusingly, they've put a letter through the door stating they are coming back with immediate effect. They've also included a schedule of items they think they will take, which details a car that's not mine! should I call the council tax guy and ask if he will at least call off the Baliff while we are communicate? Also have a DCA calling me at work - everyday! Is this allowed? Any advice as to the next step to take please. Sorry didn't even introduce myself - as my username suggests - I'm in a pickle emotionally at the present time. Trying to stay calm!
